00:00:17.839 --> 00:00:32.079
This October 5th, jury selection will begin in the federal trial against former Stout and Police Officer Matthew Farwell, who's charged in the death of Sandra Birchmore, who at the time was 23 years old and she was pregnant.
00:00:32.320 --> 00:00:35.039
This case has gotten our national news.
00:00:35.200 --> 00:00:38.640
With us today is senior editor of LA magazine.
00:00:38.799 --> 00:00:44.479
She is the author of Mayhem, The Sarnov Brothers, the FBI, and The Road to the Marathon Bobbing.
00:00:44.560 --> 00:00:50.079
She's also a podcast host and executive producer of Kingdom of Fraud and Mayhem with McPhee.
00:00:50.159 --> 00:00:52.880
Please welcome investigative reporter Michelle McPhee.
00:00:53.039 --> 00:00:54.560
Michelle, we finally got a chance to do this.
00:00:54.799 --> 00:00:55.119
I know.
00:00:55.200 --> 00:00:55.840
I'm so excited.
00:00:55.920 --> 00:00:57.520
It's so nice to be with you.
00:00:57.840 --> 00:01:05.120
Well, uh, this case is actually this is perfect timing because, like we said in the uh introduction here, we have jury selection.
00:01:05.200 --> 00:01:07.359
Now, this is a federal trial, folks.
00:01:07.599 --> 00:01:14.560
So this is this is going to be a little interesting because this kind of like wasn't on the radar for many years.
00:01:15.040 --> 00:01:26.400
Which is kind of astonishing because this case is so wrapped up with the Karen Reed trial that we know made international headlines and became a phenomenon, just like we're watching right now with Lindsay Clancy.
00:01:26.959 --> 00:01:30.079
But this case kind of flew under the radar for a while.
00:01:30.400 --> 00:01:44.159
But I think out of all of these cases, this one is the most intriguing because it goes back to a little girl who was 12 years old looking for male guidance, looking for mentorship, and she entered the police explorers program.
00:01:44.480 --> 00:01:51.359
And that's when she met this allegedly corrupt coterie of police officers.
00:01:51.519 --> 00:02:00.719
And I think for you and I, it's especially heartbreaking to think about cops that are responsible for these sort of heinous allegations.
00:02:01.040 --> 00:02:03.760
Yeah, no, this is this is beyond intolerable.
00:02:03.920 --> 00:02:09.520
I always said anything against young children and senior citizens is off the books.
00:02:09.599 --> 00:02:19.680
I mean, that's something like where you lock people up and throw away the key because there's no excuse for this stuff, especially when you're in a position of authority and you take advantage of somebody.
00:02:19.840 --> 00:02:26.000
And and this is this is probably one of the worst cases that we've probably seen in regards to that.
00:02:26.879 --> 00:02:39.280
Well, it seems that this police explorers program, and I know we're going to get into the details of the case, but you know, there was somebody right here in California who was locked up very recently for another allegation of hooking up with a minor.
00:02:39.360 --> 00:02:43.759
And I think that we need to take a hard look at this program and like, okay, what's the point of this?
00:02:43.919 --> 00:02:48.240
We're putting, you know, um young girls in harm's way.
00:02:48.479 --> 00:02:54.240
It's unfortunate because this is a program that works for well, but it's run by the Boy Scouts of America.
00:02:54.319 --> 00:02:57.199
So I think there's some eyebrows to be raised right there.
00:02:57.439 --> 00:02:58.960
Oh, yeah, no, absolutely.
00:02:59.199 --> 00:03:06.800
Do you think this case only came to light because of all the stuff and all the allegations and corruption stuff with Karen Reed case?
00:03:07.199 --> 00:03:08.560
So we this is what we know.
00:03:08.719 --> 00:03:13.039
Sandra Birchmore, as you mentioned, was a 23-year-old pregnant teacher's aide.
00:03:13.280 --> 00:03:24.240
On February 1st, 2021, there was a nor'easter in Boston, just like the John O'Keefe case, the Boston cop who Karen Reed was accused of killing and was later acquitted on those charges.
00:03:24.560 --> 00:03:27.039
Sandra Birchmore didn't show up for work.
00:03:27.199 --> 00:03:34.719
And on February 4th, the Canton Police Department did a well-being check at her home in Canton and found her deceased.
00:03:34.960 --> 00:03:42.719
And what raised alarm bells, at least for the FBI, is that police immediately ruled this a suicide.
00:03:42.800 --> 00:03:44.639
Now you can speak to how unusual that is.
00:03:44.800 --> 00:03:53.280
The cops don't walk in and immediately say, Oh, this is a suicide without some sort of evidence, uh, at least an autopsy, at least Emmy's ruling.
00:03:53.439 --> 00:03:59.840
But on day one, her aunt got a call saying, We found Sandra, she killed herself.
00:04:00.000 --> 00:04:05.120
Uh, they had she allegedly used a duffel strap from a U.S.
00:04:05.199 --> 00:04:06.400
Army duffel bag.
00:04:06.479 --> 00:04:14.080
She had briefly uh enlisted in the Army, and then they find her with one end of the strap around her neck, the other end around a doorknob.
00:04:14.159 --> 00:04:15.919
It's like a scene out of the Sopranos.
00:04:16.000 --> 00:04:20.879
This is not a usual way that someone could commit suicide to begin with.
00:04:21.120 --> 00:04:23.279
So right away there were unanswered questions.
00:04:23.439 --> 00:04:40.879
And one of the biggest unanswered questions was almost immediately, we know, that friends and family of Sandra Birchmore called the Student PD, they they called uh other investigative officers in the Norfolk County DA's office and said, Look, you guys should take a look at this guy, Matthew Farwell.
00:04:40.959 --> 00:04:51.040
He's married, uh, he's been sleeping with Sandra for years, and Sandra was telling everyone that Matthew Farwell was the father of her child, her unborn child.
00:04:51.279 --> 00:05:01.120
Not to mention, Matthew Farwell was the last guy to be with Sandra Birchmore, you know, on the night of February 1st, which we now know is the night that she died.
00:05:01.279 --> 00:05:07.839
And yet somehow, and I think this, you know, you and I both have experience with the NYPD.
00:05:07.920 --> 00:05:20.560
I can't imagine a scenario where the detectives on if there were allegations swirling around an NYPD cop, I'm pretty sure the precinct where he worked is not going to be the investigative body.
00:05:20.800 --> 00:05:24.639
But in this case, Matthew Farrell was a Stoughton police detective.
00:05:24.959 --> 00:05:29.360
He his cases were brought to the Norfolk County DA's office.
00:05:29.680 --> 00:05:32.879
These are buddies, friends, colleagues.
00:05:33.040 --> 00:05:35.920
You know, this is a very tight-knit self-shore community.
00:05:36.160 --> 00:05:45.519
So he was essentially questioned and never brought to uh any charges by people he spent his daily life with.
00:05:45.680 --> 00:05:53.360
These were his closest friends, these were his colleagues, these were the people that he hung around with every day, and they immediately ruled it a suicide.
00:05:53.439 --> 00:06:05.839
And Matthew Farwell got a pass until the FBI, as you mentioned, started sniffing around in the John O'Keefe case in 2023 and found these alarming allegations about Sandra Birchmore.
00:06:07.120 --> 00:06:07.680
Right.
00:06:07.920 --> 00:06:14.879
And this ironically happens on February 1st, is the same night that his wife was giving birth to what, to their third child.
00:06:15.120 --> 00:06:16.720
Well, this is what's so intriguing.
00:06:16.800 --> 00:06:18.319
How do they not think this is odd?
00:06:18.480 --> 00:06:30.800
Matthew Fowell drops his wife Michelle, who he married one month after he is accused of taking Sandra Birchmore's virginity when she was underage, which in Massachusetts is the crime of statutory rape.
00:06:31.040 --> 00:06:36.959
So he allegedly, according to federal prosecutors, raped Sandra in April of 2013.
00:06:37.199 --> 00:06:40.639
He married his wife, Michelle, in May of 2013.
00:06:40.800 --> 00:06:43.920
The Stought Police Department put out this big celebratory announcement.
00:06:44.079 --> 00:06:46.560
Congratulations, Matthew and Michelle Farwell.
00:06:46.959 --> 00:06:54.319
And by the time of the night of this murder, Michelle Farwell was about to give birth to the couple's third child, the son.
00:06:54.560 --> 00:07:08.240
So he drops her off at a Boston area hospital, drives through a blizzard to Canton, where Sandra Birchmore lives, he tells his colleagues, his friends, his buddies, the detectives, that, hey, yeah, we had a fight, no big deal.
00:07:08.399 --> 00:07:09.920
Uh, I don't know, you know her.
00:07:10.000 --> 00:07:11.199
She's 5150.
00:07:11.279 --> 00:07:12.720
She's a little crazy.
00:07:13.040 --> 00:07:15.279
And that apparently held water.
00:07:15.519 --> 00:07:25.759
But the idea that somebody would drive through a blizzard to have a fight with a longtime lover, victim, depending on your point of view.
00:07:25.920 --> 00:07:29.040
The defense attorney would say she's a lover.
00:07:29.199 --> 00:07:30.800
This is all consensual.
00:07:31.279 --> 00:07:34.240
Federal prosecutors say she was a grooming victim.
00:07:34.480 --> 00:07:37.279
Either way, he went to Sandra Birchmore's home.
00:07:37.360 --> 00:07:38.079
We know this to be true.
