Cooperation Isn't Enough: Build a Record That Earns Leniency
A defendant called me in a panic after hearing retired FBI agent Paul Bertrand—who arrested me—speak at our webinar. Paul said that in decades with the Bureau, he saw only one case where cooperation alone kept someone out of prison. The defendant realized he'd spent three years doing nothing but cooperating. No restitution. No work. No progress. Just waiting. His lawyer finally told him the truth: cooperation helps, but it doesn't replace action.
Real leniency comes from showing change, not just cutting a deal.

Someone new to our community asked how Ippei got 57 months while his co-defendant, Matthew Boyer, got a year and a day. I told him it's not the right comparison. Ippei stole $16 or $17 million, and even if Shohei is the greatest athlete in the world and a billionaire, he's still a victim, and the c…
Nearly three years ago I spoke with a man who told me he was embezzling money. He was not the target of an investigation. I told him to stop the bleeding and not make it worse, and I referred him to five lawyers. He didn't call one. He had convinced himself, the way I once did, that another wire an…
