Before Congress can impose an obligation, it must possess the constitutional authority to do so. Before the government can claim jurisdiction, it must establish the lawful foundation for that jurisdiction.
And before an American is threatened with confiscation, prosecution, or imprisonment, shouldn’t the government be required to establish the authority it claims to exercise?
A STATUTE CANNOT CREATE AUTHORITY THE CONSTITUTION NEVER DELEGATED. A REGULATION CANNOT MANUFACTURE JURISDICTION. AND NO DEFINITION CAN TRANSFORM AN ALLEGED POWER INTO A LAWFUL ONE.
Yet Americans continue arguing over the language of statutes while neglecting the fundamental question of authority.
WE ARE DEBATING THE RULES BEFORE ESTABLISHING WHETHER THE GOVERNMENT HAD THE POWER TO MAKE THEM!
The government invokes Article I, the Sixteenth Amendment, and the Internal Revenue Code as the foundation for its claimed taxing authority.
But invoking a constitutional provision is not a substitute for examining what that provision actually authorizes, what limitations remain, and whether the asserted jurisdiction reaches the individual.