00:07:38.240 --> 00:07:55.680
We have video of him entering the building, and then he drives to the hospital in the same clothes he's captured on CCTV surveillance video, where his wife gives birth to their third son, who ironically is the son that he was with when he got arrested, I believe.
00:07:55.759 --> 00:07:56.879
It was one of his three kids.
00:07:57.120 --> 00:08:02.240
He was arrested in August of 2024, not by the Norfolk County DA's office.
00:08:02.560 --> 00:08:10.399
He still hasn't faced any state charges, but he is charged federally with the murder of Sandra Birchmore, the murder of her unborn child.
00:08:10.560 --> 00:08:17.199
And you know, the I think the tough knot for prosecutors to prove is that he killed a witness.
00:08:17.439 --> 00:08:40.720
So she was clearly talking about the crimes that she had suffered at the hands of Farwell and allegedly his twin brother, who was also a stone police officer, their buddy, Robert Devine, who was also a police officer and is now an attorney, still an attorney, which is shocking despite these allegations, and the town's animal control officer.
00:08:40.879 --> 00:08:42.320
I mean, can you imagine this?
00:08:42.720 --> 00:08:47.360
All of these men who have now lost their jobs or who have not been arrested yet.
00:08:47.519 --> 00:08:52.399
It seems to me that this could lead to additional charges down the road.
00:08:52.639 --> 00:09:12.720
Uh, when you're looking at this group of cops who exchanged videos of Sandra Birchmore and who is uh now accused of grooming and abusing her for years, uh, if the feds are involved, I'm thinking there could be some sort of civil rights or human trafficking case coming down the pike for the rest of these guys.
00:09:13.039 --> 00:09:16.159
Yeah, I think there's a lot of uh sleepless nights going on over there.
00:09:16.240 --> 00:09:31.519
I mean, when you read this case and you start looking at it for the some of the people that are involved or allegedly involved in this, they they have to be like wake up all night because you know the feds always are lurking anyway, but they they happen to do like one case at a time, too.
00:09:31.679 --> 00:09:34.159
So they do one case, they get it out of the way.
00:09:34.240 --> 00:09:39.039
Uh, I mean, the prosecutors won some big motions in the last couple of weeks, right?
00:09:39.120 --> 00:09:50.799
The the big one was allowing her text messages in because the defense was saying this was hearsay, but uh you know, she's now deceased, and the judge is like, uh, yeah, no, this is this is going to be allowed in.
00:09:51.039 --> 00:10:06.879
Yeah, that was a huge win for the prosecution because Sandra essentially left like a like a breadcrumb trail of what happened to her, you know, from the time of the alleged statutory rape all the way up to the days before the murder.
00:10:07.120 --> 00:10:10.879
She even told one of her friends, hey, Matt's been acting pretty weird.
00:10:10.960 --> 00:10:16.879
He came over here and took a look at like at my closet door where she was found hanging later.
00:10:17.039 --> 00:10:18.480
You know, he was acting a little weird.
00:10:18.559 --> 00:10:19.679
All of a sudden he's being nice to me.
00:10:19.759 --> 00:10:21.120
I don't know what's going on.
00:10:21.440 --> 00:10:28.559
So she left clues that would eventually lead the FBI and federal prosecutors to lock him up.
00:10:28.720 --> 00:10:34.960
Clues that apparently were overlooked by his colleagues in the Norfolk County DA's office.
00:10:35.840 --> 00:10:40.720
And and then the other twist is this army sergeant, was it Jason Picard?
00:10:41.279 --> 00:10:42.559
Jason Picard.
00:10:42.799 --> 00:10:46.159
Yeah, we broke that story LA magazine that he was the dad.
00:10:46.480 --> 00:10:47.200
Yeah, tell us about that.
00:10:47.440 --> 00:10:47.840
Yep.
00:10:48.720 --> 00:10:53.600
So here is where I think there could be possible problems for many people down the line.
00:10:53.759 --> 00:11:02.080
And today, the prosecutors just today said we have a bombshell witness, we'd like to identify that witness under seal.
00:11:02.320 --> 00:11:06.480
So we know that Jason is already going to be a witness, so it's not him.
00:11:06.639 --> 00:11:11.200
There's some other bombshell witnesses coming into the party right now.
00:11:11.360 --> 00:11:24.799
Um, but Jason was all of these guys, and uh were a part of a really well-known and renowned National Guard crew, so they were all friends.
00:11:24.960 --> 00:11:34.799
Matthew Farwell, his twin brother William Farwell, um Jason Bicard, and others were in this National Guard unit, and that's how they all know each other.
00:11:35.039 --> 00:11:40.159
Sandra, the reason she joined the police explorers program is because she was looking at a career in civil service.
00:11:40.240 --> 00:11:41.120
She wanted to be a cop.
00:11:41.360 --> 00:11:45.919
And we know that you get some extra points on the civil service test if you serve in the military.
00:11:46.000 --> 00:11:48.639
So she was hoping that signing up for the army would help her out.
00:11:48.799 --> 00:12:02.320
Well, she washed out, she had asthma, she wasn't up to the task, but she maintained this relationship with a recruiter, not necessarily her recruiter, but a recruiter in the office where she had signed up, which is Quincy.
00:12:02.559 --> 00:12:04.960
And that guy was friends with the Farwell brothers.
00:12:05.039 --> 00:12:36.960
And allegedly, according to the uh Turtle Affairs report that was commissioned by the Stoughton police chief, Donna McNamara, who we also know is going to be a witness for the prosecution in this case, Donna McNamara's report commissioned, uh, states that they were exchanging videos of Jason's encounter, sexual encounter with Sandra Birchmore, and Matthew Farwell's defense attorneys let it leak at a hearing in recent weeks that he was the father of the child, not Matthew Farwell.
00:12:37.279 --> 00:12:43.679
So the the Fed's theory is he killed her to keep her quiet about this kid.
00:12:43.840 --> 00:12:46.240
The kid wasn't his anyhow, but it doesn't matter.
00:12:46.399 --> 00:12:53.840
Like this is all still leading up to you know, Matthew Farwell's career was going to be over if she talked.
00:12:54.000 --> 00:13:03.039
And one of her friends had already called the Stoughton Police Department just days before her murder, saying, Hey, you guys need to look at this Matthew Farwell guy, he's a piece of garbage.
00:13:03.200 --> 00:13:04.240
Sandra owes me money.
00:13:04.320 --> 00:13:12.559
There was some sort of dispute with this girl, and this girl called the Stoughton Police Department to anger Sandra.
00:13:12.639 --> 00:13:19.440
This is part of a little tiff, but she told the Stoughton Police Department about Matthew Farwell's longtime affair with her.
00:13:20.000 --> 00:13:28.879
Yeah, no, and so I mean it looks as if, like you know, allegedly Farwell kills her because he thinks the baby's his because she's been telling him it's his.
00:13:29.600 --> 00:13:31.360
She's been telling him it's him, she's making demands.
00:13:31.440 --> 00:13:33.200
I want your name on the birth certificate.
00:13:33.279 --> 00:13:34.879
I want you to be there when he's born.
00:13:35.039 --> 00:13:37.440
You know, you have to be a part of the baby's life.
00:13:37.759 --> 00:13:39.600
And he he was panicking.
00:13:39.759 --> 00:13:43.600
You know, his wife is literally about to give birth to their third kid.
00:13:43.840 --> 00:13:47.279
Uh, the job gets a call, his job gets a call.
00:13:47.600 --> 00:13:49.279
He is furious.
00:13:49.440 --> 00:13:56.000
He actually, I think, had some sort of argument with the dispatcher who took the call, and now this is all mounting, mounting, mounting.
00:13:56.080 --> 00:14:00.799
And the federal prosecution believes that that is what led him to strangle her to death.
00:14:00.960 --> 00:14:14.159
Uh some of the other bombshells that came out in the recent hearings is he had just attended a class as a detective for the Stoughton Police Department on hangings, you know, uh murder by hanging.
00:14:14.320 --> 00:14:15.519
Ligatures and stuff, yeah.
00:14:15.759 --> 00:14:17.039
Yeah, ligatures and stuff.
00:14:17.200 --> 00:14:18.639
So, you know, we know that.
00:14:18.799 --> 00:14:28.240
We know that among the evidence that was missed by his colleagues was a necklace that had been apparently torn from her neck and was laying on the rug when her parents went to the house.
00:14:28.320 --> 00:14:35.679
When I'm sorry, when her aunt went to the house to, you know, clean up the mess and figure out what to do with her her beloved cats.
00:14:35.840 --> 00:14:44.000
They find this necklace that was clearly, you know, ripped from her neck during whatever altercation took place in that room.
00:14:44.240 --> 00:14:47.120
What federal prosecutors call an altercation.
00:14:47.279 --> 00:14:53.120
Um, prosecutors again, prosecutors have a case that's so good that the U.S.
00:14:53.200 --> 00:14:56.960
district, the federal judge, called the evidence overwhelming.
00:14:57.279 --> 00:15:02.960
But the defense can say, look, you know, they they investigated Matthew Fowler for four years.
00:15:03.039 --> 00:15:08.399
The cops who were first on the scene, the medical examiner was pressured into changing her ruling.
00:15:08.639 --> 00:15:11.279
So they're gonna say he was never charged.
00:15:11.440 --> 00:15:12.559
This is just the feds.
00:15:12.639 --> 00:15:14.000
You're going after a cop.
