Protecting Your Narrative in an Open Market

Every business has Intellectual Property, and today it’s more valuable than ever. But most businesses don’t recognize it, protect it, or exploit it. It’s usually an afterthought. When an inventor develops something new, management may start thinking about patents. When a new brand is ready to launch, management may start thinking about trademarks. When an employee leaves and takes your new product to a competitor, management may think about trade secrets.

Every business needs to make Intellectual Property a top priority of business planning. Financial experts say that the Intellectual Property portfolio is typically one-third or more of the total value of a business. Intellectual property can also lead to greater profits, expanded market share, multiple streams of revenue, and better business reputation.

Ladies,
gentlemen and everyone in between.
Welcome to the folk tellers stories.
We shared podcast this week,
we're gonna be talking about securing your story a little professional and personal advice on protecting your narrative on the open market.
So the beggars and thieves can't take your good story telling.
Uh I'm here with my compatriots,
Kurt David and I keep thinking about your opening here of ladies and gentlemen and everybody in between because now we're talking about protection.
Ok.
I'm not in touch with that and,
and cut that out.
But are you wearing any?
Ok,
this is,
we're,
we're going down the rabbit hole quick,
Steve can't even get his name out,
but uh you're here.
Who else is here?
Well,
I'm here,
Stephen Sadler,
Stephen Sadler.
I'm glad you're here.
Stephen Sadler too.
I would have missed you if you weren't here.
So,
anyway,
all right.
So,
uh uh that was like just checking it in with the laughter,
right?
So securing your story,
uh We've all published.
Uh Some of us had patented,
uh our stories,
our ideas and,
you know,
it's a,
it's a hidden world.
It's a hidden world.
I,
the quote,
I begin with is uh Pablo Picasso says a bad artists,
copy good artists steal.
I'm like,
oh,
that's not nice.
But uh uh one of our,
so I wanna want to start with a,
is a book written by um one of our friends and actually our intellectual property uh attorney's name is Bill Nier.
Bill wrote a book,
uh a really cool book uh called the Business Owner Guide to Intellectual Property.
Turning your ideas into gold.
And Bill is an IP lawyer.
Uh Bill couldn't be with us,
but he's letting us,
uh he's letting us actually steal some of his stuff.
So that's kind of cool.
Um Well,
I guess it's not stealing if he gave us the rights.
Picasso said it's ok.
All right.
So here's what,
here's what uh Mr says about intellectual property and about protecting your,
your creative ideas and stories and endeavors.
He said every business and this could be every person needs to make intellectual property a top priority in their planning.
Financial experts say that intellectual uh an intellectual property portfolio,
say that three times fast is typically one third or more of the total value of a business.
Intellectual property can also lead to greater profits,
expanded market share,
multiple streams of revenue and better business reputation.
Uh Bill was the uh lawyer for uh Kellogg's for years and years and years.
And uh they sold,
when Kellogg sold um part of their portfolio,
they sold Ernie the Elf uh from Kieler cookies and he had been uh the Chief Elf since 1968.
Uh and in 2001,
Kellogg's purchased Kieler Foods for approximately $4.5 billion.
The intellectual portfolio that Ernie and his friends in the tree represented was $1.5 billion of that value.
That is one very expensive Elf.
And one of the things that bill advises is it's 33 steps.
He says you need to research,
collect and protect and we're gonna talk a little bit about that.
So what do you,
um,
what do you guys feel like?
Uh is it a,
is it a waste of time to try to lock down your,
your ideas and your story or is it something,
you know,
in your personal experience?
Is it something that you've,
uh,
you've had good luck with no luck with or what,
what about you,
Steve?
I mean,
you've done,
you've done a lot of stuff on your,
uh your ideas and your stories.
Um,
some things you've,
you've just written,
like I can tell you as a writer,
um,
you retain,
like if,
if you write something down and you have a physical or a digital copy of it,
um,
that you can prove is written at a certain time,
it,
it's got sort of automatic copyright but you don't have all the protections versus filing it.
But Steve,
what about,
you know,
what's been your experience in this because you've done a lot with like,
like patents and devices and technology and stuff.
I think it depends on the reason why you're trying to secure the IP.
And what I mean by that is if you're,
if the reason that you're trying to secure it is because you want to sue people later on,
then that's not the right reason to secure the IP.
Securing the IP should be kind of going to what Bill wrote in his book there.
You're,
you're creating wealth,
you're creating value.
So the reason that you're patenting something or you place a copyright on something or you're protecting your brand,
it's to build the value of the entity that,
that,
that it's in and that doesn't matter whether it's a product or whether it's a song or whatever.
Um But a lot of people don't,
they don't see it like that.
It's like they,
they wanna,
you know,
kind of secure it and protect it for the purpose of either sitting on it and suing someone else later or whatever.
And,
and as an event and as in being an inventor,
that's bad energy to me,
the,
you know,
the reason that you're doing is you want to protect,
you know,
your art.
And the interesting thing is when you're dealing with patents and trademarks,
it's actually called art.
Really.
Yes.
Matter of fact,
if you're doing a search,
you're looking for what prior art,
that's the research part that Bill was talking about that the first thing is researching,
making sure that,
that idea or whatever it is,
is not already out there.
Yeah.
And that's usually why you,
you need an attorney,
like an attorney go out and they'll actually do a proper patent search or a trademark search or whatever,
find out whether someone else is using it and if they're not,
or if you're doing something that's similar,
then,
you know,
obviously they have to cite that and say,
you know,
this particular pattern here is,
you know,
similar and cited but yours is different.
And,
and that's the other thing.
Another word that comes from stories is novel.
You know,
the,
no,
the,
the novelty of,
you know,
of what a patent is it something original,
original.
Yeah.
Actually,
I think the definition is a,
a patentability requirement according to which an invention is not patentable if it was already known for before the date of filing.
So that is the key part.
You have to have that component.
It has to be,
has to be novel.
That's interesting.
Kurt,
um Kurt fell asleep.
Um Kurt,
we need to wake you up because you're like,
what,
what do I know about this?
Like he's over here taking notes.
He's like,
shit,
I didn't secure any of that.
No,
you know,
it,
it's funny because this is a great topic and,
you know,
one of the things that I've learned is that I'm still learning,
but most of us,
I think most of us will.
I think it's safe to say most people will never be filing for a patent.
Right?
I mean,
would that be a safe assumption that most people are not gonna file for a pen?
But what is important?
Right?
For certain people,
certain situations,
I think it depends like you mentioned,
Steve and it depends on what the idea is because as I tell people,
every book,
every TV show every product starts with one thing.
It's an idea,
right?
It's an idea and we all have ideas.
Some are great,
some are grand,
some are like,
what,
what was I thinking?
Right?
Something as simple as a Hula hoop,
right?
I mean,
think about that.
I mean,
somebody who came up with that idea,
um obviously has done well with it.
Um I,
I remember when I first wrote my,
my book,
my first book and talking about this,
right?
It's like this is new terrain for me.
I,
I didn't know anything about copyright or how did this work?
And one of the biggest suggestions I had is,
well,
there's a poor man version that you can do right to protect your IP.
And I said,
well,
what is that?
And Stevie alluded to it about the time stamp,
right?
They said,
well,
if you have something written,
you can mail it to yourself in a certified letter,
it'll be time stamped with that certified letter and just don't open it because from that date,
you can prove that.
Hey,
here it is.
Right.
And if it's in a court of law or whatever that is,
I can then open it or have the judge open it.
And here it is,
this is my idea,
by the way,
and here's a time stamp,
but that's a cheap version.
You have to send a lot of those to you.
What do you mean?
Well,
say you send one and someone,
you know,
it says,
hey,
this is my pattern.
As soon as you open it up,
you've opened it up,
you only got one.
Oh,
so that's even a,
a,
it's a little more expensive than the Superman version.
It's a great,
so a 10 pack of registered letters.
But no,
it's a great point because yeah,
when that does have to be open for whatever the reason and,
and like you said,
if,
if the motive for doing that is to,
um,
sue or protect or,
you know,
from,
not protect but to,
to look at,
ok,
well,
how can I sue somebody if they steal this?
You know,
to me it's a protection of an idea,
right?
It's an idea that you have that I have that whatever it is we want to protect that and,
you know,
we deal with that.
In fact,
one of the things I deal with the distributors for TV,
programming,
uh that I'm involved with is,
well,
who owns the content.
That's always one of the first questions that distributors ask in TV,
content.
Well,
who owns it?
Well,
when I can say I,
I do,
it opens up the doors a lot more versus,
well,
so,
and so does,
but I'm involved and,
and,
you know,
it just kind of complicates and muddy the water.
But then in,
how do you protect that as well?
Distributors want things that are nice and clean,
you know,
and the less people that are involved,
the better if you want to distribute your,
your movies or TV series or whatever or your book.
Yeah,
I mean,
they want clean.
Here's something you guys,
you guys are hitting on.
That's kind of kind of making me think is,
you know,
one of the other reasons you want,
you want to get legal counsel on this and why you're intellectual property,
we're talking about the idea.
And I think what happens is right out of the gate when someone has an idea,
they're like,
oh,
this would be a great movie or this would be a great,
they're immediately thinking about the asset,
right?
And actually the value is in the idea and Steve taught me this and I'll tell you a story about that when we were in Los Angeles.
So,
um the idea that you have,
if it's a good idea,
it's going to create many assets over time.
So one of the reasons to secure that IP to,
to secure that idea is you don't know what this could become like in your mind,
you're like,
like you said,
you're doing a book.
So you do a,
a book and in your mind,
you're like,
oh,
you know,
we're gonna create the book and I'll secure the book.
But the ideas in that book may turn out to be many,
many,
many other things.
So it's not just securing the book.
It's really,
it's securing the idea example,
my from glory day's concept,
it started as a book turned into a TV show.
Now we're talking about expanding it.
Not many other factors as well.
Uh But what's interesting,
what bill mentioned from his book was talking about the,
the value of that,
right?
The value of the IP being part of the whole package,
right?
I mean,
it's something I didn't think of before.
It's like,
oh yeah,
that protection is very important because that's part of the value of it,
by the way,
what you're doing at all those pieces.
Uh Joseph been calling that for a while with um Jeff Gomez trans media.
I mean,
you're,
you're telling your story in different types of media,
that's what trans media means.
So,
so that's why you have to protect all of these different things in different channels that they are actually gonna be delivered in.
Right.
Absolutely.
Because they could be a game,
they could be a book,
they could be a movie,
could be the metaphors.
Oh yeah,
yeah,
we should do a podcast on that.
Oh,
wait,
this is a really bad memory.
Our next episode.
Oh Wait,
that was episode number one.
That's number one,
number one with the bullet.
Uh So the story,
a story I was gonna tell about uh securing your IP.
So uh Steve took me out to L A and we're doing,
you know,
the whole folk tellers universe and,
and he sets up all these meetings in L A and so we're in this um rented uh L A bungalow and it was an Airbnb.
Yeah,
it was and I'm gonna do like a door song because because now,
but I was with Little Steve in a Hollywood bungalow.
Um But uh I think you're the one with the God that I don't know.
But anyway,
so someone will know the lyrics to L A woman of which I'm referring.
Thank you.
See,
Bill's nodding his head.
Thank you,
Bill.
Even though it's a token nod,
that'd be a story that you started about an hour ago.
You started a story about an hour,
an hour ago.
So here we go.
Come on.
All right.
Uh Bill,
can you patch in L A woman?
Uh On this part,
I don't have the rights.
It's protected.
We'll talk about that,
we'll talk about that,
someone secured those rights on it.
So we're in L A and,
and we're in the bungalow for our means.
It's the morning and Steve,
you know,
Mr Digital social media guy and he goes,
dude,
like we got to lock down this,
I'm not a social media guy.
Ok?
He's a,
he's a social media,
he's my social media guy.
Now.
You're,
you're more than that,
you're just my guy.
Oh,
you're just my guy.
Ok?
I don't think this is that type of offense.
Well,
he's got that half eaten banana shirt on.
Right.
That's right.
Yeah,
I got a pink shirt with John.
We did open up this session with uh ladies and gentlemen and everybody in between.
So I guess right off the bat,
but go ahead,
I'm Juan today.
So all right,
back to the story.
Back to the story.
So in this episode,
um so we're in L A where it's in the morning before our meetings and he's like,
you gotta lock all this social media down,
you gotta lock down the folk teller's name across media and he's going,
he's like this is available,
it's available on Twitter,
it's available on Instagram and I'm like,
OK,
he goes,
we could,
he goes,
you don't understand and so I'll like pass it.
Why is,
why was that a big deal?
Because all of those different social media platforms or channels for you to be able to send content out to and every single one of them has like a vanity name to it.
And if you can't lock that down right across the board,
then someone else will.
So,
you know,
and you,
and that's not even about having a trademark on that.
So say,
for example,
you have the trademark on folk tellers,
which we do,
right?
But you don't have the Instagram folk tellers and some so someone can literally start pumping stuff out to that one and you know,
yeah,
you could probably send them a cease and desist letter,
but then that becomes expensive to do that.
Sure.
So if you're smart,
you when you come up with the name and you do a patent,
you do a uh copyright or I should say a trademark or service mark search,
you should look right across the board at all of the different social channels to see whether you can lock it up.
And by the way,
for people that are into this,
this is the start of your platform,
this is creating your digital footprint and um and that's what I advise.
That's a great point because,
you know,
years ago,
we didn't have to worry about that,
right?
If we had a copyright for a book,
that was the book,
right?
But now you're saying,
and I agree that that boy,
you gotta make sure you lock down all the social media avenues,
right?
I mean,
all of them,
right?
I mean,
you want to get as many as you can because if you don't control your narrative and your story,
someone else will.
That's folk tellers has been talking about for many,
many years.
