00:00:04.237 -->
00:00:08.877Thank you for listening to TMA's Practice Well podcast. TMA,
00:00:09.137 -->
00:00:11.977helping you improve the health of all Texans.
00:00:11.280 -->
00:00:19.600Music.
00:00:19.877 -->
00:00:24.917Hi, I'm Cheryl Krovyak, the director of the TMA Education Center and producer
00:00:24.917 -->
00:00:31.017of TMA Practice Well podcast. In the February Bulletin from the Texas Medical Board, Dr.
00:00:31.137 -->
00:00:36.217Zafran announced the TMB has completed a comprehensive review and revision of all agency rules.
00:00:36.477 -->
00:00:38.357This is a state-mandated process
00:00:38.357 -->
00:00:42.177to help ensure that TMB regulations are aligned with state statutes.
00:00:42.517 -->
00:00:46.917The TMB has reduced the number of chapters from 40 to 25 to provide cleaner
00:00:46.917 -->
00:00:49.737and better organized Texas administrative code.
00:00:49.857 -->
00:00:54.457The board also took the chance to clarify language in areas where licensees
00:00:54.457 -->
00:00:56.237and stakeholders have reported confusion.
00:00:56.397 -->
00:01:02.017For example, information on physician licensure, which was once distributed
00:01:02.017 -->
00:01:06.737across seven different chapters, is now housed in Chapter 161.
00:01:06.937 -->
00:01:12.957This chapter, that's Chapter 161, includes mandated CME requirements and the
00:01:12.957 -->
00:01:16.597changes the TMB made to bring the requirements in line with state statutes.
00:01:17.449 -->
00:01:21.409Joining me now to discuss some of the biggest changes is Dr. Sam Shada.
00:01:21.849 -->
00:01:26.989Dr. Shada has advocated for Texas physicians and their patients for several decades.
00:01:27.489 -->
00:01:32.389Welcome, Dr. Schade. Tell us about your experience working with Texas legislators
00:01:32.389 -->
00:01:33.969and the Texas Medical Board.
00:01:34.369 -->
00:01:40.289Happy to do that for you. I've been working with the legislature for going on
00:01:40.289 -->
00:01:44.149four decades. A very good friend of mine got me introduced to this.
00:01:44.269 -->
00:01:51.269And there was a need in the 80s for prescription of opioids because it was being under-prescribed.
00:01:51.489 -->
00:01:55.649And so he taught me the ropes of working the legislature, working bills.
00:01:55.989 -->
00:02:00.369And in that process, of course, being involved with the Texas Medical Association
00:02:00.369 -->
00:02:06.369and their committees and being a delegate to the TMA for 20 years.
00:02:06.369 -->
00:02:09.489In the process, I was also a member of the Texas Pain Society,
00:02:09.709 -->
00:02:11.229past president and board member.
00:02:11.589 -->
00:02:14.289I've worked very closely with the Texas Medical Board.
00:02:14.669 -->
00:02:19.129I have the president's cell phone number, chief legal counsel's cell phone number.
00:02:19.349 -->
00:02:25.769I also was the first director of the legislatively mandated PMP Advisory Committee.
00:02:25.989 -->
00:02:30.629So I have a longstanding background and interest in regulatory issues.
00:02:30.809 -->
00:02:34.809I agree. You certainly do. and thank you for your dedication and leadership
00:02:34.809 -->
00:02:38.889and willingness to put on the white coat and go to the state capitol and talk
00:02:38.889 -->
00:02:40.069to the congressmen and women.
00:02:40.249 -->
00:02:43.809That's part of the First Tuesday process, and I've been active in that,
00:02:43.989 -->
00:02:46.809and that's very, very important. I'm glad you brought that up.
00:02:46.989 -->
00:02:53.769The First Tuesday's program is well-organized by our lobbyists and going down
00:02:53.769 -->
00:02:57.949and meeting with your senator and your representative and key members on the
00:02:57.949 -->
00:03:02.689different committees that are handling these bills, but in addition,
00:03:03.009 -->
00:03:09.329going to hearings, putting in cards and support and testifying as an expert
00:03:09.329 -->
00:03:11.169for the TMA or individually.