00:15:14.320 --> 00:15:26.799
So it's gonna be interesting how this all plays out, but we've seen what's happening with you know police narratives, especially on the South Shore of Massachusetts, and how well believed they are by juries these days.
00:15:27.120 --> 00:15:41.679
Yeah, I think if that's the road they're going down, they're gonna have a tough road to hoe because right now those police departments, Canton, Stoughton, uh, the Massachusetts State Police have zero uh what's the word I'm looking for?
00:15:41.919 --> 00:15:43.919
Credibility, yeah, credibility.
00:15:44.080 --> 00:15:47.919
I mean, Proctor was Proctor involved in this case too, I think.
00:15:48.720 --> 00:16:00.399
I think peripherally, just because he was in the Norfolk County DA's office at the time, but there are direct correlations to Oak Keefe with uh Sergeant Mike Lank was one of the first people on the scene when Sandra died.
00:16:00.639 --> 00:16:08.399
Um, John Fanning, who was in charge of the Karen Reed jury, was pretty much acting as the lead investigator in the Farwell case.
00:16:08.559 --> 00:16:13.840
What Fanning should have um Fanning should have had an out because he used to be a Stoughton cop.
00:16:14.080 --> 00:16:22.000
So he could have gone to Michael Morrissey, the DA, the district attorney, and said, Look, this one maybe we get some outside people to come in and talk to Farwell.
00:16:22.240 --> 00:16:23.440
Everyone's saying he did it.
00:16:23.519 --> 00:16:25.039
It's a complete conflict of interest.
00:16:25.120 --> 00:16:26.399
He was on the same job.
00:16:26.559 --> 00:16:27.679
They played hockey.
00:16:27.759 --> 00:16:29.759
He played hockey for the Stoughton Police Department.
00:16:29.840 --> 00:16:35.279
These these overlaps were not distant or uh unrelated.
00:16:35.679 --> 00:16:38.639
These were friends, like you know, you had Pete.
00:16:38.799 --> 00:16:42.240
It would again, you know, I don't I don't can't imagine.
00:16:42.399 --> 00:16:46.080
I worked at one police plaza and NYPD for 10 years.
00:16:46.240 --> 00:16:52.879
I can't imagine if a guy in a precinct was being eyed for in Brooklyn South.
00:16:53.120 --> 00:16:55.600
Do you think Brooklyn South is going to handle the homicide?
00:16:55.679 --> 00:16:56.960
Would that ever happen?
00:16:57.279 --> 00:17:02.559
Yeah, no, I mean this would have been an internal affairs thing for sure, and that would have been the end of that.
00:17:02.879 --> 00:17:06.319
But uh, this is this is all crazy because I think Trooper Dunn, right?
00:17:06.400 --> 00:17:09.039
He was Karen Reed, and also in this case, too, from the beginning.
00:17:09.279 --> 00:17:10.400
He was also in this case, too.
00:17:10.720 --> 00:17:11.759
We have the Alberts.
00:17:11.839 --> 00:17:15.119
The Alberts were, you know, Kevin Albert was there from Canton PD.
00:17:15.440 --> 00:17:18.319
I mean, it's gonna be fascinating.
00:17:18.480 --> 00:17:29.039
Look, we know for a fact that um Sean Good, the sergeant from Canton police, who just got fired, or just stepped, sorry, he resigned before he could be fired, so he could get his pension.
00:17:29.359 --> 00:17:33.279
Shocking that that guy's getting a pension considering the stuff that he and Proctor were writing.
00:17:33.440 --> 00:17:38.400
But one of the things he was he was maligning Sandra Birchmore, you know.
00:17:38.640 --> 00:17:45.519
I think he used a Boston term that used to be popular, but not so much that begins with an R that Mark Wahlberg got in trouble for using.
00:17:46.319 --> 00:17:47.279
One of those words.
00:17:47.440 --> 00:17:47.599
Yeah.
00:17:47.839 --> 00:17:49.680
Or Matt Damon got in trouble for using.
00:17:49.839 --> 00:17:55.279
So, you know, Liz, they definitely were talking about the Sandra Birchmore case, and the feds have everything now.
00:17:55.440 --> 00:18:02.240
So I just cannot imagine that there's not going to be uh some sort of steamroll effect once the Farwell case is over.
00:18:02.480 --> 00:18:05.200
Uh I'm shocked he's taking it to trial, to be honest.
00:18:05.279 --> 00:18:07.759
You know, but but they took the death penalty off the table.
00:18:07.920 --> 00:18:08.799
What does he have to lose?
00:18:08.880 --> 00:18:11.200
He's gonna go to trial and take his chances.
00:18:11.839 --> 00:18:18.079
Yeah, and I well, I guess by leaking or however they, you know, if the Sergeant Picard's name comes out, that's gonna be there.
00:18:18.240 --> 00:18:20.160
Well, he's the real father, so he's the one.
00:18:20.319 --> 00:18:22.079
It was done with an army duffel bag, right?
00:18:22.160 --> 00:18:29.119
I mean, that's where the defense is gonna be headed with this, that they're gonna try to pin it on this guy Picard and they got the wrong guy and everything else.
00:18:29.200 --> 00:18:30.799
I mean, that's the only thing I can think of.
00:18:31.039 --> 00:18:32.640
Yeah, I think you're probably right about that.
00:18:32.799 --> 00:18:38.079
They're gonna they dropped his name on purpose in court, even though we had already known we had known his name.
00:18:38.400 --> 00:18:38.960
I don't know.
00:18:39.039 --> 00:18:44.559
I think um, I think Picard, who's serving overseas the last I checked, so he's still in the U.S.
00:18:44.720 --> 00:18:45.119
Army.
00:18:45.279 --> 00:18:59.759
Uh Picard, I think, has a rock solid alibi, like I was in Iraq, you know, like oh, and I'm not saying that's true, but I believe that he has some sort of rock solid alibi that he was nowhere near Canton, Massachusetts on the night that Sandra Birchmore died.
00:19:00.000 --> 00:19:04.000
Yeah, I mean, and I I and I know he didn't know he was the dad.
00:19:04.079 --> 00:19:07.119
This was like a to him, it was a hookup.
00:19:07.359 --> 00:19:08.880
It wasn't our relationship.
00:19:09.200 --> 00:19:13.599
Yeah, and plus there's video surveillance of the guy coming in and coming out.
00:19:13.759 --> 00:19:17.119
I mean, you can you can tell who it is, but you know.
00:19:17.680 --> 00:19:18.400
Well, that's the other thing.
00:19:18.480 --> 00:19:35.920
I mean, he was clearly trying to disguise himself because what was going on at that time in Massachusetts was a a vehement brawl between police unions, correctly or not, but police unions and the governor's office, Charlie Baker's office, about vaccine mandates.
00:19:36.240 --> 00:19:44.079
And the police unions were apoplectic that guys were getting fired, what women were getting fired from their job for not getting the vaccine.
00:19:44.319 --> 00:19:54.799
So Barwell was a police union official for mass cops, which is one of the biggest ones, and very tight with spam and spam leadership, and that's the state police union.
00:19:55.119 --> 00:20:03.759
And, you know, I think um that he walked in with this mask and his hoodie up and avoided the cameras said a lot.
00:20:03.920 --> 00:20:08.960
This is not a guy that was just gonna go break it off and tell her to cut cut the crap.
00:20:09.039 --> 00:20:17.920
This was a guy who had a plan, and he went in there with a plan to cover his face and commit a crime, the evidence suggests.
00:20:18.160 --> 00:20:19.359
So it's gonna be interesting.
00:20:19.440 --> 00:20:24.240
That's gonna be a big part of this case, is this whole COVID face mask that he walked in with.
00:20:24.559 --> 00:20:26.319
But it was clearly Matthew Farwell.
00:20:26.559 --> 00:20:28.480
And you know who found the video tape?
00:20:28.720 --> 00:20:38.880
Not the Norfolk County DA's office, the building manager called and said, Hey, I have a tape of a guy walking into our house right around that time.
00:20:39.279 --> 00:20:42.559
So they weren't looking for that tape very hard.
00:20:42.720 --> 00:20:47.759
They got a call about the existence of the tape and apparently had no choice but to pick it up.
00:20:48.799 --> 00:20:56.319
Yeah, I mean, and then they have uh within hours later, he's got a basically the same surgical mass on mask on holding his son.
00:20:56.960 --> 00:21:00.960
And uh, you know, I I mean you just kind of shake your head.
00:21:01.359 --> 00:21:05.200
I mean, it's I think that I think the defense has an uphill battle.
00:21:05.440 --> 00:21:06.160
Oh god.
00:21:07.359 --> 00:21:07.759
I don't envy.
00:21:08.400 --> 00:21:09.440
I don't envy their position.
00:21:09.519 --> 00:21:19.200
Like I said, so it was Picard allegedly that shared these videos and photos of it was him and Sandra with the unclear who sent the videos.
00:21:19.359 --> 00:21:21.920
It could have been Sandra herself who sent them to the brothers.
00:21:22.799 --> 00:21:32.480
Let me put it to you this way: one of the one of my longtime sources who worked this case put it to me exactly like this Michelle.
00:21:32.880 --> 00:21:37.759
What I saw, I had to go to church and wash my eyes out with holy water.
00:21:38.000 --> 00:21:42.400
The things that these men were asking her to do to degrade herself.