Well,
so in Bill's book,
I mean,
his whole premise is,
you know,
the,
the three steps.
It's the,
the research,
the collect and protect and um I don't think what most people realize because all this is hidden,
like no one's gonna tell you this.
I mean,
you have to,
you have to go find,
you have to talk to like,
yeah,
I mean,
we are not lawyers,
we're not providing legal counsel.
We highly recommend that you find someone who is an expert,
intellectual property and have this conversation with them when you think that you have a great idea.
Um,
it costs money,
it costs time.
But,
uh,
we've all done it and,
and,
uh,
it's,
you know,
it's well worth it.
It's well worth.
Um,
if you think you've got a good enough idea,
it's well worth putting money down because even when Steve,
like,
unfortunately,
um,
those platforms weren't locked down and they didn't cost us a ton of money.
But,
like,
yeah,
I mean,
people make a living.
You haven't got my bill yet.
Well,
we're,
well,
well,
the bigger you are,
the more of a target you are too though,
right?
If you can get it before you become a big fish and that's the thing.
And the only thing is you don't know what he,
he said it before.
You don't know what something can become.
You don't know what this idea,
uh,
in patents they call it.
Well,
everything it's called art.
Art,
right?
And you don't know where,
where that's going to be in the future.
So the idea is to make sure that you're controlling all of the different platforms and all the names and the narrative just get starts to get published out there.
And all of a sudden you've got a huge,
you know,
footprint of uh of content and that's where the value is of what you're doing,
especially when you're doing things digitally these days.
It's like people look at something digital and they go,
well,
I don't see a building or,
you know,
I don't see a car,
I don't see any physical assets.
But meanwhile,
in the electron world,
it's enormous.
I mean,
this,
you know,
how much content and how much things that you built and it's as,
and as it's as valuable as regular buildings,
if not more because some of the interesting things are,
I can go back to ideas and patterns that I had,
you know,
10,
15 years ago,
open up those files and they haven't deteriorated.
It looks exactly the same as the day that I left that file.
But if I had a building,
that building is not gonna look like that.
I got a question about that Steve because is it only valuable based on the number of impressions I would gain in that area or is it valuable before that?
I mean,
because you,
you,
you're locking this down with the idea that it is gonna become valuable.
But is the value only in impressions that,
of course,
so you can answer this multi tiered question.
So there's,
uh,
there's companies that make a living off of just buying URL S and then reselling them,
they sit,
you know,
they,
they buy hundreds of thousands of URL S and they just wait to see if those names hit or someone and then it's like anywhere between,
you know,
sell them to you for 20 bucks or 20,000,
it's like scalping concert tickets.
Yeah,
that's what it is,
is Joseph Bastian dot com right now.
I wonder that's why uh we do.
Yes,
you got that.
He got me that for Christmas to put a little digital bow on it for him.
So this,
so,
so to answer,
you know,
so there's Kurt's question and uh you know what you're touching on and you've,
you've talked about it a little bit,
I think already,
but I think it's,
it bears repeating,
talking in depth around protecting your story.
You know,
you came up with the model.
Um CF I,
so what,
what's,
what's CF I?
And how does that impact protecting your story and communicating your story?
Well,
II,
I mentioned that in the previous podcast,
so I don't want to get into the detail,
but just CF I,
but it's content,
frequency and influence,
you gotta have content,
which is your story,
you have to have frequency,
which is all those channels that we were just talking about.
Like placing content into them on a regular basis.
And a cadence where people know that the content is coming just like this podcast,
people are gonna go,
hey,
there's a podcast coming next Tuesday again.
And you're telling people that.
So then they start to expect it when you just drop off or you're,
you know,
you're not sending content,
people aren't gonna follow you.
That's,
that's how you get a following because they expect things to be sent to you.
And then the I obviously is the influence side and that's where you actually get people of influence to help you expand whatever your product is or,
or your service or um or your music or whatever you're doing.
So,
so what risk would be we be running?
So we went,
you know,
early on,
we spent the money and the time to uh uh trademark uh folk tellers and to,
you know,
create our brand and to do all the,
you know,
do all the,
the work that we needed to do.
What if we wouldn't have done that?
Where,
where would we be now?
Like if we had this podcast,
what,
where would,
where would our risks be?
Well,
someday an accountant is gonna take all of your assets and they're gonna apply value to it.
And every one of these pieces that you own has a value to it.
So people just think that,
oh,
it's just physical assets that have value it,
isn't it?
So,
this whole digital world has just as much value,
if not more than,
than what the physical world does.
And,
um,
and to not to not understand that as far as a business,
you know,
you know,
in this era would be very foolish.
But is it,
is it value kind of like a house?
I could have a value in my house,
but unless I sell it,
it doesn't matter.
But is it kind of that way as well?
What you're describing?
Yeah,
I mean,
anything is worth what someone's gonna pay,
right?
I mean,
that's,
that's what it is but there,
there's comparatives.
I mean,
when you're dealing with houses,
you're someone's gonna,
you're gonna compare it with the other houses on your street.
Well,
you're gonna compare it with other domain names that have X number of traffic or you know,
where you are on the Alexa rating or you know how many Twitter followers you have and so on and so on.
I mean,
that's,
that's,
that's,
yeah,
it's still important.
Now,
obviously,
if you're selling products,
your products and services have to be good too.
That's the,
the sea could be replaced with products as well,
not just content,
it could be products,
frequency and influence and we just came up with that today.
But uh but yeah,
I write that down but I have a question.
Uh Bill talked about the three aspects in his book,
right?
The research,
the second one.
What does that mean,
exactly for the second aspect of that.
So to collect.
I know.
Yeah.
So,
so you actually have to collect your assets and,
and,
and it's looking at what Steve said you have,
you have,
uh,
an auditor or an accountant come in and it's not just physical assets like buildings and books,
it's also,
you know,
digital and,
and it's everything and then putting a value to it.
So you gotta,
you gotta collect it and say what,
what really is the scope and reach of our intellectual property and to have someone come in,
who knows how to do that?
Because you wouldn't know like most that's the thing is all this stuff is hidden.
Like as a business owner,
you,
you would not intuitively,
you know,
any of this,
like he said,
like uh the Kieler Elf was worth $1.5 billion.
Just the elf,
just the image of,
of uh what's his name?
I'm trying to blank.
Oh,
it's,
we have to ask Bill would do you know the name of the Ke Ernie?
Ernie?
Boom.
Thank you.
That's my brother's name.
So uh yeah,
it's Ernie the Elf.
He an E as well.
Uh Some days he,
yeah,
he could be,
he could be impish like Steve Steve's impish sometimes he's,
you're Elvin,
impish,
sprightly.
All right.
All right,
I'll stop my um What was your question?
You answer the question about the collection.
So,
collecting is,
is,
is gathering all of your IP and assume,
and again,
you don't assume that,
you know what all your IP is until you actually go through the exercise with the professional.
Can I give you a story on that one?
You absolutely may give us a story.
So,
I,
you know,
I worked with the,
um,
with the Zappa State for a long time with,
ah,
Zappa Frank Zappa's son.
I mean,
he,
ahmed had to take the estate when his mother passed away and take all of the analog assets that were in their vault that they had.
And there was a lot and he had to have them all converted over to digital to make sure they preserved because a lot of them were actually,
you know,
degrading music stats and records and tapes or whatever.
And,
um,
that is,
you know,
to them,
that's the value,
that's everything that they needed to be able to,
you know,
you know,
give that to an account and say,
here,
you know,
put,
put a value to this,
let us know,
you know what this is worth and all of these,
uh,
you know,
these music estates have to do that.
Now,
even Prince had apparently had a huge library of assets and all of those would have been done would have been recorded analog originally and would all had to be converted into digital.
Um,
I hear still to this day that people,
uh,
the best medium for recording or,
you know,
keeping music and data is C DS still because they,
they don't,
they don't,
they don't degrade,
um,
anything that's tape and,
you know,
and that type of thing does degrade.
So if you're gonna back something up,
burn it onto a CD,
because a CD will be around in many,
many years and you can find a CD player still.
There'll only be two things around in 100 years.
Golf balls and C DS and cockroaches and cockroaches.
Well,
let me tell you one of my biggest mistake that I made uh from my,
my first book from glory day.
I remember the publisher came in after a certain time.
Every book has a shelf life,
right?
And the publisher came to me and said,
well,
do you want to buy your original plates?
I think they call it.
I'm not sure when printing what they call that,
but you have the original plates and there was a price tag at,
you know,
250 bucks or whatever it was.
I don't remember what the price was and I'm like,
uh,
no,
I don't need it,
you know,
and now I regret the fact that I didn't do that because I would have the in the original plates for the printing that I could take anywhere and do.
And now you have to start all over again.
So anybody out there that's looking at authoring a book,
if you get offered the opportunity to buy those original I don't know what they call them,
anybody know what they call them or whatever.
Yeah.
From the printing of the actual book I should have bought them because then I have those,
right?
Otherwise they just destroy them.
Right.
Start all over again.
Well,
you guys are touching on some interesting things because as creators,
as storytellers,
our inclination is to create,
set behind us and continue to create.
So and there's probably people listening that are like nodding their heads.
It's like,
yeah,
when was the last time you stepped back?
And you looked at the collection of all of your,
all of your work,
all of your art,
all of your inventions.
Well,
the thing is where do you,
where do you put it?
Right.
That's the next thing.
Yeah,
and,
and like format and all that kind of stuff.
I don't mean that,
I mean,
a lot of people,
they just have it in their name or they might have it in a business's name,
but the thing they don't understand,
you better have it in a trust because if it isn't locked in a trust when you leave this planet,
it will be gone,
it will be taken.
And you hear that all the time,
there's a lot of people that,
that don't have trust that,
you know,
and,
and that's an easy,
that's an easy thing to set up,
you know,
contact your lawyer and,
and say,
look,
I have to these assets and I don't want to put them into a truck but a lot of people,
and I,
and I'm not,
you know,
giving people advice,
legal advice,
but relative to our IP and what we're doing,
everything is,
is put into it.
It's almost like,
um,
putting your personal will together but around your,
your IP.
Yes.
Well,
and you used an interesting word that I picked up on.
Trust.
It all boils down to trust.
right?
Because you have to trust that your information,
your content,
your product,
whatever it is is protected because otherwise,
can you trust that that won't be,
you know,
like you brought up a great example and I didn't even think about this if and when my final breath happens,
what happens to my IP.
Unless it's in a trust,
it's wherever it ends up after that and you have family members and then they get into fun.
They like,
no,
no,
no,
it's the other way around.
It's like,
no,
it'll become popular when you take your final.
That's the way it normally works in that world unless you're of us being still alive,
I think.
And,
well,
yeah,
he's in Kalamazoo,
Steve.
Don't tell Kurt our plan,
which they take my stuff and you can have someone,
someone has to die for this podcast to take off after the,
after our,
our series is done.
Can I suggest it's Bill our producer?
No,
no.
Well,
he said he's already dead inside.
So it doesn't matter,
whatever you're a I Joseph,
you were already killed.
So no one has to,
no one has to die.
Now you're already dead.
There's the story,
we have to protect that.
The A,
what I'll write a story on A I Joseph.
No,
I'll use a I to write the story in 20 minutes.
There's a story in the story like the w but what's,
you know,
I,
I think out of this whole conversation,
what's really important is understanding that there's value and that's something that,
you know,
you mentioned Joseph that we just,
our focus is creating,
right?
We just want to create,
we just want to create,
put it behind us,
create,
put it behind us.
And,
and I think about Thomas Kincade,
most people may not know Thomas Kincade,
but he's the painter of light Thomas painter behind our couch in our house.
And I don't know if you know the back story,
Thomas Kincade.
I mean,
he,
he was really in a really bad situation growing up,
right?
Very poor.
Um Anyway,
his,
his transcending the way he overcame that was by drawing and painting.
My reason for bringing it up is that he started painting these Hollywood sets and,
and painting landscapes and somebody saw him painting one day on the street and said,
wow,
that's,
that's amazing.
I I can help sell that.
And it's when the creator met the salesman.
And so they started,
you know,
selling things and then it became the fact that he was at a wedding one time and he sat next to somebody that said,
what,
what are you doing?
He's like,
well,
I'm a painter and they're like,
well,
you know,
how are you doing?
Who was running your business?
And it's when the,
the creator who had a salesman met the businessman and tied it all together and he became the first billion dollar commercial artist as a result.
It all started with that.
But my point is this,
that,
that then it ended.
Yeah.
And unfortunately tragically,
yeah,
absolutely.
But the,
the,
the point is the point,
the point is um business,
business aspect and what happened was he got,
well,
and then he got taken to the cleaners like it was a bad deal because they were running the kin cake galleries and then he ended up having to buy,
yeah,
he had,
he had to buy it back and then,
yeah.
So,
but the point is the business side of it and the protection of that.
I mean,
he didn't.
Yeah.
And it's all he wanted to create.
That's all you wanted to do.
And it's a whole different skill set.
I'm so glad you're bringing this up because this is crucial for people listening out there that the creative people,
the storytellers um you need someone with a business mindset that understands these things because it's a whole different skill set uh to do this and,
and like you can go back in history and most inventors died poppers because they weren't,
they weren't good business people.
They were,
they were creatives and they were creating things and they were inventing things and they usually get screwed because someone with a business mindset comes in and like,
man,
I can make a ton of money on that and they,
they offer him the moon and they,
they cut him a bad deal.
And,
uh,
you know,
I mean,
you could,
you could list them like Eli Whitney Tesla on and on and on or they didn't protect their IP,
didn't we talking about today?
Talking about is a great example of someone that just wanted to give because there's two sides to the coin here.
You've got the side of securing and protecting your IP.
