Buying Peace From a Bully Only Funds the Next Extortion
The Settlement Was Never Final
Nine elite law firms paid almost $1 billion and bent the knee to Trump’s administration, apparently believing that surrender would buy them peace. It did not. The ABA’s lawsuit, the DOJ’s subpoenas, and the fight over Boris Epshteyn’s files show the obvious truth the firms tried to avoid: capitulation does not end coercion. It teaches the coercer that pressure works.
Power Sat With Trump, Not the Firms
The institutional power in this story belongs to the White House, the DOJ, and Trump’s personal network around Epshteyn. That matters because the reporting exposes a deliberate campaign, not an accidental conflict. The ABA says Trump targeted firms to intimidate lawyers from representing people and causes he disliked. The firms that settled did not neutralize that machinery; they legitimized it.
The DOJ Is Not Cleaning Up a Mess
The Justice Department’s July subpoenas are being sold as routine litigation, but the sequence tells a different story. The DOJ asked the same firms for communications tied to negotiations and enforcement, even though much of that material likely already sits inside the government’s hands. That looks less like a search for truth than an attempt to jam the ABA’s subpoena and protect Trump’s inner circle from exposure.
Legal Form as Political Cover
The DOJ’s effort to disqualify Susman Godfrey leans on a strained reading of Rule 3.7, a rule about necessary witnesses, not a broad prohibition on any lawyer who might know anything. The brief does what authoritarian legal strategy always does: it dresses leverage up as doctrine. It turns a procedural rule into camouflage for retaliation. The point is not fidelity to professional ethics. The point is to make resistance expensive and compliance contagious.
The Firms Gave Up Standing and Got Nothing for It
The nine settling firms now face an ugly contradiction. If they cooperate with the DOJ subpoenas, they may help disclose the very material the government wants blocked from the ABA. If they refuse, they admit the weakness of their earlier surrender. Either way, their bargain is exposed as fake security. The firms that fought Trump and won are the ones with actual standing; the firms that paid off the bully are just evidence.
The Pattern Is the Point
This is not about one dispute over document requests. It is about how authoritarian pressure works in practice: isolate institutions, punish defiance, reward compliance briefly, then return for more. The subpoena fight shows how easily law can be weaponized against the people meant to uphold it. And it shows the cost of elite cowardice. Once powerful institutions decide preservation matters more than principle, they stop defending the system and start financing its collapse.