00:21:42.480 --> 00:21:55.519
Now remember, you can you can go into shaming the victim, but in this particular case, she was a little girl who went into a program where men allegedly immediately began to groom and abuse her.
00:21:55.759 --> 00:21:59.759
We know through text messages that Matthew Farwell bragged about taking her.
00:22:00.160 --> 00:22:01.680
Virginity when she was underage.
00:22:02.319 --> 00:22:05.119
So this is a girl that had problems.
00:22:05.279 --> 00:22:10.240
And then these problems were exacerbated by her connection to these men.
00:22:10.480 --> 00:22:20.400
And so she may have shared these videos with the Farwell brothers as part of the continuing abuse that they were bestowing upon her.
00:22:20.559 --> 00:22:24.400
Do this to yourself, do that to yourself, take a video of it, send it to us.
00:22:24.559 --> 00:22:26.480
And they were sharing these videos.
00:22:26.799 --> 00:22:29.039
So, I mean, what does that say?
00:22:29.200 --> 00:22:34.720
I it when I say it out loud, I get disgusted because I know so many cops.
00:22:34.960 --> 00:22:39.599
And I am shocked that this kind of thing went on with police officers.
00:22:39.680 --> 00:22:42.319
It just really is astonishing.
00:22:42.559 --> 00:22:47.279
And the fact that they shared it on their job phones, they shared it on their like, what did they think?
00:22:47.440 --> 00:22:52.319
Like these guys were meeting her on duty for these sexual encounters.
00:22:52.480 --> 00:22:54.640
So even right there, there's theft of services.
00:22:54.720 --> 00:22:57.839
Like, there's so much I think you and I can agree is gonna.
00:22:58.319 --> 00:22:59.119
I'm with you.
00:22:59.279 --> 00:23:15.680
I'm sure there are a lot of sleepless guys out there right now that if anybody had anything to do with Sandra Birchmore, and kudos to the police chief, Donna McNamara, who caught wind of this, commissioned an IAD report completely independent from the job.
00:23:15.839 --> 00:23:23.279
They she went to out to retired guys who were, and let me be clear, you know, we we say a lot about the Norfolk County State Police.
00:23:23.519 --> 00:23:29.119
In the end, the state police, even though they were retired guys, solved this case.
00:23:29.279 --> 00:23:34.640
Like they dug up the evidence, they were horrified, they talked about washing their eyes out with holy water.
00:23:34.799 --> 00:23:41.920
They I had a friend of mine, a longtime friend, said, Michelle, I I boxed up all my state police t-shirts and burned them.
00:23:42.000 --> 00:23:43.839
I was so I'm so embarrassed by this.
00:23:44.079 --> 00:23:51.279
So we can't paint the entire job with this brush of these, you know, accused dirtbags.
00:23:51.440 --> 00:24:05.519
I think they're it's worth mentioning that old timers were the ones who uncovered all of the evidence that led to the federal prosecution, along with uh female FBI agent who was going to take the stand in this case as well.
00:24:05.920 --> 00:24:16.640
Yeah, those, but those guys as retired old timers, different generation, different kinds of cops, you know, and then when you see what they have working now with between the proctors of the world and everything like that.
00:24:16.720 --> 00:24:20.079
I tell you, I think there was a governor here at Healy.
00:24:20.240 --> 00:24:24.000
Healy, Haley, the Haley has done nothing to address this at all either.
00:24:24.480 --> 00:24:30.799
There was a the the head of the state police was a temporary chief or superintendent, whatever they call him.
00:24:31.119 --> 00:24:32.079
Colonel, yep.
00:24:33.039 --> 00:24:36.559
She had a chance to remake the state police, and she hasn't.
00:24:37.200 --> 00:24:42.480
You know, you have to think, these guys, the state police are also her own personal bodyguards.
00:24:42.720 --> 00:24:46.079
So they have they have dirt on everybody, including her.
00:24:46.160 --> 00:24:53.119
And she had there were allegations about her own personal life that you know the state police would have intimate knowledge of because they're with her all the time.
00:24:53.279 --> 00:24:57.839
You know, they they drive her, they sit outside her house, they know everything.
00:24:58.000 --> 00:25:00.480
So who knows what they have on Morahealy?
00:25:00.640 --> 00:25:14.000
But my opinion is she should be embarrassed at how little response she has had to this absolute horror show that took place, especially in the Sandra Birchmore case.
00:25:14.079 --> 00:25:16.799
Karen Reed was a grown woman with a career and a job.
00:25:16.960 --> 00:25:19.920
Sandra Birchmore was a child when this began.
00:25:20.160 --> 00:25:34.720
And the and the lack of outrage from the governor's office that this was allowed to happen, and the lack of outrage that this case languished with this alleged killer running around still with a badge for years after Sandra Birchmore was found dead.
00:25:34.960 --> 00:25:40.960
I I think that you know, the I think the voters of Massachusetts should make Mara Healing answer to that.
00:25:42.640 --> 00:25:44.079
You would think they would, right?
00:25:44.240 --> 00:25:51.279
But um, I don't have any I don't get involved in politics, but the politics up in the Northeast is absolutely crazy.
00:25:51.519 --> 00:25:53.920
I I mean this whole case just makes you nauseous.
00:25:54.000 --> 00:25:55.039
I mean, when you take a look at this.
00:25:55.119 --> 00:26:05.759
And like I said, without the Karen Reed, I remember when during Karen Reed, when they were to when there was whispers of the FBI, everyone thought it was about the Karen Reed trial, but it apparently was all about the Sandra Birchmore case.
00:26:06.000 --> 00:26:10.559
It's all about the Sandra Birchmore case, it always has been, and that's why I've been covering the story for so long.
00:26:10.640 --> 00:26:16.480
You know, as I did a big piece for Boston Magazine, I've done dozens of pieces for Los Angeles magazine.
00:26:16.640 --> 00:26:20.880
Like this is a case that touched me personally because you look at this kid, she's defenseless.
00:26:21.119 --> 00:26:25.119
Her mother was dead, she was being raised by an aunt, you know.
00:26:25.200 --> 00:26:27.519
Um, she finally was pulling her life together.
00:26:27.680 --> 00:26:34.079
And by the way, even the day, her, the last day of this girl's life, there was zero indication.
00:26:34.240 --> 00:26:41.119
They're gonna try to say she's nuts and she's 5150, and she had a history of suicidal uh thoughts.
00:26:41.440 --> 00:26:47.599
But if you look at the last day of her life, this this girl was very excitedly planning for the future of her child.
00:26:47.759 --> 00:26:52.720
She was setting up cat care for her the day that she was gonna give birth.
00:26:52.880 --> 00:26:57.200
She was, you know, setting up photos for her newborn baby.
00:26:57.359 --> 00:26:59.200
She had a load of laundry in the washing machine.
00:26:59.279 --> 00:27:01.359
If you're gonna off yourself, do you put in a load of laundry?
00:27:02.319 --> 00:27:06.640
I mean, I'm not thinking about my laundry if I'm thinking about taking my own life, right?
00:27:06.720 --> 00:27:15.759
So there was just so much evidence that there was nothing about Sandra Birchmore that suggested that day she was suicidal.
00:27:16.079 --> 00:27:35.279
And if you look back through the police reports, it's very telling because almost immediately Sergeant Mike Lank from the Karen Reed case and others, Trooper Dunn, walked in and wrote things on the police report that I think if it if you found a man's body, you wouldn't say she was untidy, very untidy.
00:27:35.440 --> 00:27:36.640
It's an untidy place.
00:27:36.720 --> 00:27:38.559
Like, what does that have to do with the price of apples?
00:27:38.640 --> 00:27:44.000
You have a dead girl here, you know, her phone hasn't moved since February 1st.
00:27:44.160 --> 00:27:45.759
Clearly, she had been dead for days.
00:27:45.920 --> 00:27:47.920
This should have been processed as a crime scene.
00:27:48.160 --> 00:27:51.359
But instead, the Emmy's office shows up, takes her body out.
00:27:51.440 --> 00:27:57.920
There's no there's no DNA, and now we know that Farwell's DNA was on the murder weapon or on the alleged murder weapon.
00:27:58.400 --> 00:27:59.519
And her underwear, too, right?
00:27:59.759 --> 00:28:00.960
And in her underwear, right?
00:28:01.039 --> 00:28:04.240
So they didn't process the this as a crime scene.
00:28:04.480 --> 00:28:17.440
And what I found especially galling is that in the police reports, when they interviewed Farwell, they referred to him as Matt, not Detective Farwell or you know, Matthew Farwell.
00:28:17.599 --> 00:28:21.839
I mean, it just showed a chumminess that I think is unusual in a police report.
00:28:21.920 --> 00:28:23.119
I don't know what you think.
00:28:23.440 --> 00:28:28.799
But when you're interviewing somebody who's been named as a possible suspect, you don't say, hey, Matt's a good guy.
00:28:29.200 --> 00:28:31.920
Yeah, this whole case thinks.
00:28:32.000 --> 00:28:33.519
Uh Sinead had a great question.
00:28:33.599 --> 00:28:35.759
She says, Do you know if this is going to be televised?
00:28:36.079 --> 00:28:37.359
No, it's federal court.
00:28:37.440 --> 00:28:43.279
No, no TV in this, which is unfortunate because I think it would get way more attention if it was televised.
00:28:43.519 --> 00:28:47.920
But this is a federal case, so there's no federal, uh, there's no cameras in the courtroom.