But there's a huge community of open source,
for example,
which is all about giving and what happens when you give other people add to that art,
right?
So say,
for example,
I write a small program and I,
I put it up on,
get up and I said,
look here,
download this and,
and,
and,
and add to it and,
and all of a sudden that becomes something even more amazing too.
So I'm not just saying secure,
everything that you do there,
there's other components to life where giving is good and giving to the community.
There are certain things that you should give because for the for the betterment of the world if you do give them and Tesla tried to do that many times and I,
we won't mention any names of who made that into a service.
But um the world would be a different place if Nikolai Tesla,
you know,
got what he wanted.
You work for Thomas Edison.
I didn't say that.
A I Joseph just said Thomas Edison,
you're already,
you're already dead.
You can say that.
That's all right.
I'm already dead.
You can,
you can't do anything to me.
So for our listeners,
protecting IP comes in all different fashions.
It comes with securing the content across the board,
social online.
But also like you just said,
though,
there is a time to give it away,
there is a time to give something away.
Yes,
definitely.
I mean,
if you think that it's bigger than you and it's bigger,
you know,
and,
and other,
and where other people can add to it,
right?
Because trying to negotiate that into contracts and it's like,
oh you created this piece and this piece,
it becomes such a headache.
It's,
it's probably just as easy to say,
I'm gonna make this open source and I,
and I want the ability to be able to use this.
I'm using technology as an example.
I wanna be able to use that technology for in my business and it becomes open source.
Wordpress is a prime example of that.
That's a word that's an open source application which many,
many developers have have worked on.
So I have a question back to one of the original questions.
Does it really matter?
I mean,
even if I go through all this of protecting,
of,
of solidifying,
you know,
making sure my domain URL all these things are are in tech.
Uh does it matter?
Why does it matter uh in the end for something like this?
It is part of the value as mentioned,
you know,
in Bill's book,
he talked about the value of that.
But how,
how do we assure that it is still protected?
So here this is my,
are you if you're asking me personally as I,
I'm only asking you professionally,
but yeah.
Ok.
If you want to answer it personally,
go ahead.
Well,
that's the same thing.
I mean,
you know what you see is what you get,
I'm sorry.
Uh I think protecting it and one of the thing,
you know,
Steve was talking about,
uh,
you know,
securing the rights and protecting you can still give people access to your protective IP and you know,
yeah,
and you want to,
but,
but you have like you,
then you have the say and the thing is people are still gonna steal like Picasso's quote,
you know,
people are still gonna steal.
And uh,
well,
we were ok,
we were talking to uh Dave cooler from,
from full house and Dave was,
we were having breakfast with him and he said,
uh he goes,
you know,
I tried to,
I,
I actually copyrighted that.
Cut it out,
you know,
his,
his signature move with the scissors and,
yeah,
they cut it out,
look up,
cut it out.
You'll know exactly what we're talking about.
But,
um,
he said so many people have used it on memes and this and that.
It's like,
you know,
it's,
it's copyrighted,
it's protected but people steal it all the time.
So then you have to make a decision is like,
you know,
is it worth chasing everyone or sending cease and desist letters?
Probably not.
But um that doesn't mean um you shouldn't protect it because it's just,
it's just a good business practice to have it protected.
So many people like all,
all the images you see online,
you know,
most of those are rights protected and people use them all the time um illegally,
like you could,
you could pursue that and most people who put pictures up online,
if you ask for permission,
they would give you permission to use it.
Yeah.
And there's non royalty aspects of images and music,
but there's also the royalty aspect of it.
I mean,
I dealt with this with,
with my book from glory days because we had the images of the four Detroit teams,
the Pistons Tigers,
red Wings and lions.
And that I gotta tell you that was a quite a experience in learning process because of the licensing with each of those jerseys,
right?
We had a picture of each jersey in the front of the cover.
And,
and to be honest,
one of the most difficult was that old English tea from the Detroit Tigers because the Detroit Tigers do not own that.
That's owned by major league baseball properties incorporated in New York City.
And we had to go about three months back and forth with legal paperwork and they literally want us to have a,
um,
$4 million liability policy on the book.
And I'm like,
what somebody gonna get a paper cut and sue major league baseball.
But literally,
so we went back and forth for a while.
And finally,
they were like,
well,
you know,
you have,
uh,
heirs and omissions to the publisher,
right on the,
yeah,
of course,
they said,
all right.
Well,
let's cut the,
the 5 $4 million liability policy,
but you still have to sign this six page licensing agreement that's very strict about what you can do and can't do with that image.
And so my point is this that they,
that,
you know,
you talk about supports.
It was one of our previous conversations,
an episode,
but sports have a huge IP that they protect and they're marketing monsters and their,
and their merchandise and you have to prove authenticity of those merchandise.
I mean,
like if something is signed like a helmet or a shirt,
you normally comes with a certificate that says this is authentic,
right?
So authenticity is a major part of securing IP and IP can be a shirt as soon as I sign or a ball and it says it's got to have the official license,
property of whatever,
you know,
the tag those tags are on there.
Well,
so Steve,
you've got a story about the uh hero's journey so that the,
the series we're working on with the uh the black musical artists and the name Hero's Journey.
Uh You got a letter,
we got a letter from uh from the Joseph Campbell.
Found.
Correct?
Yeah.
So Joseph Campbell,
for those that don't know,
is uh a mythologist who uh coined the term the hero's journey.
And he,
he kind of came up with the model for the progression of the hero's journey,
um uh probably like 50 years ago.
So now it's owned by a non-profit foundation,
but go ahead.
Yeah,
and basically said,
they said,
listen,
you can use Hero's journey.
The series as long as you're not referring to,
I think it's a 17 step process of heroes,
different,
yeah,
different,
different stages.
But that's basically what they were saying.
So,
um we wrote a letter and my attorney wrote a letter back and said,
no,
we're not referring to that at all.
We're just using the name Hero's journey because these musicians are going on a hero's journey and it's a series of,
of different artists and you know,
that type of thing.
And um immediately they sent back a letter and said,
fine,
go ahead.
Yeah.
So that's how easy it can become.
But what ha when bad things happen is when you don't do that and you don't try to,
you know,
do it the right way and you just take and that's what a lot of people do.
Like you,
you guys were talking about,
people take images and they do that and then you're gonna get yourself into trouble.
Someone's gonna come after you,
right?
So it's,
it's not about um being litigious or like,
you know,
when we began,
it's like it's not about suing people.
It's just about sound business practices.
And if you believe that your intellectual property,
that the,
your creative assets have value,
it's important that you protect them.
I think that's,
you know,
that's really the,
the simple message,
uh the simple message.
That's the story.
Yeah,
that's the story and you're sticking to it.
So Steve just ended the whole episode.
No closure needed at this point.
There you go.
So uh yeah,
but we,
but I can't leave it at that.
So yeah,
so wrap up.
So like,
you know,
from your personal experience,
you know,
protecting your story,
how important is it and why should you do it?
Um Protecting your story is the most as we,
we always say,
we don't,
you don't protect your story.
Someone else is gonna take your story for you.
It's that simple and you got all the lines today.
Well,
you've taught me well.
That's sweet.
And I love your pink shirt.
Yeah,
for me,
I think the biggest thing in the takeaway is that we have all ideas.
We all have ideas,
right?
We all have ideas that we create and,
but I think one of the biggest things is I don't know what my idea might become tomorrow and to be safe,
to protect that idea today because you don't know what's gonna come tomorrow.
I didn't know that my book was gonna turn into a TV show to turn in all these other aspects into trans media after this,
right?
Which it has and it will continue to morph into.
And so protecting that I think is really important because,
you know,
having,
having that hindsight now,
I can see it,
but at that time I did.
And so that's why it's important to say,
boy,
take the time to research,
collect and do.
What's the other thing that Bill said,
protect,
protect,
right?
So those three aspects very important and I'll just,
I'll just echo that before we,
before we wrap up,
just going through that process,
it's gonna change the way you think about the things that you're creating.
Uh to,
to me,
it really kind of codifies and solidifies a lot of creative ideas and really it forces you by going through that through that process of research,
collect and protect into,
into really looking at the broader picture and pulling that thread all the way through.
So um if any of you out there want more information,
we highly recommend.
Uh So Bill Honaker also known as the IP Guy,
you can go to IP guy dot com.
He's got some really good free content there and information about securing your story and securing your IP.
So we highly recommend that.
And uh that's a good one,
guys.
Thank you.
And this is protected.
Our,
our,
our podcast is protected.
This is under,
has a trademark on that too.
Take care everyone.

1
00:00:08,220 --> 00:00:09,229
Ladies,
2
00:00:09,239 --> 00:00:11,420
gentlemen and everyone in between.
3
00:00:11,430 --> 00:00:14,739
Welcome to the folk tellers stories.
4
00:00:14,750 --> 00:00:16,620
We shared podcast this week,
5
00:00:16,629 --> 00:00:25,750
we're gonna be talking about securing your story a little professional and personal advice on protecting your narrative on the open market.
6
00:00:25,760 --> 00:00:30,409
So the beggars and thieves can't take your good story telling.
7
00:00:30,420 --> 00:00:33,569
Uh I'm here with my compatriots,
8
00:00:33,580 --> 00:00:40,209
Kurt David and I keep thinking about your opening here of ladies and gentlemen and everybody in between because now we're talking about protection.
9
00:00:40,700 --> 00:00:40,819
Ok.
10
00:00:40,830 --> 00:00:42,830
I'm not in touch with that and,
11
00:00:43,020 --> 00:00:44,029
and cut that out.
12
00:00:44,040 --> 00:00:45,189
But are you wearing any?
13
00:00:46,000 --> 00:00:46,549
Ok,
14
00:00:46,560 --> 00:00:47,029
this is,
15
00:00:47,040 --> 00:00:47,389
we're,
16
00:00:47,400 --> 00:00:49,349
we're going down the rabbit hole quick,
17
00:00:49,360 --> 00:00:50,889
Steve can't even get his name out,
18
00:00:50,900 --> 00:00:52,200
but uh you're here.
19
00:00:52,209 --> 00:00:53,189
Who else is here?
20
00:00:53,520 --> 00:00:53,610
Well,
21
00:00:53,619 --> 00:00:54,229
I'm here,
22
00:00:54,240 --> 00:00:55,150
Steven Sadler,
23
00:00:55,180 --> 00:00:55,909
Steven Sadler.
24
00:00:55,919 --> 00:00:56,619
I'm glad you're here.
25
00:00:56,630 --> 00:00:57,650
Steven Sadler too.
26
00:00:58,299 --> 00:00:59,610
I would have missed you if you weren't here.
27
00:00:59,619 --> 00:00:59,909
So,
28
00:01:00,150 --> 00:01:00,479
anyway,
29
00:01:00,680 --> 00:01:01,189
all right.
30
00:01:01,270 --> 00:01:01,509
So,
31
00:01:02,509 --> 00:01:08,309
uh uh that was like just checking it in with the laughter,
32
00:01:08,319 --> 00:01:08,489
right?
33
00:01:08,500 --> 00:01:09,819
So securing your story,
34
00:01:09,830 --> 00:01:11,730
uh We've all published.
35
00:01:11,739 --> 00:01:14,260
Uh Some of us had patented,
36
00:01:14,540 --> 00:01:16,000
uh our stories,
37
00:01:16,010 --> 00:01:17,410
our ideas and,
38
00:01:17,430 --> 00:01:17,930
you know,
39
00:01:18,139 --> 00:01:18,470
it's a,
40
00:01:18,480 --> 00:01:19,639
it's a hidden world.
41
00:01:19,650 --> 00:01:20,639
It's a hidden world.
42
00:01:20,650 --> 00:01:20,959
I,
43
00:01:21,069 --> 00:01:21,720
the quote,
44
00:01:21,730 --> 00:01:27,180
I begin with is uh Pablo Picasso says a bad artists,
45
00:01:27,190 --> 00:01:29,360
copy good artists steal.
46
00:01:29,370 --> 00:01:29,910
I'm like,
47
00:01:30,209 --> 00:01:30,379
oh,
48
00:01:30,389 --> 00:01:32,319
that's not nice.
49
00:01:33,029 --> 00:01:34,580
But uh uh one of our,
50
00:01:34,589 --> 00:01:36,480
so I wanna want to start with a,
51
00:01:36,489 --> 00:01:43,879
is a book written by um one of our friends and actually our intellectual property uh attorney's name is Bill Nier.
52
00:01:43,889 --> 00:01:45,080
Bill wrote a book,
53
00:01:45,089 --> 00:01:49,239
uh a really cool book uh called the Business Owner Guide to Intellectual Property.
54
00:01:49,250 --> 00:01:50,800
Turning your ideas into gold.
55
00:01:50,809 --> 00:01:52,870
And Bill is an IP lawyer.
56
00:01:53,080 --> 00:01:55,419
Uh Bill couldn't be with us,
57
00:01:55,430 --> 00:01:56,819
but he's letting us,
58
00:01:56,830 --> 00:01:58,910
uh he's letting us actually steal some of his stuff.
59
00:01:58,919 --> 00:02:00,040
So that's kind of cool.
60
00:02:00,050 --> 00:02:02,500
Um Well,
61
00:02:02,510 --> 00:02:05,370
I guess it's not stealing if he gave us the rights.
62
00:02:05,379 --> 00:02:06,589
Picasso said it's ok.
63
00:02:06,949 --> 00:02:07,449
All right.
64
00:02:07,459 --> 00:02:07,930
So here's what,
65
00:02:07,940 --> 00:02:14,479
here's what uh Mr says about intellectual property and about protecting your,
66
00:02:14,490 --> 00:02:17,440
your creative ideas and stories and endeavors.
67
00:02:17,910 --> 00:02:24,759
He said every business and this could be every person needs to make intellectual property a top priority in their planning.
