Yesterday during the show, you guys might remember that the Texas Ethics Commission, kind of out of nowhere.

I'm sure there were, you know, backdoor discussions and those sorts of things, but kind of out of nowhere, it appeared like uh to be to be totally fair that the Texas Ethics Commission was just randomly on a random Wednesday gonna show up and they were going to increase the per diem for legislators here in the state of Texas, which of course, as we talked about yesterday, would also have the byproduct, the symptom.

That means uh that lawmakers are able to get wined and dined by lobbyists without any transparency, and that number goes up.

And so, rightfully, some of us were not very happy with that arrangement.

Uh, and and that's without even understanding that it connects back to the lobbyists and the secret meals and the secret money and and these sorts of things.

And so there was a lot of problems.

The the biggest of which probably was the lack of transparency because it just seems to have come out of mostly nowhere.

Obviously, you're gonna have to have raised discussions, and it makes sense they have an ethics commission that rules on what's fair, but also that still needs to be accountable to the people.

One of the biggest problems in our modern government is that there is literally no transparency or accountability.

And part of the problem is that one, the checks and balances aren't going so well in general.

And so, you know, there was a lot of there was a lot of backlash at the Texas Ethics Commission for even talking about doing this, especially on again a random day that nobody really knew was coming.

They voted yesterday to table the proposed increase without discussion.

Largely, I would, I would wager, because people started finding out about it.

People said, oh, well, if you're gonna have this meeting, we should show up, we should find out what's going on, we should have, you know, voter participation.

And so we all know exactly what it would have done and exactly why there was backlash, because again, this is raising per diem without talking to the the people of Texas, raising, I mean, it's not raising the salary, but for all intents and purposes, without the amount they wanted to raise it, it would have been an extra$10,000 a year, at least, assuming no special sessions, which if you've ever met Governor Abbott, those are kind of inevitable.

And so at the end of the day, we realized not only did it raise per diem by a significant amount without talking to the people, but because of the rule that lobbyists can spend up to 60% of the daily per diem on a single thing for a candidate without having to inform the people and put down details and who they were whining and dining, the end result would be that, of course, they could spend lobbyists could spend significantly more money on buying and paying for politicians without telling you they're buying and paying for politicians.

And so people rightfully said, not cool, we don't want that.

And rather than vote on it and say, We're not gonna do this, this is clearly wrong, or have massive public discussion, instead they just tabled it.

The Fifth Circuit has now struck down a federal ban on interstate handgun sales.

Several provisions of the federal code, which were enacted back in 1968, so it's been a while, almost 60 years, collectively prohibited the buying and selling of handguns across state lines.

Uh the first section 922A3 prohibits unlicensed individuals from transporting or receiving into the state a firearm obtained outside of the state.

The second, section 922A5, prohibits unlicensed individuals from selling or delivering firearms to individuals known or believed to reside in another state.

Together, they basically, I mean, as a category, just outlaw all direct sales of handguns to interstate commerce.

And so Tim Herron of New Mexico and Freddie Blish of Arizona are individuals who have sworn they would be customers of Elite Precision's Customs LLC, a federally licensed firearms manufacturer and dealer located in Mansfield, Texas, if not for the ban.

And so the plaintiffs uh sought a permanent injunction that would block the provisions from being enforced.

The DOJ, of course, sought to just have the lawsuit uh dismissed entirely, not even go after it.

district judge Mark Pittman found that the challenge provisions do not function as a de facto prohibition on possession, but rather a reasonable commercial restriction enacted by Congress.

And so the district court concluded that they don't violate the Second Amendment, which I I mean is just absolutely insane.

Regardless of that, the plaintiffs appealed the case, as they're allowed to do, to the Fifth Circuit Court of Appeals in New Orleans.

Now, the Fifth Circuit has been on a bit of a run recently, uh, mainly because the Fifth Circuit has behaved the way that judges are supposed to behave, which is not to write law, it is not to enforce law, it is to interpret existing law.

That's all they're supposed to do.

And they're supposed to, and of course, there are always subjective things, and things can be vague, and so you need courts to do this.

That they're supposed to go in and give you guys an objective reason why they ruled the way they did, using sentence structure and everything else, legal precedent, all the other things that have been built up to make those rulings.

And so the Fifth Circuit has actually been doing that largely, not perfectly, but they've been doing it to a large degree.