00:28:48.319 --> 00:28:49.039
But you know what?
00:28:49.200 --> 00:28:49.599
This U.S.
00:28:49.680 --> 00:28:52.799
attorney's office, I have to say, is excellent with the media.
00:28:52.960 --> 00:29:03.680
And usually, when I'm Los Angeles, trust me, when you ask them for exhibits in a federal case, they look at you like you just said, can I stab your mother at midnight?
00:29:03.839 --> 00:29:09.119
You know, like there's there's no such thing as like, you know, an exchange of information or exhibits.
00:29:09.279 --> 00:29:15.680
You know, during the Boston Marathon bombing trial, which I covered, and as you know, wrote a book about during the Whitey Bulger trial.
00:29:15.920 --> 00:29:22.160
This office is on it when it comes to at the end of the day, they release the exhibits that were entitled to evidence.
00:29:22.319 --> 00:29:27.839
So there are some visuals which hopefully will keep you know the public spotlight on this case because it deserves it.
00:29:28.079 --> 00:29:29.839
This is something that we should all be looking at.
00:29:30.000 --> 00:29:31.200
How did this happen?
00:29:31.440 --> 00:29:41.519
And how did somebody um who look at the very least, there was a lot of means and motive for this guy.
00:29:41.680 --> 00:29:44.240
He had a key to her house, he had a motive to kill her.
00:29:44.400 --> 00:29:47.519
At the very least, he should have been taken seriously as a suspect.
00:29:47.759 --> 00:29:51.440
But instead, this was open and shut.
00:29:51.599 --> 00:29:56.319
This girl had no family, she had nobody to beat the drum for justice for her.
00:29:56.480 --> 00:30:06.079
So I think it was they really thought they were gonna get away with it alleged, this allegedly, but the Karen Reed case happened and that blew that out of the water.
00:30:06.319 --> 00:30:11.680
But you know, to your point, if Karen Reed didn't happen, would the feds have ever been sniffing around this?
00:30:11.759 --> 00:30:12.319
I don't know.
00:30:12.799 --> 00:30:13.200
I don't know.
00:30:13.279 --> 00:30:16.559
I think Donna McAmara knew a lot.
00:30:16.720 --> 00:30:19.599
I think that she is determined to make sure people pay for this.
00:30:19.680 --> 00:30:21.440
I think it embarrassed her department.
00:30:21.599 --> 00:30:25.440
She got fired for no reason because she cooperated with the FBI.
00:30:25.599 --> 00:30:47.039
So I'm I am very excited to fly back to Boston and see Donna McAmara on the stand because I give her a lot of kudos for finding really good private investigators who were state police, old school guys, the real deal guys, and these real deal guys pulled together anybody who reads the IAD report from the Stogton Police, and it's out there, you can just read it yourself.
00:30:47.279 --> 00:30:57.119
You will be astonished at what they uncovered that was missed by the homicide detectives who were supposed to look off as Sandra Birchmore and everyone else in Norfolk County.
00:30:57.519 --> 00:30:59.440
Yep, it's it's absolutely awful.
00:30:59.599 --> 00:31:07.359
If you're just joining us now, we have senior editor of LA magazine, Michelle McPhee, and we are discussing the Sandra Birchmore case.
00:31:07.759 --> 00:31:09.200
The medical examiner.
00:31:09.599 --> 00:31:17.440
Okay, we know that the medical examiner was allegedly bullied by Proctor and his crew during Karen Reed, right?
00:31:17.680 --> 00:31:29.519
Where they're saying, like, did you they wanted her to put certain certification of death, and in this case, she changes her mind from the matter of death of suicide to undetermined.
00:31:29.680 --> 00:31:32.079
Just well, I think it's two different Emmys.
00:31:32.640 --> 00:31:37.119
So it's the office uh it's the chief, it's the office of chief medical examiner for Massachusetts.
00:31:37.200 --> 00:31:39.200
So there were two different MEs in this case.
00:31:39.440 --> 00:31:41.200
This uh Dr.
00:31:41.359 --> 00:31:44.160
Capo Martinez was the name of this one.
00:31:44.400 --> 00:31:51.279
And my sources in Massachusetts say, look, she could only go with what she had.
00:31:51.440 --> 00:31:55.200
They never brought her evidence of anything other than a suicide.
00:31:55.519 --> 00:32:00.319
So they didn't say, well, the last guy to see her alive might have knocked her up.
00:32:00.480 --> 00:32:07.440
You know, well, the dude who came to her house was wearing a COVID mask, even though he was super anti-vaccine.
00:32:07.839 --> 00:32:22.799
Well, you know, uh the strap was never, they didn't have it, he she didn't have anything from them other than this immediate, immediate diagnosis of suicide that came from the cops.
00:32:22.960 --> 00:32:26.240
So it took her a few months, but when in the end, what did she have?
00:32:26.319 --> 00:32:41.920
So she said, okay, asphyxiation was the was the cause of death, and the manner of death was suicide, which was changed earlier this year, as we know, to manner of death undetermined, based on the new evidence that was brought to her by federal prosecutors.
00:32:42.079 --> 00:32:48.240
Now I'm sure she's gonna be ripped apart by both sides in this case, but you can only go with what you have, right?
00:32:48.400 --> 00:32:56.799
And and that's why I would brought up the first thing because what happened in Karen Reed with the medical examiner, same thing is good, the same story is gonna come up with her now, right?
00:32:57.680 --> 00:32:59.359
It's the same office, right?
00:32:59.759 --> 00:33:08.480
And from the prosecution side, they're gonna say that she was basically pigeonholed into doing this as a suicide because of that, and right, and just remember Proctor.
00:33:08.559 --> 00:33:09.359
I remember that whole conversation.
00:33:09.440 --> 00:33:10.400
I think it was Procter, right?
00:33:10.480 --> 00:33:14.240
He said, Hey, you couldn't like basically convince her otherwise, you know.
00:33:14.640 --> 00:33:23.039
Well, that's just Procter would that was in the Karen Reed case, but in this particular case, you know, the the defense is making that argument.
00:33:23.200 --> 00:33:26.480
They're saying the feds made her change this diagnosis.
00:33:26.640 --> 00:33:43.279
Well, I have sources in that office, and I think that you know her career is destroyed, for one, this poor doctor, and two, the direct quote from somebody with direct knowledge of this case was she could only work with what she had.
00:33:43.519 --> 00:33:50.400
And there are emails in the IAD report with the retired Stadies where they try to get to the bottom of it.
00:33:50.480 --> 00:33:56.720
Like the ME is asking the Norfolk County DA for information and not getting it.
00:33:56.880 --> 00:34:00.000
Asking for information, not getting it, asking for information, not getting it.
00:34:00.160 --> 00:34:04.240
So she waited months before she finally just said, okay, fine, suicide.
00:34:04.559 --> 00:34:12.480
But I think it was pretty clear that she wasn't convinced and was asking the Norfolk County DA's office for more information and wasn't getting it.
00:34:12.559 --> 00:34:15.119
And that's proven out in the emails.
00:34:17.039 --> 00:34:19.440
Robert Devine, is it Robert Devine?
00:34:19.679 --> 00:34:22.559
Yeah, the deputy chief, believe it or not.
00:34:22.800 --> 00:34:23.920
The ex-deputy chief.
00:34:24.159 --> 00:34:24.960
Ex-deputy chief.
00:34:25.280 --> 00:34:30.159
When he started abusing Birchmore, he had already been demoted because of another sex scandal he got into.
00:34:30.400 --> 00:34:37.119
He got a woman that he had an affair with, he used the Norfolk County DA's office to arrest her and ruin her life.
00:34:37.440 --> 00:34:41.679
So he had already been caught up in a scandal, he had already made these false allegations.
00:34:41.760 --> 00:34:48.079
He sent this poor girl to jail when she ratted him out to his wife, who was also a police officer.
00:34:48.239 --> 00:34:50.480
Uh, this is all contained in the IED report.
00:34:50.559 --> 00:34:53.119
This is in, you know, this is in writing.
00:34:53.360 --> 00:35:03.519
He had been demoted from deputy chief to a cop again because of this first sex scandal, and then he gets involved in the second sex scandal.
00:35:03.599 --> 00:35:08.559
And Devine was the guy who brought the police explorers program to Stoughton PD in the first place.
00:35:08.800 --> 00:35:09.119
Right.
00:35:09.199 --> 00:35:12.320
And they took about four people from Stoughton, right?
00:35:12.400 --> 00:35:16.480
So you got Matthew, his brother William, Robert Devine, and who was the fourth?
00:35:16.800 --> 00:35:19.360
The animal control officer, Joshua Heel.
00:35:19.760 --> 00:35:20.000
Okay.
00:35:20.159 --> 00:35:32.000
And Joshua Heel admits to having consent what he calls, what he calls consensual sex with Sandra in the animal control office in exchange for an adopted cat.
00:35:32.719 --> 00:35:55.519
So these are men that use their positions of power, and and you know, I I want I also think that it's important to note that a lot of this might not have come out with the feds, and also there was uh an attorney in the on the North Shore of Massachusetts, Stephen Marulo, who got a call from Sandra's aunt, Darlene Smith.
00:35:55.760 --> 00:36:00.400
Like, I don't believe this, she wouldn't have committed suicide with Catholic, like that's the other thing, too.
00:36:00.480 --> 00:36:03.199
Like, the people don't understand the devastation of that.