68
00:02:24,770 --> 00:02:29,259
Financial experts say that intellectual uh an intellectual property portfolio,
69
00:02:29,270 --> 00:02:35,550
say that three times fast is typically one third or more of the total value of a business.
70
00:02:35,619 --> 00:02:38,699
Intellectual property can also lead to greater profits,
71
00:02:38,710 --> 00:02:40,169
expanded market share,
72
00:02:40,220 --> 00:02:43,860
multiple streams of revenue and better business reputation.
73
00:02:44,149 --> 00:02:49,800
Uh Bill was the uh lawyer for uh Kellogg's for years and years and years.
74
00:02:50,039 --> 00:02:51,529
And uh they sold,
75
00:02:51,539 --> 00:02:54,619
when Kellogg sold um part of their portfolio,
76
00:02:54,630 --> 00:03:01,919
they sold Ernie the Elf uh from Kieler cookies and he had been uh the Chief Elf since 1968.
77
00:03:02,190 --> 00:03:04,149
Uh and in 2001,
78
00:03:04,160 --> 00:03:09,619
Kellogg's purchased Kieler Foods for approximately $4.5 billion.
79
00:03:10,050 --> 00:03:18,220
The intellectual portfolio that Ernie and his friends in the tree represented was $1.5 billion of that value.
80
00:03:18,479 --> 00:03:21,360
That is one very expensive Elf.
81
00:03:21,369 --> 00:03:27,380
And one of the things that bill advises is it's 33 steps.
82
00:03:27,389 --> 00:03:31,460
He says you need to research,
83
00:03:32,250 --> 00:03:35,979
collect and protect and we're gonna talk a little bit about that.
84
00:03:35,990 --> 00:03:36,889
So what do you,
85
00:03:36,899 --> 00:03:36,919
um,
86
00:03:36,929 --> 00:03:38,259
what do you guys feel like?
87
00:03:38,270 --> 00:03:38,990
Uh is it a,
88
00:03:39,000 --> 00:03:44,250
is it a waste of time to try to lock down your,
89
00:03:44,259 --> 00:03:47,929
your ideas and your story or is it something,
90
00:03:47,940 --> 00:03:48,309
you know,
91
00:03:48,509 --> 00:03:49,570
in your personal experience?
92
00:03:49,580 --> 00:03:50,789
Is it something that you've,
93
00:03:50,800 --> 00:03:50,830
uh,
94
00:03:51,589 --> 00:03:53,809
you've had good luck with no luck with or what,
95
00:03:53,820 --> 00:03:54,250
what about you,
96
00:03:54,259 --> 00:03:54,559
Steve?
97
00:03:54,570 --> 00:03:54,729
I mean,
98
00:03:54,740 --> 00:03:55,059
you've done,
99
00:03:55,070 --> 00:03:57,380
you've done a lot of stuff on your,
100
00:03:57,389 --> 00:03:59,580
uh your ideas and your stories.
101
00:03:59,589 --> 00:03:59,869
Um,
102
00:04:00,199 --> 00:04:01,649
some things you've,
103
00:04:01,660 --> 00:04:02,360
you've just written,
104
00:04:02,369 --> 00:04:04,100
like I can tell you as a writer,
105
00:04:04,330 --> 00:04:04,860
um,
106
00:04:05,300 --> 00:04:06,059
you retain,
107
00:04:06,070 --> 00:04:06,800
like if,
108
00:04:06,809 --> 00:04:10,369
if you write something down and you have a physical or a digital copy of it,
109
00:04:10,740 --> 00:04:11,259
um,
110
00:04:11,339 --> 00:04:13,440
that you can prove is written at a certain time,
111
00:04:13,449 --> 00:04:13,520
it,
112
00:04:13,529 --> 00:04:18,670
it's got sort of automatic copyright but you don't have all the protections versus filing it.
113
00:04:18,679 --> 00:04:19,140
But Steve,
114
00:04:19,149 --> 00:04:19,519
what about,
115
00:04:19,529 --> 00:04:19,940
you know,
116
00:04:20,338 --> 00:04:22,989
what's been your experience in this because you've done a lot with like,
117
00:04:22,998 --> 00:04:26,109
like patents and devices and technology and stuff.
118
00:04:27,220 --> 00:04:32,899
I think it depends on the reason why you're trying to secure the IP.
119
00:04:34,029 --> 00:04:36,279
And what I mean by that is if you're,
120
00:04:36,290 --> 00:04:41,839
if the reason that you're trying to secure it is because you want to sue people later on,
121
00:04:42,739 --> 00:04:46,190
then that's not the right reason to secure the IP.
122
00:04:46,809 --> 00:04:50,799
Securing the IP should be kind of going to what Bill wrote in his book there.
123
00:04:50,970 --> 00:04:51,500
You're,
124
00:04:51,510 --> 00:04:52,579
you're creating wealth,
125
00:04:52,589 --> 00:04:53,660
you're creating value.
126
00:04:53,670 --> 00:04:59,820
So the reason that you're patenting something or you place a copyright on something or you're protecting your brand,
127
00:04:59,970 --> 00:05:02,220
it's to build the value of the entity that,
128
00:05:02,230 --> 00:05:02,359
that,
129
00:05:02,369 --> 00:05:07,040
that it's in and that doesn't matter whether it's a product or whether it's a song or whatever.
130
00:05:07,279 --> 00:05:09,649
Um But a lot of people don't,
131
00:05:09,660 --> 00:05:10,630
they don't see it like that.
132
00:05:10,640 --> 00:05:11,209
It's like they,
133
00:05:11,220 --> 00:05:11,869
they wanna,
134
00:05:11,880 --> 00:05:12,190
you know,
135
00:05:12,200 --> 00:05:18,429
kind of secure it and protect it for the purpose of either sitting on it and suing someone else later or whatever.
136
00:05:18,640 --> 00:05:19,089
And,
137
00:05:19,100 --> 00:05:21,410
and as an event and as in being an inventor,
138
00:05:21,420 --> 00:05:23,019
that's bad energy to me,
139
00:05:23,109 --> 00:05:23,410
the,
140
00:05:23,420 --> 00:05:23,730
you know,
141
00:05:23,739 --> 00:05:25,970
the reason that you're doing is you want to protect,
142
00:05:26,119 --> 00:05:26,529
you know,
143
00:05:26,540 --> 00:05:28,179
your art.
144
00:05:28,410 --> 00:05:31,690
And the interesting thing is when you're dealing with patents and trademarks,
145
00:05:31,700 --> 00:05:32,950
it's actually called art.
146
00:05:33,799 --> 00:05:34,369
Really.
147
00:05:34,540 --> 00:05:35,049
Yes.
148
00:05:35,970 --> 00:05:36,540
Matter of fact,
149
00:05:36,549 --> 00:05:37,579
if you're doing a search,
150
00:05:37,589 --> 00:05:40,359
you're looking for what prior art,
151
00:05:40,779 --> 00:05:46,019
that's the research part that Bill was talking about that the first thing is researching,
152
00:05:46,029 --> 00:05:46,950
making sure that,
153
00:05:46,959 --> 00:05:48,869
that idea or whatever it is,
154
00:05:48,880 --> 00:05:49,920
is not already out there.
155
00:05:49,929 --> 00:05:49,989
Yeah.
156
00:05:50,000 --> 00:05:50,859
And that's usually why you,
157
00:05:50,869 --> 00:05:51,809
you need an attorney,
158
00:05:51,820 --> 00:05:56,059
like an attorney go out and they'll actually do a proper patent search or a trademark search or whatever,
159
00:05:56,070 --> 00:05:58,679
find out whether someone else is using it and if they're not,
160
00:05:58,940 --> 00:06:01,170
or if you're doing something that's similar,
161
00:06:01,179 --> 00:06:01,609
then,
162
00:06:01,619 --> 00:06:01,829
you know,
163
00:06:01,839 --> 00:06:03,670
obviously they have to cite that and say,
164
00:06:03,679 --> 00:06:03,910
you know,
165
00:06:03,920 --> 00:06:05,799
this particular pattern here is,
166
00:06:05,880 --> 00:06:06,160
you know,
167
00:06:06,170 --> 00:06:08,489
similar and cited but yours is different.
168
00:06:08,709 --> 00:06:09,079
And,
169
00:06:09,089 --> 00:06:09,929
and that's the other thing.
170
00:06:09,940 --> 00:06:12,859
Another word that comes from stories is novel.
171
00:06:13,399 --> 00:06:13,760
You know,
172
00:06:13,769 --> 00:06:14,000
the,
173
00:06:14,010 --> 00:06:14,140
no,
174
00:06:14,149 --> 00:06:14,500
the,
175
00:06:14,510 --> 00:06:15,980
the novelty of,
176
00:06:15,989 --> 00:06:16,250
you know,
177
00:06:16,260 --> 00:06:18,559
of what a patent is it something original,
178
00:06:18,660 --> 00:06:19,239
original.
179
00:06:19,250 --> 00:06:19,329
Yeah.
180
00:06:19,339 --> 00:06:20,109
Actually,
181
00:06:20,119 --> 00:06:21,459
I think the definition is a,
182
00:06:21,470 --> 00:06:29,989
a patentability requirement according to which an invention is not patentable if it was already known for before the date of filing.
183
00:06:30,149 --> 00:06:31,920
So that is the key part.
184
00:06:31,929 --> 00:06:33,890
You have to have that component.
185
00:06:34,149 --> 00:06:34,920
It has to be,
186
00:06:34,929 --> 00:06:35,940
has to be novel.
187
00:06:36,230 --> 00:06:37,119
That's interesting.
188
00:06:37,130 --> 00:06:37,769
Kurt,
189
00:06:37,779 --> 00:06:39,260
um Kurt fell asleep.
190
00:06:39,269 --> 00:06:41,489
Um Kurt,
191
00:06:41,500 --> 00:06:43,880
we need to wake you up because you're like,
192
00:06:43,890 --> 00:06:44,040
what,
193
00:06:44,149 --> 00:06:45,160
what do I know about this?
194
00:06:45,209 --> 00:06:47,290
Like he's over here taking notes.
195
00:06:47,299 --> 00:06:47,570
He's like,
196
00:06:47,579 --> 00:06:48,040
shit,
197
00:06:48,049 --> 00:06:49,679
I didn't secure any of that.
198
00:06:50,089 --> 00:06:50,489
No,
199
00:06:50,500 --> 00:06:50,839
you know,
200
00:06:50,850 --> 00:06:51,000
it,
201
00:06:51,010 --> 00:06:52,950
it's funny because this is a great topic and,
202
00:06:52,959 --> 00:06:53,209
you know,
203
00:06:53,220 --> 00:06:55,899
one of the things that I've learned is that I'm still learning,
204
00:06:56,119 --> 00:06:57,320
but most of us,
205
00:06:57,329 --> 00:06:59,029
I think most of us will.
206
00:06:59,040 --> 00:07:03,070
I think it's safe to say most people will never be filing for a patent.
207
00:07:03,079 --> 00:07:03,380
Right?
208
00:07:03,390 --> 00:07:03,570
I mean,
209
00:07:03,579 --> 00:07:06,410
would that be a safe assumption that most people are not gonna file for a pen?
210
00:07:06,500 --> 00:07:07,470
But what is important?
211
00:07:07,480 --> 00:07:07,709
Right?
212
00:07:07,720 --> 00:07:08,690
For certain people,
213
00:07:08,700 --> 00:07:09,880
certain situations,
214
00:07:09,890 --> 00:07:11,640
I think it depends like you mentioned,
215
00:07:11,649 --> 00:07:16,350
Steve and it depends on what the idea is because as I tell people,
216
00:07:16,359 --> 00:07:17,140
every book,
217
00:07:17,149 --> 00:07:20,489
every TV show every product starts with one thing.
218
00:07:20,500 --> 00:07:21,450
It's an idea,
219
00:07:21,529 --> 00:07:21,799
right?
220
00:07:21,809 --> 00:07:23,850
It's an idea and we all have ideas.
221
00:07:23,859 --> 00:07:24,489
Some are great,
222
00:07:24,500 --> 00:07:25,130
some are grand,
223
00:07:25,140 --> 00:07:25,929
some are like,
224
00:07:25,940 --> 00:07:26,170
what,
225
00:07:26,179 --> 00:07:27,149
what was I thinking?
226
00:07:27,160 --> 00:07:27,529
Right?
227
00:07:27,600 --> 00:07:29,250
Something as simple as a Hula hoop,
228
00:07:29,260 --> 00:07:29,649
right?
229
00:07:29,660 --> 00:07:29,809
I mean,
230
00:07:29,820 --> 00:07:30,670
think about that.
231
00:07:30,679 --> 00:07:30,839
I mean,
232
00:07:30,850 --> 00:07:32,320
somebody who came up with that idea,
233
00:07:32,600 --> 00:07:34,630
um obviously has done well with it.
234
00:07:34,809 --> 00:07:35,279
Um I,
235
00:07:35,290 --> 00:07:37,309
I remember when I first wrote my,
236
00:07:37,320 --> 00:07:37,829
my book,
237
00:07:37,839 --> 00:07:40,350
my first book and talking about this,
238
00:07:40,359 --> 00:07:40,549
right?
239
00:07:40,559 --> 00:07:42,250
It's like this is new terrain for me.
240
00:07:42,260 --> 00:07:42,369
I,
241
00:07:42,380 --> 00:07:45,230
I didn't know anything about copyright or how did this work?
242
00:07:45,450 --> 00:07:47,750
And one of the biggest suggestions I had is,
243
00:07:47,760 --> 00:07:47,929
well,
244
00:07:47,940 --> 00:07:52,149
there's a poor man version that you can do right to protect your IP.