And it's been fascinating to watch.

Regardless of that, it went to the Court of the Fifth Circuit Court of Appeals, where it was heard by a three-judge panel uh consisting of uh judges Jerry Smith, Kurt Engelhart, and Katharina Haynes.

The only issue that actually went before the Fifth Circuit was whether the three challenge provisions are constitutional under the Second Amendment.

That was it was very straightforward, incredibly simple.

Those three provisions, which have been enacting since 1968, someone had enough of a damage to take it to court and say, hey, these are actually unconstitutional and you need to rule on it.

And so just recently, the panel released its decision.

It was two to one, finding that the provisions are unconstitutional under the Second Amendment, which reversed Judge Pittman's order and blocked the provisions from being enforced.

Now, the woman, Judge Haynes, she dissented from that.

It then becomes the government's burden to prove, to justify any regulations they have by demonstrating that it is consistent with the nation's historical tradition of firearm regulation.

Now they could appeal, and I don't want to get ahead of myself and say they're not going to, because we're not profits, we can't see the future, you know, we can't plan for tomorrow, we can only do what we can today.

Now, a couple of things that I want to note.

First of all, winning a case in general at any level bodes well for the future.

But a vast majority of the time, because there's now technically a precedent from an existing judge, when it goes to a higher court, they have to not only rule on the case, but also by nature say the other judge was wrong, the other court was was mistaken.

And that's a higher burden to do, generally, than simply just sitting there and and saying, we're gonna rule on this.

And so the fact that the Trump DOJ is not expected to appeal, combined with the fact that the Fifth Circuit has now ruled favorably against the DOJ and in favor of the right of the people to keep and bear arms, which shall not be infringed, bodes very well.

Uh now, on the same day as the panel ruling, the DOJ's Office of Legal Counsel released a legal opinion on a separate Second Amendment issue, concluding that the federal prohibition against licensed dealers selling handguns to otherwise law-abiding adults aged 18 to 20 is inconsistent with the Second Amendment and therefore unenforceable.

In other words, the Trump DOJ, while there are existing laws they're enforcing, are also coming out and saying, but that doesn't mean we want to.

Attorneys for a woman identified as Jane Doe have filed a federal lawsuit against several Houston area hotel operators, including Wyndham Hotels and Resorts, alleging that the businesses enabled and profited from a sex trafficking scheme allegedly organized by a former Klein Kane High School teacher and her adult son, which we've reported on before.

Now, Houston was the first major U.S.

Uh, back in 2020, the city approved requirements for hotel and hotel owners, managers, and employees to receive training on how to recognize and report potential trafficking.

So the lawsuit alleges that despite having that training, the hotels failed to act, even though there were warning signs, and instead prioritize their revenue and just basically not having to deal with any sort of conflict.

Now, I will say it's crazy because the case against the former teacher was actually dismissed in January of this year, which we reported on due to insufficient evidence.

However, her adult son, Roger McGee, pleaded guilty to child trafficking and is currently serving a 20-year sentence.

It's a little bit crazy to me that despite the fact that we got the adult son uh and it was very clearly connected with his mother, we weren't able to continue the case, allegedly speaking.

And so that got dropped.

Uh, but now they're filing a federal lawsuit against the hotel change that allowed this to transpire.

Now, a couple things that I want to know, because I want to be as clear as I can about my opinion on all of this.

The the reality is that obviously there are multiple guilty parties in almost any sort of crime.

It results in a bit of a tussle uh and a headlock.

The Texas Ethics Commission typically intervenes only in more egregious cases, and we know that collecting fines can take years, but the new ordinance, I think, will function less as a punishment than a signal that that you don't get to just do that with no accountability.

And just in the Greater Houston area, we know we've had multiple instances of abuse and disciplinary punishment as a result of that abuse, right?

And so Texas City Police revealed new details yesterday about two department employees accused of misusing the city's flock license plate reader system, including a dispatcher who searched for her own child dozens of times and a police sergeant who was demoted.

The details were presented during a special Texas City Commission meeting yesterday night, focused in part on the police department's use of automated license plate readers.

Assistant police chief James Patterson said that an audit launched in August uncovered two separate cases of misuse.

But even if you're a pro-immigration person, the basis for being pro-immigration is generally a very, very strict adherence to what they call empathy, which is where they feel what other people feel.