00:36:03.360 --> 00:36:41.199
When you tell, you know, a practicing Catholic that your pregnant niece just killed herself and her unborn baby, that has an effect if you're faithful, and they were faithful, and they never believed it, and they fought back hard and went to a guy Stephen Marulo, and Stephen Marulo blew up this can of worms when he filed a civil suit against the town of Stoughton and the police department, and that and then that gave the ammunition to Donna McNamara to hire the retired guys to go and do a real investigation, which is exactly what happened, and now we know the outcome.
00:36:41.360 --> 00:36:42.800
Matthew Fowell's in handcuffs.
00:36:42.960 --> 00:36:52.320
I think perhaps his brother and others are gonna be soon to follow, unless Billy made a deal because he is on the Fed's witness list, right?
00:36:52.400 --> 00:36:55.440
So let's maybe he's avoiding prosecution, right?
00:36:55.599 --> 00:36:57.920
By testifying against his brother.
00:36:58.719 --> 00:37:05.199
For the for the prosecution's witness list, are they are there any you think potential bombshells that come out of this?
00:37:06.400 --> 00:37:10.880
I mean, I'm I'm really curious about who is so big that they had to seal it.
00:37:12.159 --> 00:37:14.400
That that to me, I'm I'm racking my brain.
00:37:14.480 --> 00:37:15.679
Who could this possibly be?
00:37:15.840 --> 00:37:16.559
I mean, who knows?
00:37:16.639 --> 00:37:19.519
Matthew Farwell's wife has never been seen again.
00:37:19.760 --> 00:37:22.079
You know, she never filed for divorce.
00:37:22.159 --> 00:37:23.760
I've never been able to find her.
00:37:24.000 --> 00:37:27.440
You know, she's sitting there with wondering.
00:37:27.760 --> 00:37:37.760
She's living with a guy that federal prosecutors have a lot of evidence that he was into children, and they cite a lot of evidence about his porn site, his porn search history.
00:37:38.000 --> 00:37:46.719
One of the most horrifying things that one of my sources shared with me was he would punish this is in writing, we know this from court records.
00:37:46.800 --> 00:37:52.239
He would punish Sandra with brutal sex and tell her, I'm gonna do this to you, I'm gonna do that to you.
00:37:52.400 --> 00:38:06.400
And one of the things that he was obsessed with was rape fantasies, and in one of them, he told Sandra, I want you to call me Joey and pretend I'm your brother, and that's the name of his own son.
00:38:06.960 --> 00:38:08.239
That's the name of his own son.
00:38:08.320 --> 00:38:11.199
So if I'm Michelle Farwell, how do you live with this?
00:38:11.440 --> 00:38:12.559
I mean, so I'm curious.
00:38:12.639 --> 00:38:15.280
I'm not saying it's her, I'm just who could be bigger.
00:38:15.440 --> 00:38:18.639
We know Jason Picard, the father of the kid, is going to testify.
00:38:18.800 --> 00:38:20.800
We know Billy Farwell is gonna testify.
00:38:20.880 --> 00:38:28.239
Okay, maybe he made a deal with prosecution to give up his brother to avoid his own, you know.
00:38:28.400 --> 00:38:34.639
Uh I think he's he's very exposed because he definitely had theft of services.
00:38:34.800 --> 00:38:38.960
We know he was hooking up with her, he hooked up with her 10 days before she died.
00:38:39.199 --> 00:38:40.400
Billy Farwell.
00:38:40.559 --> 00:38:47.039
We know Divine, he didn't admit it, but he definitely got jammed up for having sex with her on the job.
00:38:47.119 --> 00:38:48.639
They were meeting up in parking lots.
00:38:48.800 --> 00:38:50.880
So, right there, you know, we have theft of services.
00:38:50.960 --> 00:38:51.920
So, did they make a deal?
00:38:52.000 --> 00:38:56.320
I don't know, but it's gonna be interesting to see if Matthew Farwell has any friends left.
00:38:56.400 --> 00:38:59.119
Who's gonna take the stand in his favor?
00:38:59.519 --> 00:39:04.079
I can't imagine anyone, even his fellow cops, who's gonna say, Yeah, this was this was a good guy.
00:39:04.239 --> 00:39:11.280
He hooked up with the girl from the police explorers program when she was 15 years old, allegedly.
00:39:11.920 --> 00:39:17.119
Yeah, no, I mean, you would think that nobody would come to his aid, right?
00:39:17.199 --> 00:39:23.519
I mean, at this point, especially when you hear about what you had just told us in regards to you know, though those kind of fantasy stuff.
00:39:23.599 --> 00:39:28.960
I mean, you would say to yourself, you would want to distance yourself as far away from this person as possible, you know.
00:39:29.119 --> 00:39:34.239
Um, well, I know the mass cops is not happy every time I mention the fact that he was a union official with them.
00:39:34.480 --> 00:39:45.360
They didn't know, you know, they just he represented the stone police department for the for this particular union, but they're like, Can't you just forget about the mass cops?
00:39:45.920 --> 00:40:06.719
They are good, you would like to, but this it's a big part of the story that look, this guy was a powerful union official, which could have played a role in this entire because of the timing, because Sandra's murder happened when they were in this battle with the state house over COVID COVID and vaccine mandates, and Farwell was a powerful figure in this fight.
00:40:06.960 --> 00:40:08.079
Did he get a pass?
00:40:08.239 --> 00:40:18.239
I don't know, I'm not making any allegations, but I do know for a fact that his attorney was the attorney for the union for the state police for spam.
00:40:18.960 --> 00:40:22.239
So, you know, his first attorney was Spam's attorney.
00:40:23.199 --> 00:40:26.480
So that I think that's a tie that you can't deny.
00:40:26.800 --> 00:40:35.599
No, I mean, besides the cell phone records and the internet, uh, the the video surveillance, do you know if there are any other internet records besides you know his searches on online?
00:40:35.920 --> 00:40:38.159
Was he were they doing anything like that?
00:40:38.559 --> 00:40:45.920
Well, we know that they uh also got into evidence um Sandra's diary entries, so her manual diary entries.
00:40:46.079 --> 00:40:52.400
I mean, look, this here's the thing we know that this uh Nick Rarino, this is an interesting one that I haven't really figured out yet.
00:40:52.559 --> 00:40:55.920
Nick Areno, you know, was very central to the Karen Reed case.
00:40:56.239 --> 00:41:01.840
He was the tech guy that came up with the Jen McCabe haws long to die in the cold.
00:41:02.079 --> 00:41:07.199
Um, you know, he was pivotal to the prosecution in the Karen Reed case.
00:41:07.360 --> 00:41:18.800
Well, Nick Areno was the guy who also failed to locate 30,000 text messages between Farwell and Sandra Birchmore that were on Sandra Birchmore's iCloud.
00:41:19.039 --> 00:41:29.360
But weirdly, Nick Areno is now a civilian working for the Norfolk County DA's office in the technology as a you know forensic expert.
00:41:29.519 --> 00:41:33.119
And he is gonna testify on behalf of the prosecution.
00:41:33.280 --> 00:41:35.119
So even that's a weird little tie.
00:41:35.199 --> 00:41:36.880
Like, what is Nick Areno gonna say?
00:41:36.960 --> 00:41:37.679
Did they give him a pass?
00:41:37.920 --> 00:41:43.440
I don't know, but maybe he tried to take this evidence to the Norfolk County DA's office.
00:41:43.599 --> 00:41:53.840
And I do know there were people who wanted to do the right thing in Canton that that said, hey, we got to bring this to a grand jury, we got to at least present evidence.
00:41:54.159 --> 00:42:02.239
And Michael Morrissey's second in command, who then resigned abruptly, refused to sit this case.
00:42:02.480 --> 00:42:06.320
And I think that those are some of the questions that are gonna need to be answered.
00:42:06.400 --> 00:42:22.400
And I'm curious to see who in Michael Morrissey's office, maybe it's Morrissey himself, who's one of the sealed witnesses, but there's got to be people in the Norfolk County DA's office who are gonna be called from either side to say, why didn't you present a case against this guy to a state jury?
00:42:24.079 --> 00:42:28.639
I'm I'm assuming there's going to be a whole bunch of police officers that are going to be dragged into this.
00:42:28.800 --> 00:42:30.639
As like, what did you know about this?
00:42:30.880 --> 00:42:40.159
I mean, there has to be, especially if the internal investigation reveals certain people knew something or text messages or phone calls between him and the other cops.
00:42:40.320 --> 00:42:43.519
I mean, this could this could take down an entire department.
00:42:43.840 --> 00:42:55.039
Well, it's interesting because we do know that the dispatcher who took the call from Sandra's friend didn't report it up the chain, but called Matthew Farwell and said, Hey, dude, just so you know, I just got this call.
00:42:55.280 --> 00:43:00.079
So, right there we have a breach of protocol for the very at the very least.
00:43:00.400 --> 00:43:10.320
And uh what we know from the Norfolk County DA's office is that for months they interviewed Matthew Farwell.
00:43:10.719 --> 00:43:13.840
Uh he refused to give up his DNA.
00:43:14.159 --> 00:43:21.119
I Farwell was very aware that he was a suspect, though, because I I do know that they attempted to get his DNA.
00:43:21.280 --> 00:43:27.280
They followed him around for months, trying to get his DNA for at least for a match to the what they found on the murder weapon.
00:43:27.519 --> 00:43:30.880
And he was, my source says, extraordinarily careful.