245
00:07:52,440 --> 00:07:52,890
And I said,
246
00:07:52,899 --> 00:07:52,980
well,
247
00:07:52,989 --> 00:07:53,589
what is that?
248
00:07:53,600 --> 00:07:55,679
And Stevie alluded to it about the time stamp,
249
00:07:55,690 --> 00:07:55,859
right?
250
00:07:55,869 --> 00:07:56,179
They said,
251
00:07:56,190 --> 00:07:56,649
well,
252
00:07:56,679 --> 00:07:58,239
if you have something written,
253
00:07:58,440 --> 00:08:01,070
you can mail it to yourself in a certified letter,
254
00:08:01,079 --> 00:08:05,570
it'll be time stamped with that certified letter and just don't open it because from that date,
255
00:08:05,579 --> 00:08:06,279
you can prove that.
256
00:08:06,290 --> 00:08:06,690
Hey,
257
00:08:06,700 --> 00:08:07,649
here it is.
258
00:08:07,660 --> 00:08:07,739
Right.
259
00:08:07,750 --> 00:08:09,790
And if it's in a court of law or whatever that is,
260
00:08:09,799 --> 00:08:11,790
I can then open it or have the judge open it.
261
00:08:11,799 --> 00:08:12,299
And here it is,
262
00:08:12,309 --> 00:08:13,290
this is my idea,
263
00:08:13,299 --> 00:08:14,000
by the way,
264
00:08:14,010 --> 00:08:14,910
and here's a time stamp,
265
00:08:14,920 --> 00:08:15,899
but that's a cheap version.
266
00:08:15,910 --> 00:08:17,540
You have to send a lot of those to you.
267
00:08:17,609 --> 00:08:18,269
What do you mean?
268
00:08:18,279 --> 00:08:18,549
Well,
269
00:08:18,559 --> 00:08:20,410
say you send one and someone,
270
00:08:20,890 --> 00:08:21,230
you know,
271
00:08:21,239 --> 00:08:21,470
it says,
272
00:08:21,480 --> 00:08:21,619
hey,
273
00:08:21,630 --> 00:08:22,579
this is my pattern.
274
00:08:22,589 --> 00:08:23,920
As soon as you open it up,
275
00:08:23,929 --> 00:08:24,859
you've opened it up,
276
00:08:24,869 --> 00:08:25,779
you only got one.
277
00:08:26,089 --> 00:08:26,299
Oh,
278
00:08:26,309 --> 00:08:27,739
so that's even a,
279
00:08:27,750 --> 00:08:27,760
a,
280
00:08:27,989 --> 00:08:30,480
it's a little more expensive than the Superman version.
281
00:08:30,589 --> 00:08:31,440
It's a great,
282
00:08:31,470 --> 00:08:33,739
so a 10 pack of registered letters.
283
00:08:33,750 --> 00:08:34,020
But no,
284
00:08:34,030 --> 00:08:35,219
it's a great point because yeah,
285
00:08:35,229 --> 00:08:37,679
when that does have to be open for whatever the reason and,
286
00:08:37,690 --> 00:08:38,460
and like you said,
287
00:08:38,469 --> 00:08:38,799
if,
288
00:08:38,809 --> 00:08:41,440
if the motive for doing that is to,
289
00:08:41,450 --> 00:08:41,510
um,
290
00:08:41,520 --> 00:08:43,059
sue or protect or,
291
00:08:43,070 --> 00:08:43,280
you know,
292
00:08:43,289 --> 00:08:43,739
from,
293
00:08:43,750 --> 00:08:44,700
not protect but to,
294
00:08:44,710 --> 00:08:45,270
to look at,
295
00:08:45,280 --> 00:08:45,500
ok,
296
00:08:45,510 --> 00:08:45,619
well,
297
00:08:45,630 --> 00:08:47,739
how can I sue somebody if they steal this?
298
00:08:48,020 --> 00:08:48,219
You know,
299
00:08:48,229 --> 00:08:50,359
to me it's a protection of an idea,
300
00:08:50,369 --> 00:08:50,510
right?
301
00:08:50,520 --> 00:08:55,309
It's an idea that you have that I have that whatever it is we want to protect that and,
302
00:08:55,320 --> 00:08:55,510
you know,
303
00:08:55,520 --> 00:08:56,030
we deal with that.
304
00:08:56,039 --> 00:08:56,330
In fact,
305
00:08:56,340 --> 00:08:58,289
one of the things I deal with the distributors for TV,
306
00:08:58,299 --> 00:08:59,090
programming,
307
00:08:59,380 --> 00:09:00,789
uh that I'm involved with is,
308
00:09:00,799 --> 00:09:00,929
well,
309
00:09:00,940 --> 00:09:02,270
who owns the content.
310
00:09:02,280 --> 00:09:05,030
That's always one of the first questions that distributors ask in TV,
311
00:09:05,039 --> 00:09:05,630
content.
312
00:09:05,640 --> 00:09:05,809
Well,
313
00:09:05,820 --> 00:09:06,390
who owns it?
314
00:09:06,400 --> 00:09:06,619
Well,
315
00:09:06,630 --> 00:09:07,429
when I can say I,
316
00:09:07,440 --> 00:09:08,330
I do,
317
00:09:08,340 --> 00:09:10,760
it opens up the doors a lot more versus,
318
00:09:10,770 --> 00:09:11,309
well,
319
00:09:11,320 --> 00:09:11,619
so,
320
00:09:11,630 --> 00:09:12,260
and so does,
321
00:09:12,270 --> 00:09:13,429
but I'm involved and,
322
00:09:13,440 --> 00:09:13,700
and,
323
00:09:13,710 --> 00:09:13,869
you know,
324
00:09:13,880 --> 00:09:15,590
it just kind of complicates and muddy the water.
325
00:09:15,599 --> 00:09:16,090
But then in,
326
00:09:16,169 --> 00:09:17,849
how do you protect that as well?
327
00:09:17,880 --> 00:09:20,219
Distributors want things that are nice and clean,
328
00:09:20,469 --> 00:09:20,719
you know,
329
00:09:20,729 --> 00:09:22,020
and the less people that are involved,
330
00:09:22,030 --> 00:09:23,469
the better if you want to distribute your,
331
00:09:23,479 --> 00:09:26,119
your movies or TV series or whatever or your book.
332
00:09:26,130 --> 00:09:26,239
Yeah,
333
00:09:26,250 --> 00:09:26,859
I mean,
334
00:09:26,869 --> 00:09:27,659
they want clean.
335
00:09:27,770 --> 00:09:28,809
Here's something you guys,
336
00:09:28,820 --> 00:09:29,869
you guys are hitting on.
337
00:09:29,880 --> 00:09:33,780
That's kind of kind of making me think is,
338
00:09:33,789 --> 00:09:33,940
you know,
339
00:09:33,950 --> 00:09:36,179
one of the other reasons you want,
340
00:09:36,190 --> 00:09:39,979
you want to get legal counsel on this and why you're intellectual property,
341
00:09:39,989 --> 00:09:41,380
we're talking about the idea.
342
00:09:41,390 --> 00:09:46,039
And I think what happens is right out of the gate when someone has an idea,
343
00:09:46,049 --> 00:09:46,640
they're like,
344
00:09:46,650 --> 00:09:46,659
oh,
345
00:09:46,669 --> 00:09:49,659
this would be a great movie or this would be a great,
346
00:09:49,669 --> 00:09:52,539
they're immediately thinking about the asset,
347
00:09:52,549 --> 00:09:53,239
right?
348
00:09:53,549 --> 00:10:00,140
And actually the value is in the idea and Steve taught me this and I'll tell you a story about that when we were in Los Angeles.
349
00:10:00,150 --> 00:10:00,640
So,
350
00:10:00,789 --> 00:10:04,059
um the idea that you have,
351
00:10:04,559 --> 00:10:06,000
if it's a good idea,
352
00:10:06,130 --> 00:10:09,479
it's going to create many assets over time.
353
00:10:09,849 --> 00:10:12,400
So one of the reasons to secure that IP to,
354
00:10:12,409 --> 00:10:18,700
to secure that idea is you don't know what this could become like in your mind,
355
00:10:18,710 --> 00:10:18,960
you're like,
356
00:10:18,969 --> 00:10:19,460
like you said,
357
00:10:19,469 --> 00:10:20,179
you're doing a book.
358
00:10:20,190 --> 00:10:20,679
So you do a,
359
00:10:20,690 --> 00:10:21,789
a book and in your mind,
360
00:10:21,799 --> 00:10:22,239
you're like,
361
00:10:22,250 --> 00:10:22,260
oh,
362
00:10:22,270 --> 00:10:22,500
you know,
363
00:10:22,510 --> 00:10:24,500
we're gonna create the book and I'll secure the book.
364
00:10:24,510 --> 00:10:27,530
But the ideas in that book may turn out to be many,
365
00:10:27,539 --> 00:10:27,789
many,
366
00:10:27,799 --> 00:10:28,989
many other things.
367
00:10:29,000 --> 00:10:30,400
So it's not just securing the book.
368
00:10:30,409 --> 00:10:30,880
It's really,
369
00:10:30,890 --> 00:10:32,864
it's securing the idea example,
370
00:10:32,875 --> 00:10:34,775
my from glory day's concept,
371
00:10:34,784 --> 00:10:37,445
it started as a book turned into a TV show.
372
00:10:37,544 --> 00:10:39,054
Now we're talking about expanding it.
373
00:10:39,065 --> 00:10:40,994
Not many other factors as well.
374
00:10:41,205 --> 00:10:42,275
Uh But what's interesting,
375
00:10:42,284 --> 00:10:45,104
what bill mentioned from his book was talking about the,
376
00:10:45,114 --> 00:10:46,215
the value of that,
377
00:10:46,224 --> 00:10:46,484
right?
378
00:10:46,494 --> 00:10:50,015
The value of the IP being part of the whole package,
379
00:10:50,025 --> 00:10:50,234
right?
380
00:10:50,244 --> 00:10:50,335
I mean,
381
00:10:50,344 --> 00:10:51,695
it's something I didn't think of before.
382
00:10:51,705 --> 00:10:51,924
It's like,
383
00:10:51,934 --> 00:10:52,174
oh yeah,
384
00:10:52,184 --> 00:10:56,299
that protection is very important because that's part of the value of it,
385
00:10:56,309 --> 00:10:56,900
by the way,
386
00:10:56,909 --> 00:10:58,760
what you're doing at all those pieces.
387
00:10:58,770 --> 00:11:03,500
Uh Joseph been calling that for a while with um Jeff Gomez trans media.
388
00:11:03,700 --> 00:11:04,059
I mean,
389
00:11:04,070 --> 00:11:04,299
you're,
390
00:11:04,309 --> 00:11:06,900
you're telling your story in different types of media,
391
00:11:06,909 --> 00:11:08,400
that's what trans media means.
392
00:11:08,409 --> 00:11:08,780
So,
393
00:11:08,830 --> 00:11:14,229
so that's why you have to protect all of these different things in different channels that they are actually gonna be delivered in.
394
00:11:14,340 --> 00:11:14,820
Right.
395
00:11:14,869 --> 00:11:15,559
Absolutely.
396
00:11:15,570 --> 00:11:16,840
Because they could be a game,
397
00:11:16,849 --> 00:11:18,190
they could be a book,
398
00:11:18,450 --> 00:11:19,630
they could be a movie,
399
00:11:19,640 --> 00:11:20,450
could be the metaphors.
400
00:11:21,630 --> 00:11:21,830
Oh yeah,
401
00:11:22,090 --> 00:11:22,229
yeah,
402
00:11:22,239 --> 00:11:24,359
we should do a podcast on that.
403
00:11:24,799 --> 00:11:24,809
Oh,
404
00:11:24,820 --> 00:11:25,280
wait,
405
00:11:25,299 --> 00:11:26,570
this is a really bad memory.
406
00:11:28,820 --> 00:11:29,859
Our next episode.
407
00:11:29,900 --> 00:11:30,309
Oh Wait,
408
00:11:30,320 --> 00:11:31,559
that was episode number one.
409
00:11:31,599 --> 00:11:32,539
That's number one,
410
00:11:32,549 --> 00:11:33,539
number one with the bullet.
411
00:11:33,729 --> 00:11:34,729
Uh So the story,
412
00:11:34,739 --> 00:11:37,950
a story I was gonna tell about uh securing your IP.
413
00:11:37,960 --> 00:11:42,500
So uh Steve took me out to L A and we're doing,
414
00:11:42,510 --> 00:11:42,739
you know,
415
00:11:42,750 --> 00:11:45,140
the whole folk tellers universe and,
416
00:11:45,150 --> 00:11:53,169
and he sets up all these meetings in L A and so we're in this um rented uh L A bungalow and it was an Airbnb.
417
00:11:53,369 --> 00:11:53,789
Yeah,
418
00:11:53,799 --> 00:11:58,460
it was and I'm gonna do like a door song because because now,
419
00:11:58,469 --> 00:12:01,330
but I was with Little Steve in a Hollywood bungalow.
420
00:12:01,479 --> 00:12:06,039
Um But uh I think you're the one with the God that I don't know.
421
00:12:06,049 --> 00:12:06,489
But anyway,
422
00:12:06,539 --> 00:12:12,059
so someone will know the lyrics to L A woman of which I'm referring.
423
00:12:12,179 --> 00:12:12,630
Thank you.
424
00:12:12,640 --> 00:12:12,789
See,
425
00:12:12,799 --> 00:12:13,799
Bill's nodding his head.
426
00:12:13,809 --> 00:12:14,219
Thank you,
427
00:12:14,229 --> 00:12:14,700
Bill.
428
00:12:14,710 --> 00:12:16,119
Even though it's a token nod,
429
00:12:16,309 --> 00:12:20,729
that'd be a story that you started about an hour ago.