00:03:11.931 -->
00:03:16.491Now, I know you've taken the time to go through the revisions in the Texas Medical Board rules.
00:03:16.871 -->
00:03:22.071What do you think is the most beneficial for physicians regarding the changes to the mandated CMEs?
00:03:22.211 -->
00:03:31.031The new rules are much shorter, and specifically on the opioid CME, it has been lucent,
00:03:31.611 -->
00:03:36.131meaning previously on the old rules, every physician, even if they didn't have
00:03:36.131 -->
00:03:38.691a DEA license, had to take this to renew their license.
00:03:39.371 -->
00:03:42.831Now, it's only if you're in direct patient care.
00:03:42.971 -->
00:03:45.751When you renew your license, if you put direct patient care,
00:03:45.971 -->
00:03:48.611you have to take these two hours of CEUs.
00:03:48.931 -->
00:03:54.291And instead of doing it forever, the law states you only have to do it twice,
00:03:54.291 -->
00:03:58.171and then it goes to once in every eight years.
00:03:58.251 -->
00:04:02.151So it's a significant decrease in the burden in doing this.
00:04:02.871 -->
00:04:04.471That is excellent news.
00:04:05.211 -->
00:04:10.051And you were one of our original planners and speakers for TMA's first CME that
00:04:10.051 -->
00:04:14.651was created to help physicians meet the mandated controlled substance prescribing CME.
00:04:15.071 -->
00:04:19.051As you know, there were quite a few physicians who were very frustrated that
00:04:19.051 -->
00:04:23.631they had to take the CME, even though they don't provide direct patient care.
00:04:23.931 -->
00:04:27.271What other important revisions should physicians know about?
00:04:28.131 -->
00:04:30.431This is a very important nuance.
00:04:31.411 -->
00:04:38.471The old rules were very prescriptive, almost to the point of a checklist. That's gone.
00:04:39.311 -->
00:04:46.911Now their emphasis is on flexibility because each patient's care is individualized.
00:04:47.051 -->
00:04:52.671But that increases the practitioner's burden when they do their soap note,
00:04:52.671 -->
00:04:56.491okay, to document what they're doing.
00:04:56.951 -->
00:05:00.471In other words, to explain their standard of care and why they're treating the
00:05:00.471 -->
00:05:01.791patient the way they're treating them.
00:05:02.251 -->
00:05:05.451So it's a double-edged sword. You have the flexibility to do it,
00:05:05.511 -->
00:05:07.711but you also have the burden to document what you're doing.
00:05:08.834 -->
00:05:13.174You know, 20-something years ago when I first started at TMA working on CME
00:05:13.174 -->
00:05:15.794programs, documentation was an issue.
00:05:15.934 -->
00:05:21.814And here it is again today, despite all of the tools that should assist physicians with documentation.
00:05:22.554 -->
00:05:27.014Now, Dr. Schade before I let you go, do you have any last tips for your colleagues?
00:05:27.454 -->
00:05:34.714Yes, I strongly encourage you to go to the TMA's CEU, Continuing Education, section.
00:05:34.714 -->
00:05:41.294As we have just recorded, I just recorded the mandated CEUs in pain management
00:05:41.294 -->
00:05:45.554and prescription of opioids meeting regulatory requirements.
00:05:45.554 -->
00:05:49.734And there's a lot of very useful information in there and useful links.
00:05:49.754 -->
00:05:54.014So I highly encourage you to use the TMA for that requirement. Great.
00:05:54.734 -->
00:05:58.754Thank you so much, Dr. Schade. And I will include the link to that webinar in
00:05:58.754 -->
00:05:59.654the episode description.
00:06:00.274 -->
00:06:03.214And for TMA members and their staff, that webinar is free.
00:06:03.994 -->
00:06:07.454Dr. Schade, thanks again for taking time to speak with me today.
00:06:08.094 -->