00:43:30.960 --> 00:43:32.960
Like he wouldn't throw out a Dunkin' Donuts cup.
00:43:33.039 --> 00:43:35.039
He would he he was meticulous.
00:43:35.199 --> 00:43:36.880
They never got anything out of his trash.
00:43:36.960 --> 00:43:38.400
That was, but they tried.
00:43:38.559 --> 00:43:48.480
They really, so the IAD investigators absolutely tried to link Farwell to this murder with DNA, but he refused to hand over his DNA.
00:43:48.639 --> 00:43:50.960
So there's that part of it as well.
00:43:51.679 --> 00:43:57.599
Now, the DNA that was recovered from her underwear and the I think it was the carpet, and then they had the ligature.
00:43:57.679 --> 00:43:59.760
Did they when did they get all of those things?
00:44:00.400 --> 00:44:04.400
Did they were those things right from the beginning or were they then after the fact?
00:44:04.719 --> 00:44:16.400
It sounds to me like, and I have no proof of this, but it sounds to me like this was recovered by the when they brought in a new ME, Michael Baden, the very famous one who was doing you know ground zero and and big cases.
00:44:16.559 --> 00:44:21.760
When he came in and said, Hold on a minute, there is no way this was a suicide, the way her neck broke.
00:44:22.159 --> 00:44:28.719
Then the FBI started to gather their own evidence, and that's when the DNA was recovered.
00:44:29.039 --> 00:44:33.440
So I think that timeline is going to be a big question for these cops.
00:44:33.519 --> 00:44:34.880
Why didn't you get the DNA?
00:44:35.039 --> 00:44:38.559
How is it possible that you didn't find the broken necklace?
00:44:39.039 --> 00:44:41.519
How did you not find what was in her underwear?
00:44:42.000 --> 00:44:47.840
On the rug, on the rug, like there's just a lot of in even the way she died.
00:44:48.000 --> 00:44:55.519
It's do you remember there's the Sopranos episode where Polly Walnuts, I think, slammed a door on a guy to strangle him?
00:44:56.000 --> 00:44:59.920
Yeah, you know, like even that, it's almost impossible for somebody.
00:45:00.079 --> 00:45:03.920
Can you imagine a young girl pregnant trying to do that to herself?
00:45:04.079 --> 00:45:09.440
She ties one end of a duffel bag strap around her neck and then slams the door, and that's enough force.
00:45:09.599 --> 00:45:11.039
That doesn't even make sense.
00:45:11.199 --> 00:45:12.000
Does that make sense?
00:45:12.159 --> 00:45:14.480
You've done homicides, you've been working these cases before.
00:45:14.559 --> 00:45:15.440
Does that even make sense?
00:45:15.519 --> 00:45:17.679
As a well, this was this was the thing.
00:45:17.760 --> 00:45:24.639
As soon as I when it came on my radar, I had kind of poo-pooed this whole thing from the beginning before this thing even kind of took off.
00:45:24.800 --> 00:45:32.880
Because one of the things about doing shows, and people say, Hey, did you see what's going on with the Sandra Pershmore case when we were following Karen Reed?
00:45:32.960 --> 00:45:34.719
And this was like kind of an offshoot of that.
00:45:34.800 --> 00:45:39.679
And people, you're trying to keep yourself, you know, occupied on both of those things happening at once.
00:45:39.840 --> 00:45:53.920
But I'll tell you, uh I am not impressed about what's going on in Massachusetts at any level, not only with the Reed trial, this case, and of course the Lindsey Clancy case, all this is a giant mess.
00:45:54.480 --> 00:45:59.840
I mean, look, I I hate to keep saying it because I know a lot of excellent, especially Boston police.
00:46:00.000 --> 00:46:02.719
Boston police have been, you know, unimpeachable in this.
00:46:02.880 --> 00:46:05.679
And I know a lot of great state police investigators.
00:46:05.840 --> 00:46:12.719
However, to your point, I go back to my years, the 10 years I spent at 1 PP for covering the NYPD.
00:46:13.599 --> 00:46:20.960
First of all, the clearance rate was off the I mean, it's just the level of professionalism is is not comparable in any way.
00:46:21.119 --> 00:46:28.239
This case would have immediately been shifted to someone else if it involved somebody you know that other cops knew.
00:46:28.400 --> 00:46:32.639
I just I can't imagine any of these circumstances happening in the NYPD.
00:46:32.960 --> 00:46:44.880
You know, we've definitely had dirty cops scandals, but it wasn't like this, where there was dirty cops and then, whoops, let's see what we can do to help out our friend, which is what this what the police reports read like.
00:46:45.199 --> 00:46:49.119
Matt is a good guy, so and so says.
00:46:49.280 --> 00:46:54.320
Like uh I mean, it's just stuff I've never seen on an official police report before.
00:46:54.639 --> 00:47:02.559
In I think it was in 2015, I did a couple of interviews with the Enterprise News, which is the local paper, and this was about the divine case and all that other stuff.
00:47:02.639 --> 00:47:04.400
And I got some hate mail, you know.
00:47:05.840 --> 00:47:06.239
Oh, yeah.
00:47:06.320 --> 00:47:08.320
I got anonymous hate mail way back when.
00:47:08.480 --> 00:47:19.119
I don't know if I still have it, but I had done a lot of articles about the police departments up there, but also, you know, because it was about the woman that she had gotten arrested and a couple other crazy things that had happened over there.
00:47:19.280 --> 00:47:24.000
Yeah, there was the guy who went to the strip club to see a midget that he was obsessed with.
00:47:24.880 --> 00:47:25.599
A little person.
00:47:26.079 --> 00:47:28.960
That one, that's a Stoughton police scandal, too.
00:47:29.039 --> 00:47:35.119
It was a little person he was that was stripping at the Foxy Lady on duty.
00:47:35.199 --> 00:47:45.840
He went to the strip club to see the little person, and you know, this is before social media, but he took a picture and showed other guys and you know it got around, and that person got fired too.
00:47:46.000 --> 00:47:50.639
There's been a bunch of scandals in the Stoughton Police Department that are pretty alarming.
00:47:50.800 --> 00:47:56.239
Then they got a great chief who really wanted Robert Devine to be fired, Paul Shastony.
00:47:56.480 --> 00:48:09.039
Paul Shastney was a is a squared-away cop, and he was the chief of the town for a while, and he went to the board, the same board that fired Donna McNamara and said, Look, we gotta get rid of this guy.
00:48:09.199 --> 00:48:10.800
He he locked this girl up.
00:48:11.199 --> 00:48:13.679
He he abused his power, like we need to get rid of him.
00:48:13.840 --> 00:48:17.599
They would not get rid of him, they would only agree to demote him, and Shastney quit.
00:48:17.679 --> 00:48:22.480
That's how furious he was at the way that they handled the Robert Devine case way back then.
00:48:23.280 --> 00:48:32.239
Yes, I and I was I was part of those articles too, because he was the the people of Stoughton were saying, like, why is this guy still on the payroll?
00:48:32.400 --> 00:48:35.119
And that was part of the whole that was part of the whole thing in there.
00:48:35.280 --> 00:48:37.760
So if you if you have a chance, you go over there and you read those articles.
00:48:38.400 --> 00:48:39.840
I will, I definitely will 2015.
00:48:40.000 --> 00:48:43.039
Yeah, just search for my name and and those guys, uh it was bad.
00:48:43.199 --> 00:48:45.039
But yeah, I can imagine.
00:48:45.519 --> 00:48:50.800
What do you think we expect uh in regard to the next week now when we have this jury selection?
00:48:51.280 --> 00:48:52.559
I think it's gonna take a long.
00:48:52.639 --> 00:48:53.840
I this is what I predict.
00:48:53.920 --> 00:48:57.679
It's gonna take a while to find jurors who had never heard of this case, for one thing.
00:48:57.840 --> 00:49:04.000
And that's one of the arguments that defense attorneys made this week, asking once again for a change of venue.
00:49:04.159 --> 00:49:06.480
They had asked for this in March, it was denied.
00:49:06.639 --> 00:49:14.159
Judge Denise Casper, who I watched her throughout the entire Whitey Bulger trial, and she's no nonsense.
00:49:14.320 --> 00:49:18.079
Casper is a pro, and she denied the first change of venue.
00:49:18.159 --> 00:49:21.280
Now they ask for a change of state, they want to move it out of Massachusetts.
00:49:21.440 --> 00:49:23.119
I suspect it was just filed today.
00:49:23.199 --> 00:49:25.599
I suspect Casper's gonna deny that too.
00:49:25.840 --> 00:49:29.440
Um, but that's a the this is a they're throwing a Hail Mary right now.
00:49:29.519 --> 00:49:31.519
Let's get this case out of Massachusetts.
00:49:31.679 --> 00:49:43.760
But to answer your question, I think it's going to be um, I think it's gonna be a little bit of a maybe even a week to get the right jury pool set for this particular case.
00:49:43.920 --> 00:50:03.199
And I'm sure the defense is gonna use every tool that they have in the toolbox to find people who don't have any idea who Sandra Birchhmore is, who Karen Reid is, who even Lindsay Clancy, because these are all sell shore cases where there are major questions being asked about how the investigations were conducted.
00:50:03.920 --> 00:50:12.000
Do you think do you or do you think or you see, or have you heard maybe whispers of the state even filing charges in this case?