430
00:12:20,750 --> 00:12:21,820
You started a story about an hour,
431
00:12:22,190 --> 00:12:22,869
an hour ago.
432
00:12:24,190 --> 00:12:25,179
So here we go.
433
00:12:25,190 --> 00:12:25,650
Come on.
434
00:12:25,659 --> 00:12:26,140
All right.
435
00:12:26,150 --> 00:12:27,049
Uh Bill,
436
00:12:27,059 --> 00:12:29,239
can you patch in L A woman?
437
00:12:29,460 --> 00:12:30,640
Uh On this part,
438
00:12:31,450 --> 00:12:33,049
I don't have the rights.
439
00:12:33,059 --> 00:12:33,700
It's protected.
440
00:12:33,710 --> 00:12:34,659
We'll talk about that,
441
00:12:34,770 --> 00:12:35,440
we'll talk about that,
442
00:12:36,729 --> 00:12:39,020
someone secured those rights on it.
443
00:12:39,330 --> 00:12:40,880
So we're in L A and,
444
00:12:40,890 --> 00:12:43,280
and we're in the bungalow for our means.
445
00:12:43,289 --> 00:12:44,940
It's the morning and Steve,
446
00:12:44,950 --> 00:12:45,119
you know,
447
00:12:45,130 --> 00:12:47,679
Mr Digital social media guy and he goes,
448
00:12:47,690 --> 00:12:48,109
dude,
449
00:12:48,119 --> 00:12:49,510
like we got to lock down this,
450
00:12:49,520 --> 00:12:51,520
I'm not a social media guy.
451
00:12:51,909 --> 00:12:52,460
Ok?
452
00:12:52,469 --> 00:12:53,099
He's a,
453
00:12:53,690 --> 00:12:55,200
he's a social media,
454
00:12:56,859 --> 00:12:58,570
he's my social media guy.
455
00:12:58,880 --> 00:12:59,169
Now.
456
00:12:59,520 --> 00:12:59,869
You're,
457
00:12:59,880 --> 00:13:00,799
you're more than that,
458
00:13:00,809 --> 00:13:01,989
you're just my guy.
459
00:13:02,919 --> 00:13:02,950
Oh,
460
00:13:02,979 --> 00:13:03,830
you're just my guy.
461
00:13:03,840 --> 00:13:04,190
Ok?
462
00:13:04,549 --> 00:13:06,869
I don't think this is that type of offense.
463
00:13:07,169 --> 00:13:07,619
Well,
464
00:13:07,630 --> 00:13:10,409
he's got that half eaten banana shirt on.
465
00:13:10,469 --> 00:13:10,669
Right.
466
00:13:10,679 --> 00:13:11,049
That's right.
467
00:13:11,159 --> 00:13:11,260
Yeah,
468
00:13:11,270 --> 00:13:12,969
I got a pink shirt with John.
469
00:13:13,200 --> 00:13:16,739
We did open up this session with uh ladies and gentlemen and everybody in between.
470
00:13:16,750 --> 00:13:18,609
So I guess right off the bat,
471
00:13:18,619 --> 00:13:19,070
but go ahead,
472
00:13:19,950 --> 00:13:21,900
I'm Juan today.
473
00:13:21,909 --> 00:13:22,640
So all right,
474
00:13:22,650 --> 00:13:23,520
back to the story.
475
00:13:23,530 --> 00:13:24,500
Back to the story.
476
00:13:24,510 --> 00:13:25,359
So in this episode,
477
00:13:25,840 --> 00:13:30,890
um so we're in L A where it's in the morning before our meetings and he's like,
478
00:13:30,900 --> 00:13:33,380
you gotta lock all this social media down,
479
00:13:33,390 --> 00:13:36,890
you gotta lock down the folk teller's name across media and he's going,
480
00:13:36,900 --> 00:13:38,909
he's like this is available,
481
00:13:39,109 --> 00:13:40,349
it's available on Twitter,
482
00:13:40,520 --> 00:13:42,190
it's available on Instagram and I'm like,
483
00:13:42,479 --> 00:13:43,280
OK,
484
00:13:43,289 --> 00:13:43,630
he goes,
485
00:13:43,640 --> 00:13:43,880
we could,
486
00:13:44,289 --> 00:13:44,640
he goes,
487
00:13:44,650 --> 00:13:47,280
you don't understand and so I'll like pass it.
488
00:13:47,289 --> 00:13:47,780
Why is,
489
00:13:47,789 --> 00:13:49,059
why was that a big deal?
490
00:13:49,520 --> 00:13:59,530
Because all of those different social media platforms or channels for you to be able to send content out to and every single one of them has like a vanity name to it.
491
00:13:59,909 --> 00:14:02,549
And if you can't lock that down right across the board,
492
00:14:02,559 --> 00:14:03,770
then someone else will.
493
00:14:03,780 --> 00:14:04,409
So,
494
00:14:04,570 --> 00:14:04,869
you know,
495
00:14:04,880 --> 00:14:05,010
and you,
496
00:14:05,020 --> 00:14:07,309
and that's not even about having a trademark on that.
497
00:14:07,320 --> 00:14:07,609
So say,
498
00:14:07,619 --> 00:14:08,030
for example,
499
00:14:08,039 --> 00:14:09,750
you have the trademark on folk tellers,
500
00:14:09,760 --> 00:14:10,349
which we do,
501
00:14:10,359 --> 00:14:10,859
right?
502
00:14:11,119 --> 00:14:17,549
But you don't have the Instagram folk tellers and some so someone can literally start pumping stuff out to that one and you know,
503
00:14:17,770 --> 00:14:17,979
yeah,
504
00:14:17,989 --> 00:14:20,380
you could probably send them a cease and desist letter,
505
00:14:20,390 --> 00:14:22,119
but then that becomes expensive to do that.
506
00:14:22,130 --> 00:14:22,340
Sure.
507
00:14:22,349 --> 00:14:23,400
So if you're smart,
508
00:14:23,609 --> 00:14:26,059
you when you come up with the name and you do a patent,
509
00:14:26,070 --> 00:14:31,150
you do a uh copyright or I should say a trademark or service mark search,
510
00:14:31,349 --> 00:14:37,070
you should look right across the board at all of the different social channels to see whether you can lock it up.
511
00:14:37,260 --> 00:14:38,200
And by the way,
512
00:14:38,210 --> 00:14:40,500
for people that are into this,
513
00:14:40,580 --> 00:14:43,099
this is the start of your platform,
514
00:14:43,109 --> 00:14:47,900
this is creating your digital footprint and um and that's what I advise.
515
00:14:47,919 --> 00:14:49,229
That's a great point because,
516
00:14:49,239 --> 00:14:49,440
you know,
517
00:14:49,450 --> 00:14:50,039
years ago,
518
00:14:50,049 --> 00:14:51,080
we didn't have to worry about that,
519
00:14:51,090 --> 00:14:51,210
right?
520
00:14:51,219 --> 00:14:52,640
If we had a copyright for a book,
521
00:14:52,650 --> 00:14:53,320
that was the book,
522
00:14:53,330 --> 00:14:53,520
right?
523
00:14:53,530 --> 00:14:54,640
But now you're saying,
524
00:14:54,650 --> 00:14:56,400
and I agree that that boy,
525
00:14:56,409 --> 00:14:59,440
you gotta make sure you lock down all the social media avenues,
526
00:14:59,450 --> 00:14:59,679
right?
527
00:14:59,690 --> 00:14:59,869
I mean,
528
00:14:59,880 --> 00:15:00,340
all of them,
529
00:15:00,349 --> 00:15:00,570
right?
530
00:15:00,580 --> 00:15:00,710
I mean,
531
00:15:00,719 --> 00:15:04,750
you want to get as many as you can because if you don't control your narrative and your story,
532
00:15:04,760 --> 00:15:05,580
someone else will.
533
00:15:05,590 --> 00:15:09,390
That's folk tellers has been talking about for many,
534
00:15:09,400 --> 00:15:10,109
many years.
535
00:15:10,119 --> 00:15:10,760
Well,
536
00:15:10,770 --> 00:15:12,380
so in Bill's book,
537
00:15:12,390 --> 00:15:12,559
I mean,
538
00:15:12,570 --> 00:15:13,679
his whole premise is,
539
00:15:13,690 --> 00:15:13,940
you know,
540
00:15:13,950 --> 00:15:14,169
the,
541
00:15:14,179 --> 00:15:15,289
the three steps.
542
00:15:15,299 --> 00:15:16,049
It's the,
543
00:15:16,250 --> 00:15:17,169
the research,
544
00:15:17,179 --> 00:15:22,409
the collect and protect and um I don't think what most people realize because all this is hidden,
545
00:15:22,419 --> 00:15:24,419
like no one's gonna tell you this.
546
00:15:24,429 --> 00:15:24,570
I mean,
547
00:15:24,580 --> 00:15:25,049
you have to,
548
00:15:25,059 --> 00:15:26,330
you have to go find,
549
00:15:26,340 --> 00:15:27,609
you have to talk to like,
550
00:15:27,619 --> 00:15:27,719
yeah,
551
00:15:27,729 --> 00:15:27,979
I mean,
552
00:15:27,989 --> 00:15:29,270
we are not lawyers,
553
00:15:29,280 --> 00:15:31,229
we're not providing legal counsel.
554
00:15:31,239 --> 00:15:34,270
We highly recommend that you find someone who is an expert,
555
00:15:34,354 --> 00:15:40,265
intellectual property and have this conversation with them when you think that you have a great idea.
556
00:15:40,275 --> 00:15:40,705
Um,
557
00:15:40,715 --> 00:15:42,604
it costs money,
558
00:15:42,655 --> 00:15:43,945
it costs time.
559
00:15:44,005 --> 00:15:44,445
But,
560
00:15:44,455 --> 00:15:44,465
uh,
561
00:15:44,474 --> 00:15:45,565
we've all done it and,
562
00:15:45,575 --> 00:15:46,044
and,
563
00:15:46,054 --> 00:15:46,065
uh,
564
00:15:46,075 --> 00:15:46,684
it's,
565
00:15:46,695 --> 00:15:46,765
you know,
566
00:15:46,775 --> 00:15:47,734
it's well worth it.
567
00:15:47,744 --> 00:15:48,835
It's well worth.
568
00:15:48,844 --> 00:15:49,344
Um,
569
00:15:49,765 --> 00:15:51,445
if you think you've got a good enough idea,
570
00:15:51,455 --> 00:15:54,085
it's well worth putting money down because even when Steve,
571
00:15:54,094 --> 00:15:54,445
like,
572
00:15:54,575 --> 00:15:56,015
unfortunately,
573
00:15:56,025 --> 00:15:56,155
um,
574
00:15:56,164 --> 00:16:00,784
those platforms weren't locked down and they didn't cost us a ton of money.
575
00:16:01,239 --> 00:16:01,609
But,
576
00:16:01,619 --> 00:16:01,809
like,
577
00:16:01,820 --> 00:16:01,890
yeah,
578
00:16:01,900 --> 00:16:02,090
I mean,
579
00:16:02,099 --> 00:16:02,900
people make a living.
580
00:16:02,909 --> 00:16:04,210
You haven't got my bill yet.
581
00:16:05,630 --> 00:16:06,200
Well,
582
00:16:06,210 --> 00:16:06,359
we're,
583
00:16:06,369 --> 00:16:07,039
well,
584
00:16:07,049 --> 00:16:07,200
well,
585
00:16:07,210 --> 00:16:08,039
the bigger you are,
586
00:16:08,049 --> 00:16:09,659
the more of a target you are too though,
587
00:16:09,669 --> 00:16:09,969
right?
588
00:16:09,979 --> 00:16:13,469
If you can get it before you become a big fish and that's the thing.
589
00:16:13,500 --> 00:16:15,219
And the only thing is you don't know what he,
590
00:16:15,229 --> 00:16:15,960
he said it before.
591
00:16:15,969 --> 00:16:17,760
You don't know what something can become.
592
00:16:17,770 --> 00:16:19,710
You don't know what this idea,
593
00:16:19,719 --> 00:16:19,859
uh,
594
00:16:19,869 --> 00:16:21,039
in patents they call it.
595
00:16:21,049 --> 00:16:21,080
Well,
596
00:16:21,090 --> 00:16:22,219
everything it's called art.
597
00:16:22,229 --> 00:16:22,659
Art,
598
00:16:22,669 --> 00:16:23,099
right?
599
00:16:23,539 --> 00:16:24,419
And you don't know where,
600
00:16:24,429 --> 00:16:25,869
where that's going to be in the future.
601
00:16:25,880 --> 00:16:34,179
So the idea is to make sure that you're controlling all of the different platforms and all the names and the narrative just get starts to get published out there.
602
00:16:34,190 --> 00:16:35,919
And all of a sudden you've got a huge,
603
00:16:35,960 --> 00:16:36,179
you know,
604
00:16:36,190 --> 00:16:40,679
footprint of uh of content and that's where the value is of what you're doing,
605
00:16:40,690 --> 00:16:43,559
especially when you're doing things digitally these days.
606
00:16:43,750 --> 00:16:45,679
It's like people look at something digital and they go,
607
00:16:46,080 --> 00:16:46,229
well,
608
00:16:46,239 --> 00:16:47,919
I don't see a building or,
609
00:16:47,929 --> 00:16:48,190
you know,
610
00:16:48,200 --> 00:16:49,119
I don't see a car,
611
00:16:49,130 --> 00:16:50,780
I don't see any physical assets.
612
00:16:51,210 --> 00:16:52,340
But meanwhile,
613
00:16:52,599 --> 00:16:54,099
in the electron world,
614
00:16:54,109 --> 00:16:55,219
it's enormous.
615
00:16:55,229 --> 00:16:55,859
I mean,
616
00:16:55,869 --> 00:16:56,200
this,
617
00:16:56,210 --> 00:16:56,500
you know,
618
00:16:56,510 --> 00:16:59,969
how much content and how much things that you built and it's as,
619
00:16:59,979 --> 00:17:04,150
and as it's as valuable as regular buildings,
620
00:17:04,160 --> 00:17:06,630
if not more because some of the interesting things are,
621
00:17:06,640 --> 00:17:08,849
I can go back to ideas and patterns that I had,
622
00:17:08,969 --> 00:17:09,180
you know,
623
00:17:09,189 --> 00:17:09,550
10,
624
00:17:09,560 --> 00:17:10,780
15 years ago,
625
00:17:10,790 --> 00:17:14,319
open up those files and they haven't deteriorated.
626
00:17:14,640 --> 00:17:17,729
It looks exactly the same as the day that I left that file.
627
00:17:17,739 --> 00:17:18,969
But if I had a building,
628
00:17:18,979 --> 00:17:20,449
that building is not gonna look like that.
629
00:17:20,459 --> 00:17:28,410
I got a question about that Steve because is it only valuable based on the number of impressions I would gain in that area or is it valuable before that?
630
00:17:28,420 --> 00:17:28,689
I mean,
631
00:17:28,699 --> 00:17:29,849
because you,
632
00:17:29,859 --> 00:17:29,890
you,
633
00:17:29,900 --> 00:17:34,119
you're locking this down with the idea that it is gonna become valuable.
634
00:17:34,130 --> 00:17:37,619
But is the value only in impressions that,
635
00:17:37,630 --> 00:17:38,020
of course,
636
00:17:38,030 --> 00:17:41,410
so you can answer this multi tiered question.
637
00:17:41,479 --> 00:17:42,229
So there's,
638
00:17:42,410 --> 00:17:42,930
uh,
639
00:17:43,310 --> 00:17:49,180
there's companies that make a living off of just buying URL S and then reselling them,
640
00:17:49,189 --> 00:17:49,750
they sit,
641
00:17:49,760 --> 00:17:50,040
you know,
642
00:17:50,050 --> 00:17:50,339
they,
643
00:17:50,349 --> 00:17:59,229
they buy hundreds of thousands of URL S and they just wait to see if those names hit or someone and then it's like anywhere between,
644
00:17:59,239 --> 00:17:59,369
you know,
645
00:17:59,380 --> 00:18:02,189
sell them to you for 20 bucks or 20,000,
646
00:18:02,780 --> 00:18:04,560
it's like scalping concert tickets.
647
00:18:04,989 --> 00:18:05,099
Yeah,
648
00:18:05,209 --> 00:18:05,680
that's what it is,
649
00:18:05,979 --> 00:18:08,040
is Joseph Bastian dot com right now.
650
00:18:08,050 --> 00:18:09,839
I wonder that's why uh we do.
651
00:18:10,540 --> 00:18:10,890
Yes,
652
00:18:10,930 --> 00:18:11,420
you got that.
653
00:18:12,579 --> 00:18:17,959
He got me that for Christmas to put a little digital bow on it for him.
654
00:18:18,339 --> 00:18:19,189
So this,
655
00:18:19,199 --> 00:18:19,829
so,
656
00:18:19,939 --> 00:18:20,689
so to answer,
657
00:18:20,699 --> 00:18:21,050
you know,
658
00:18:21,060 --> 00:18:24,310
so there's Kurt's question and uh you know what you're touching on and you've,
659
00:18:24,339 --> 00:18:25,670
you've talked about it a little bit,
660
00:18:25,680 --> 00:18:26,619
I think already,
661
00:18:26,630 --> 00:18:27,589
but I think it's,
662
00:18:27,599 --> 00:18:29,569
it bears repeating,
663
00:18:29,665 --> 00:18:32,244
talking in depth around protecting your story.
664
00:18:32,324 --> 00:18:32,594
You know,
665
00:18:32,604 --> 00:18:34,795
you came up with the model.
666
00:18:34,805 --> 00:18:36,194
Um CF I,
667
00:18:36,214 --> 00:18:36,814
so what,
668
00:18:36,824 --> 00:18:37,234
what's,
669
00:18:37,244 --> 00:18:38,165
what's CF I?
670
00:18:38,175 --> 00:18:42,094
And how does that impact protecting your story and communicating your story?
671
00:18:42,104 --> 00:18:42,275
Well,
672
00:18:42,285 --> 00:18:42,415
II,
673
00:18:42,425 --> 00:18:44,395
I mentioned that in the previous podcast,
674
00:18:44,405 --> 00:18:45,734
so I don't want to get into the detail,
675
00:18:45,744 --> 00:18:46,675
but just CF I,
676
00:18:46,694 --> 00:18:47,665
but it's content,
677
00:18:47,675 --> 00:18:48,814
frequency and influence,
678
00:18:49,224 --> 00:18:50,275
you gotta have content,
679
00:18:50,285 --> 00:18:51,135
which is your story,
680
00:18:51,420 --> 00:18:53,310
you have to have frequency,
681
00:18:53,319 --> 00:18:55,930
which is all those channels that we were just talking about.
682
00:18:55,939 --> 00:18:59,060
Like placing content into them on a regular basis.
683
00:18:59,319 --> 00:19:04,369
And a cadence where people know that the content is coming just like this podcast,
684
00:19:04,380 --> 00:19:05,270
people are gonna go,
685
00:19:05,280 --> 00:19:05,660
hey,
686
00:19:05,670 --> 00:19:07,390
there's a podcast coming next Tuesday again.
687
00:19:07,400 --> 00:19:08,569
And you're telling people that.
688
00:19:08,579 --> 00:19:12,140
So then they start to expect it when you just drop off or you're,
689
00:19:12,150 --> 00:19:12,430
you know,
690
00:19:12,439 --> 00:19:13,810
you're not sending content,
691
00:19:13,819 --> 00:19:14,989
people aren't gonna follow you.
692
00:19:15,000 --> 00:19:15,189
That's,
693
00:19:15,199 --> 00:19:18,250
that's how you get a following because they expect things to be sent to you.
694
00:19:18,530 --> 00:19:26,060
And then the I obviously is the influence side and that's where you actually get people of influence to help you expand whatever your product is or,
695
00:19:26,069 --> 00:19:29,699
or your service or um or your music or whatever you're doing.
696
00:19:30,130 --> 00:19:30,699
So,
697
00:19:30,709 --> 00:19:33,040
so what risk would be we be running?
698
00:19:33,050 --> 00:19:33,900
So we went,
699
00:19:33,910 --> 00:19:34,170
you know,
700
00:19:34,180 --> 00:19:34,660
early on,
701
00:19:34,670 --> 00:19:41,300
we spent the money and the time to uh uh trademark uh folk tellers and to,
702
00:19:41,500 --> 00:19:41,739
you know,
703
00:19:41,750 --> 00:19:43,469
create our brand and to do all the,
704
00:19:43,479 --> 00:19:43,670
you know,
705
00:19:43,680 --> 00:19:44,390
do all the,
706
00:19:44,400 --> 00:19:46,030
the work that we needed to do.
707
00:19:46,040 --> 00:19:47,150
What if we wouldn't have done that?
708
00:19:47,160 --> 00:19:47,369
Where,
709
00:19:47,380 --> 00:19:48,640
where would we be now?
710
00:19:48,650 --> 00:19:49,869
Like if we had this podcast,
711
00:19:49,880 --> 00:19:50,229
what,
712
00:19:50,239 --> 00:19:50,729
where would,
713
00:19:50,739 --> 00:19:51,829
where would our risks be?
714
00:19:51,959 --> 00:19:52,280
Well,
715
00:19:52,290 --> 00:19:56,420
someday an accountant is gonna take all of your assets and they're gonna apply value to it.
716
00:19:56,569 --> 00:20:00,859
And every one of these pieces that you own has a value to it.
717
00:20:01,089 --> 00:20:02,229
So people just think that,
718
00:20:02,239 --> 00:20:02,319
oh,
719
00:20:02,329 --> 00:20:04,609
it's just physical assets that have value it,
720
00:20:04,619 --> 00:20:05,500
isn't it?
721
00:20:05,510 --> 00:20:05,599
So,
722
00:20:05,609 --> 00:20:08,140
this whole digital world has just as much value,
723
00:20:08,150 --> 00:20:09,910
if not more than,
724
00:20:09,920 --> 00:20:11,650
than what the physical world does.
725
00:20:11,900 --> 00:20:12,589
And,
726
00:20:12,599 --> 00:20:12,619
um,
727
00:20:12,630 --> 00:20:15,810
and to not to not understand that as far as a business,
728
00:20:16,040 --> 00:20:16,650
you know,
729
00:20:16,660 --> 00:20:17,189
you know,
730
00:20:17,199 --> 00:20:19,859
in this era would be very foolish.
731
00:20:19,869 --> 00:20:20,300
But is it,
732
00:20:20,310 --> 00:20:21,780
is it value kind of like a house?
733
00:20:21,790 --> 00:20:23,180
I could have a value in my house,
734
00:20:23,189 --> 00:20:24,300
but unless I sell it,
735
00:20:24,310 --> 00:20:25,540
it doesn't matter.
736
00:20:25,989 --> 00:20:27,599
But is it kind of that way as well?
737
00:20:27,609 --> 00:20:28,579
What you're describing?
738
00:20:28,589 --> 00:20:28,689
Yeah,
739
00:20:28,699 --> 00:20:28,939
I mean,
740
00:20:28,949 --> 00:20:30,810
anything is worth what someone's gonna pay,
741
00:20:30,819 --> 00:20:31,099
right?
742
00:20:31,109 --> 00:20:31,280
I mean,
743
00:20:31,290 --> 00:20:31,550
that's,
744
00:20:31,560 --> 00:20:33,160
that's what it is but there,
745
00:20:33,170 --> 00:20:34,469
there's comparatives.
746
00:20:34,479 --> 00:20:34,760
I mean,
747
00:20:34,770 --> 00:20:36,000
when you're dealing with houses,
748
00:20:36,010 --> 00:20:37,160
you're someone's gonna,
749
00:20:37,170 --> 00:20:39,479
you're gonna compare it with the other houses on your street.
750
00:20:39,530 --> 00:20:39,939
Well,
751
00:20:39,949 --> 00:20:44,479
you're gonna compare it with other domain names that have X number of traffic or you know,
752
00:20:44,489 --> 00:20:48,920
where you are on the Alexa rating or you know how many Twitter followers you have and so on and so on.
753
00:20:48,930 --> 00:20:49,109
I mean,
754
00:20:49,119 --> 00:20:49,410
that's,
755
00:20:49,550 --> 00:20:50,079
that's,
756
00:20:50,640 --> 00:20:51,180
that's,
757
00:20:51,910 --> 00:20:51,989
yeah,
758
00:20:52,000 --> 00:20:52,930
it's still important.
759
00:20:53,000 --> 00:20:53,260
Now,
760
00:20:53,270 --> 00:20:53,780
obviously,
761
00:20:53,790 --> 00:20:54,890
if you're selling products,
762
00:20:54,900 --> 00:20:57,439
your products and services have to be good too.
763
00:20:57,449 --> 00:20:58,010
That's the,
764
00:20:58,020 --> 00:21:01,849
the sea could be replaced with products as well,
765
00:21:01,859 --> 00:21:02,969
not just content,
766
00:21:02,979 --> 00:21:03,910
it could be products,
767
00:21:03,920 --> 00:21:06,430
frequency and influence and we just came up with that today.
768
00:21:07,310 --> 00:21:08,209
But uh but yeah,
769
00:21:08,219 --> 00:21:10,380
I write that down but I have a question.
770
00:21:10,390 --> 00:21:12,530
Uh Bill talked about the three aspects in his book,
771
00:21:12,540 --> 00:21:12,949
right?
772
00:21:12,959 --> 00:21:13,900
The research,
773
00:21:13,910 --> 00:21:14,550
the second one.
774
00:21:14,560 --> 00:21:15,229
What does that mean,
775
00:21:15,239 --> 00:21:17,339
exactly for the second aspect of that.
776
00:21:17,609 --> 00:21:18,760
So to collect.
777
00:21:18,770 --> 00:21:18,869
I know.
778
00:21:19,670 --> 00:21:19,839
Yeah.
779
00:21:19,849 --> 00:21:20,310
So,
780
00:21:20,319 --> 00:21:23,390
so you actually have to collect your assets and,
781
00:21:23,400 --> 00:21:23,699
and,
782
00:21:23,709 --> 00:21:27,000
and it's looking at what Steve said you have,
783
00:21:27,010 --> 00:21:27,839
you have,
784
00:21:27,859 --> 00:21:27,869
uh,
785
00:21:28,369 --> 00:21:35,040
an auditor or an accountant come in and it's not just physical assets like buildings and books,
786
00:21:35,050 --> 00:21:35,619
it's also,
787
00:21:35,630 --> 00:21:35,780
you know,
788
00:21:35,790 --> 00:21:36,839
digital and,
789
00:21:36,849 --> 00:21:39,739
and it's everything and then putting a value to it.
790
00:21:39,750 --> 00:21:40,319
So you gotta,
791
00:21:40,329 --> 00:21:41,800
you gotta collect it and say what,
792
00:21:41,810 --> 00:21:47,839
what really is the scope and reach of our intellectual property and to have someone come in,
793
00:21:47,849 --> 00:21:49,619
who knows how to do that?
794
00:21:49,859 --> 00:21:53,219
Because you wouldn't know like most that's the thing is all this stuff is hidden.