00:50:12.400 --> 00:50:17.599
I mean, I think Meatball Morrissey wants to ride off into the excuse me, Michael Morrissey.
00:50:17.760 --> 00:50:25.360
I did not mean to say that, but Michael Morrissey is gonna ride off into the sunset when you know obviously he didn't run for re-election.
00:50:26.159 --> 00:50:37.840
I think that this is a guy who's been around for a long time, and there was always like a little questions about Michael Morrissey, even when he was a lawmaker back at the statehouse himself.
00:50:38.000 --> 00:50:44.159
You know, he was involved with some people that including one who took his own life, Brian Joyce.
00:50:44.239 --> 00:50:46.559
You know, he was he was very close friends with him.
00:50:46.719 --> 00:50:59.039
And when Brian Joyce was arrested by federal prosecutors for a slew of crimes that went right down to free cups of coffee from dunks, you know, uh, you know, that Joyce and Morrissey were very tight.
00:50:59.199 --> 00:51:04.960
So Morrissey has uh escaped a lot of different scandals uh over the past few decades.
00:51:05.199 --> 00:51:13.039
I feel like he's a guy that's gonna have to retire far, far down the cape when no one's gonna see him, or he perhaps even move out of state.
00:51:13.280 --> 00:51:17.119
You know, that's that's my prediction about Michael Morrissey right now.
00:51:17.199 --> 00:51:19.840
But I think he's gonna fade off into the sunset.
00:51:21.199 --> 00:51:24.159
Yeah, I mean, that was the other um you had mentioned Dr.
00:51:24.239 --> 00:51:32.639
Michael Baden's name, and there was another person that the the judge allowed in because the defense was trying to have excluded as potential witnesses.
00:51:33.039 --> 00:51:38.719
Yeah, there was some witnesses, uh other witnesses that talked about how her neck was broken.
00:51:38.880 --> 00:51:54.559
Like it's not possible to be a suicide, and also how the bones and I'm not a forensic medical examiner, but the bones in her nose show that somebody put their hand over her mouth in a forceful way and choked the life out of her.
00:51:54.800 --> 00:52:04.159
So I think you know, the prosecution had a lot of wins, but the defense had some wins too, saying that they could bring her mental history into this case.
00:52:04.400 --> 00:52:12.159
I think if there are women on the jury, they're gonna take a look at those allegations that she had problems and say, well, who created those problems?
00:52:12.639 --> 00:52:19.599
And it might not be a good time to bring up mental problems with the woman, too, with the with the Lindsay Clancy thing still weighing in the background.
00:52:19.760 --> 00:52:23.760
You know, if you're the defense, you do so at great peril, I think, if you bring that up.
00:52:24.079 --> 00:52:26.800
I'm really maybe at this point there's no deal on the table.
00:52:26.880 --> 00:52:31.119
They had um they already took the death penalty off.
00:52:32.320 --> 00:52:34.559
And so what what what could they possibly deal?
00:52:34.639 --> 00:52:38.400
I think they're just gonna throw throw everything at the wall and see what sticks.
00:52:38.719 --> 00:52:42.719
Yeah, well, I mean, for his advantage, going to a federal prison is much better than going to state prison.
00:52:42.800 --> 00:52:49.920
I mean, you you you would you would choose that over state prisons any day, especially as a former police officer, but grind out loud.
00:52:50.159 --> 00:52:51.280
I mean, where could he go?
00:52:51.440 --> 00:52:55.440
You know, there when they tried to get a bail package for him earlier this year, it was really strange.
00:52:55.519 --> 00:52:57.599
He got arrested in August of 2024.
00:52:57.679 --> 00:52:59.280
He's been held without bail since.
00:52:59.440 --> 00:53:05.119
Earlier this year, if suddenly there's a flurry of motions from his defense saying, let's let him get out.
00:53:05.519 --> 00:53:06.880
But where is he gonna go?
00:53:07.119 --> 00:53:09.039
He can't, he's a danger to society.
00:53:09.119 --> 00:53:11.199
A judge ruled, he's a danger to children.
00:53:11.360 --> 00:53:16.960
The same judge ruled, the same judge called the evidence against him overwhelming in writing.
00:53:17.119 --> 00:53:22.480
So I think you know, he couldn't go home because he'd be in the presence of children.
00:53:23.039 --> 00:53:32.079
So where what could what kind of life could Matthew Fowl possibly have if he is by some miracle acquitted of this crime?
00:53:32.480 --> 00:53:39.440
Yeah, well, he's got nowhere to hide, but like I said, if he goes to jail, he's gonna have his own problems, but he'd still be better off in federal, federal jail than that.
00:53:39.840 --> 00:53:42.880
Well, at least he can go to at least he can go to snitch jail.
00:53:44.239 --> 00:53:45.840
Well, maybe they try to work out a deal.
00:53:45.920 --> 00:53:53.280
I mean, you would even say, well, listen, he maybe work out a deal where he'd be close to home, but apparently uh the wife don't want anything to do with him either.
00:53:53.519 --> 00:53:54.159
I mean, who knows?
00:53:54.239 --> 00:53:55.679
No one's heard anything from her at all.
00:53:55.760 --> 00:54:06.480
So I don't know what her position in this entire uh case is, but I I can imagine it's not all love and rainbows at her home.
00:54:07.119 --> 00:54:14.320
Now, is there anything in your reporting so far that you would think that would be detrimental to the prosecution's case?
00:54:16.480 --> 00:54:16.800
No.
00:54:18.000 --> 00:54:18.880
No, I can't.
00:54:18.960 --> 00:54:25.360
I mean, look, they're gonna they're gonna pull out times where she was, she's definitely a girl with problems.
00:54:25.599 --> 00:54:28.000
I don't think anyone is going to deny that.
00:54:28.239 --> 00:54:30.559
Like she had some mental issues.
00:54:30.800 --> 00:54:40.400
I don't think that they're gonna be able to sway a jury to say that those issues caused her to take her own life when she was so wildly excited about this baby.
00:54:40.559 --> 00:54:49.760
You know, we had that in hours before we saw Farwell on the video, we saw her carrying in a car seat that had been a gift from her cousin.
00:54:49.920 --> 00:54:55.280
And her cousin told me, Barbara Wright, there is no way Sandra took her own life.
00:54:55.599 --> 00:54:58.079
And Matthew Farwell did this.
00:54:58.320 --> 00:55:16.480
And those Barbara Wright and Darlene Smith, her aunt, these and the lawyer Steve Marulo, they fought really hard and they finally got the support they needed when the internal affairs outside agency report was commissioned, and then the feds come rolling in.
00:55:16.639 --> 00:55:40.880
But remember, the FBI didn't show up in this case until two years later, which means if Matthew Farwell is indeed guilty, and we will find out and a jury will decide his fate, then there was a guy who was capable of this sort of crime with a badge out there for two years after Sandra Birchmore died, for until he was arrested.
00:55:41.440 --> 00:55:47.840
So that is something that I think is going to be hard for the defense to overcome.
00:55:48.800 --> 00:55:57.360
Well, I have a feeling that between the journal entries, the text messages, I think Sandra's gonna help out her own case from the from the grave, so to speak.
00:55:57.519 --> 00:56:06.960
I mean, those things are gonna be absolutely damning to any process uh any excuse me, any defense, because the prosecution is I listen, I think they lead off with this stuff.
00:56:07.119 --> 00:56:11.039
I mean, if I'm the prosecutor, I set the tone with this case right from the beginning.
00:56:11.360 --> 00:56:14.400
Dump the text messages and everything else right at right in the beginning.
00:56:14.719 --> 00:56:22.800
All you have to do is read the FBI affidavit to see the very clear roadmap that I think the prosecution is going to use to prove that Matthew Farwell committed this crime.
00:56:23.119 --> 00:56:27.119
And the evidence that I read in the FBI affidavit is very damning.
00:56:27.440 --> 00:56:33.119
And that was long before I knew that they had his DNA on the alleged murder weapon or in her underwear.
00:56:33.760 --> 00:56:34.079
Yeah.
00:56:34.320 --> 00:56:40.719
So I think that if you read the FBI affidavit, the search warrant affidavit, it lays it out there pretty clearly.
00:56:41.199 --> 00:56:49.920
Uh they have text messages, they have emails, they have all kinds of things that say, hey, he didn't want her to have this baby.
00:56:50.159 --> 00:56:57.039
Someone had called his job and said Detective Farwell is having an affair with Sandra Birchmore and she's pregnant with his baby.
00:56:57.280 --> 00:57:11.280
This is a guy who was very desperate to stop her from talking, which is how the feds came up with the you know, silencing a witness charge in this, which I think might be a little bit harder to prove, unless we know she was talking to the feds.
00:57:11.360 --> 00:57:13.440
We know the feds were around, who knows?
00:57:13.679 --> 00:57:14.000
Right.
00:57:14.159 --> 00:57:16.639
Is there anything I didn't ask you that uh we no?
00:57:16.719 --> 00:57:18.800
I think this is I think we covered everything.
00:57:19.119 --> 00:57:28.159

I have never laid eyes on Matthew Farwell.

So it'll be interesting to see this big guy lumbering into court.
00:57:56.159 --> 00:58:00.159
It's one of the things that you know the prosecution has mentioned.
00:58:00.239 --> 00:58:04.239
It's not just an age difference, it's like he's a big hulking guy.
00:58:04.559 --> 00:58:09.119
And she was a small child when she met the Farwell brothers and Robert Devine.