795
00:21:53,510 --> 00:21:54,920
Like as a business owner,
796
00:21:54,930 --> 00:21:55,280
you,
797
00:21:55,290 --> 00:21:56,750
you would not intuitively,
798
00:21:57,569 --> 00:21:57,729
you know,
799
00:21:57,739 --> 00:21:58,199
any of this,
800
00:21:59,099 --> 00:21:59,900
like he said,
801
00:21:59,910 --> 00:22:03,349
like uh the Kieler Elf was worth $1.5 billion.
802
00:22:03,359 --> 00:22:04,319
Just the elf,
803
00:22:04,959 --> 00:22:06,079
just the image of,
804
00:22:06,089 --> 00:22:07,719
of uh what's his name?
805
00:22:08,239 --> 00:22:09,079
I'm trying to blank.
806
00:22:10,390 --> 00:22:10,400
Oh,
807
00:22:10,410 --> 00:22:10,619
it's,
808
00:22:12,140 --> 00:22:16,760
we have to ask Bill would do you know the name of the Ke Ernie?
809
00:22:17,229 --> 00:22:17,609
Ernie?
810
00:22:17,619 --> 00:22:18,420
Boom.
811
00:22:18,430 --> 00:22:18,790
Thank you.
812
00:22:18,800 --> 00:22:19,680
That's my brother's name.
813
00:22:19,689 --> 00:22:20,579
So uh yeah,
814
00:22:20,589 --> 00:22:21,410
it's Ernie the Elf.
815
00:22:21,560 --> 00:22:22,359
He an E as well.
816
00:22:22,750 --> 00:22:25,579
Uh Some days he,
817
00:22:25,589 --> 00:22:25,699
yeah,
818
00:22:25,709 --> 00:22:26,380
he could be,
819
00:22:26,390 --> 00:22:31,530
he could be impish like Steve Steve's impish sometimes he's,
820
00:22:33,050 --> 00:22:34,160
you're Elvin,
821
00:22:34,510 --> 00:22:35,000
impish,
822
00:22:35,369 --> 00:22:36,280
sprightly.
823
00:22:37,300 --> 00:22:38,170
All right.
824
00:22:38,380 --> 00:22:39,000
All right,
825
00:22:39,010 --> 00:22:41,319
I'll stop my um What was your question?
826
00:22:42,250 --> 00:22:44,300
You answer the question about the collection.
827
00:22:46,650 --> 00:22:46,819
So,
828
00:22:46,829 --> 00:22:47,890
collecting is,
829
00:22:47,900 --> 00:22:48,359
is,
830
00:22:48,369 --> 00:22:51,219
is gathering all of your IP and assume,
831
00:22:51,500 --> 00:22:52,089
and again,
832
00:22:52,099 --> 00:22:53,420
you don't assume that,
833
00:22:53,430 --> 00:22:57,920
you know what all your IP is until you actually go through the exercise with the professional.
834
00:22:57,930 --> 00:22:59,250
Can I give you a story on that one?
835
00:22:59,530 --> 00:23:01,410
You absolutely may give us a story.
836
00:23:01,520 --> 00:23:01,810
So,
837
00:23:01,819 --> 00:23:01,829
I,
838
00:23:01,839 --> 00:23:02,109
you know,
839
00:23:02,119 --> 00:23:03,239
I worked with the,
840
00:23:03,250 --> 00:23:03,439
um,
841
00:23:03,449 --> 00:23:05,739
with the Zappa State for a long time with,
842
00:23:05,819 --> 00:23:05,869
ah,
843
00:23:06,209 --> 00:23:07,869
Zappa Frank Zappa's son.
844
00:23:08,250 --> 00:23:08,680
I mean,
845
00:23:08,689 --> 00:23:09,060
he,
846
00:23:09,119 --> 00:23:16,079
ahmed had to take the estate when his mother passed away and take all of the analog assets that were in their vault that they had.
847
00:23:16,089 --> 00:23:21,680
And there was a lot and he had to have them all converted over to digital to make sure they preserved because a lot of them were actually,
848
00:23:21,689 --> 00:23:22,140
you know,
849
00:23:22,349 --> 00:23:25,959
degrading music stats and records and tapes or whatever.
850
00:23:26,270 --> 00:23:26,880
And,
851
00:23:26,890 --> 00:23:27,060
um,
852
00:23:27,489 --> 00:23:28,400
that is,
853
00:23:28,930 --> 00:23:29,219
you know,
854
00:23:29,229 --> 00:23:30,069
to them,
855
00:23:30,079 --> 00:23:31,400
that's the value,
856
00:23:31,410 --> 00:23:34,180
that's everything that they needed to be able to,
857
00:23:34,329 --> 00:23:34,920
you know,
858
00:23:34,930 --> 00:23:35,180
you know,
859
00:23:35,189 --> 00:23:36,410
give that to an account and say,
860
00:23:36,420 --> 00:23:37,040
here,
861
00:23:37,050 --> 00:23:37,560
you know,
862
00:23:37,719 --> 00:23:38,439
put,
863
00:23:38,449 --> 00:23:39,560
put a value to this,
864
00:23:39,569 --> 00:23:40,380
let us know,
865
00:23:40,550 --> 00:23:43,219
you know what this is worth and all of these,
866
00:23:43,229 --> 00:23:43,239
uh,
867
00:23:43,250 --> 00:23:43,459
you know,
868
00:23:43,469 --> 00:23:45,530
these music estates have to do that.
869
00:23:45,770 --> 00:23:46,260
Now,
870
00:23:47,089 --> 00:23:57,140
even Prince had apparently had a huge library of assets and all of those would have been done would have been recorded analog originally and would all had to be converted into digital.
871
00:23:57,369 --> 00:23:57,810
Um,
872
00:23:57,819 --> 00:23:59,939
I hear still to this day that people,
873
00:24:00,140 --> 00:24:00,150
uh,
874
00:24:00,160 --> 00:24:04,500
the best medium for recording or,
875
00:24:04,510 --> 00:24:04,810
you know,
876
00:24:04,819 --> 00:24:09,380
keeping music and data is C DS still because they,
877
00:24:09,390 --> 00:24:10,140
they don't,
878
00:24:10,150 --> 00:24:10,719
they don't,
879
00:24:10,829 --> 00:24:11,900
they don't degrade,
880
00:24:12,189 --> 00:24:12,719
um,
881
00:24:12,969 --> 00:24:14,329
anything that's tape and,
882
00:24:14,339 --> 00:24:14,589
you know,
883
00:24:14,599 --> 00:24:16,619
and that type of thing does degrade.
884
00:24:16,630 --> 00:24:18,300
So if you're gonna back something up,
885
00:24:18,310 --> 00:24:19,380
burn it onto a CD,
886
00:24:19,390 --> 00:24:22,000
because a CD will be around in many,
887
00:24:22,010 --> 00:24:24,900
many years and you can find a CD player still.
888
00:24:24,910 --> 00:24:27,219
There'll only be two things around in 100 years.
889
00:24:27,229 --> 00:24:31,319
Golf balls and C DS and cockroaches and cockroaches.
890
00:24:32,270 --> 00:24:32,469
Well,
891
00:24:32,479 --> 00:24:35,400
let me tell you one of my biggest mistake that I made uh from my,
892
00:24:35,410 --> 00:24:36,800
my first book from glory day.
893
00:24:37,369 --> 00:24:40,339
I remember the publisher came in after a certain time.
894
00:24:40,349 --> 00:24:41,760
Every book has a shelf life,
895
00:24:41,770 --> 00:24:42,099
right?
896
00:24:42,219 --> 00:24:43,699
And the publisher came to me and said,
897
00:24:43,709 --> 00:24:43,859
well,
898
00:24:43,869 --> 00:24:45,989
do you want to buy your original plates?
899
00:24:46,000 --> 00:24:46,719
I think they call it.
900
00:24:46,729 --> 00:24:48,280
I'm not sure when printing what they call that,
901
00:24:48,290 --> 00:24:50,560
but you have the original plates and there was a price tag at,
902
00:24:50,569 --> 00:24:50,739
you know,
903
00:24:50,750 --> 00:24:52,589
250 bucks or whatever it was.
904
00:24:52,780 --> 00:24:54,300
I don't remember what the price was and I'm like,
905
00:24:54,310 --> 00:24:54,319
uh,
906
00:24:54,329 --> 00:24:54,560
no,
907
00:24:54,569 --> 00:24:55,219
I don't need it,
908
00:24:55,229 --> 00:24:55,660
you know,
909
00:24:55,989 --> 00:25:02,869
and now I regret the fact that I didn't do that because I would have the in the original plates for the printing that I could take anywhere and do.
910
00:25:03,030 --> 00:25:04,619
And now you have to start all over again.
911
00:25:04,630 --> 00:25:06,380
So anybody out there that's looking at authoring a book,
912
00:25:06,390 --> 00:25:09,920
if you get offered the opportunity to buy those original I don't know what they call them,
913
00:25:09,930 --> 00:25:13,170
anybody know what they call them or whatever.
914
00:25:13,270 --> 00:25:13,359
Yeah.
915
00:25:13,369 --> 00:25:18,079
From the printing of the actual book I should have bought them because then I have those,
916
00:25:18,089 --> 00:25:18,400
right?
917
00:25:18,410 --> 00:25:19,920
Otherwise they just destroy them.
918
00:25:19,930 --> 00:25:20,109
Right.
919
00:25:20,119 --> 00:25:21,420
Start all over again.
920
00:25:22,099 --> 00:25:22,290
Well,
921
00:25:22,300 --> 00:25:27,000
you guys are touching on some interesting things because as creators,
922
00:25:27,010 --> 00:25:28,410
as storytellers,
923
00:25:28,500 --> 00:25:31,589
our inclination is to create,
924
00:25:31,859 --> 00:25:34,619
set behind us and continue to create.
925
00:25:34,939 --> 00:25:38,380
So and there's probably people listening that are like nodding their heads.
926
00:25:38,390 --> 00:25:38,849
It's like,
927
00:25:38,859 --> 00:25:39,150
yeah,
928
00:25:39,160 --> 00:25:41,380
when was the last time you stepped back?
929
00:25:41,390 --> 00:25:43,760
And you looked at the collection of all of your,
930
00:25:43,770 --> 00:25:44,800
all of your work,
931
00:25:44,810 --> 00:25:45,890
all of your art,
932
00:25:45,900 --> 00:25:47,650
all of your inventions.
933
00:25:47,660 --> 00:25:47,719
Well,
934
00:25:47,729 --> 00:25:48,310
the thing is where do you,
935
00:25:48,319 --> 00:25:49,369
where do you put it?
936
00:25:49,790 --> 00:25:50,280
Right.
937
00:25:50,290 --> 00:25:51,219
That's the next thing.
938
00:25:51,280 --> 00:25:51,380
Yeah,
939
00:25:51,390 --> 00:25:51,619
and,
940
00:25:51,630 --> 00:25:53,500
and like format and all that kind of stuff.
941
00:25:53,569 --> 00:25:54,579
I don't mean that,
942
00:25:54,910 --> 00:25:55,199
I mean,
943
00:25:55,209 --> 00:25:55,880
a lot of people,
944
00:25:55,890 --> 00:25:59,680
they just have it in their name or they might have it in a business's name,
945
00:25:59,689 --> 00:26:01,439
but the thing they don't understand,
946
00:26:01,660 --> 00:26:07,010
you better have it in a trust because if it isn't locked in a trust when you leave this planet,
947
00:26:07,079 --> 00:26:08,239
it will be gone,
948
00:26:08,430 --> 00:26:09,359
it will be taken.
949
00:26:09,369 --> 00:26:10,719
And you hear that all the time,
950
00:26:10,729 --> 00:26:12,380
there's a lot of people that,
951
00:26:12,390 --> 00:26:13,680
that don't have trust that,
952
00:26:13,689 --> 00:26:14,160
you know,
953
00:26:14,170 --> 00:26:14,209
and,
954
00:26:14,219 --> 00:26:14,979
and that's an easy,
955
00:26:14,989 --> 00:26:16,560
that's an easy thing to set up,
956
00:26:16,569 --> 00:26:16,810
you know,
957
00:26:16,819 --> 00:26:18,300
contact your lawyer and,
958
00:26:18,359 --> 00:26:18,699
and say,
959
00:26:18,709 --> 00:26:18,920
look,
960
00:26:18,930 --> 00:26:22,040
I have to these assets and I don't want to put them into a truck but a lot of people,
961
00:26:22,050 --> 00:26:22,260
and I,
962
00:26:22,270 --> 00:26:22,880
and I'm not,
963
00:26:22,890 --> 00:26:23,069
you know,
964
00:26:23,079 --> 00:26:24,140
giving people advice,
965
00:26:24,150 --> 00:26:24,819
legal advice,
966
00:26:24,829 --> 00:26:27,839
but relative to our IP and what we're doing,
967
00:26:27,849 --> 00:26:28,800
everything is,
968
00:26:28,810 --> 00:26:29,660
is put into it.
969
00:26:29,670 --> 00:26:31,040
It's almost like,
970
00:26:31,050 --> 00:26:31,339
um,
971
00:26:31,550 --> 00:26:35,979
putting your personal will together but around your,
972
00:26:36,040 --> 00:26:37,219
your IP.
973
00:26:37,510 --> 00:26:37,979
Yes.
974
00:26:38,280 --> 00:26:38,609
Well,
975
00:26:38,619 --> 00:26:41,390
and you used an interesting word that I picked up on.
976
00:26:41,400 --> 00:26:41,770
Trust.
977
00:26:41,780 --> 00:26:43,250
It all boils down to trust.
978
00:26:43,260 --> 00:26:43,619
right?
979
00:26:43,630 --> 00:26:46,010
Because you have to trust that your information,
980
00:26:46,020 --> 00:26:46,780
your content,
981
00:26:46,790 --> 00:26:47,260
your product,
982
00:26:47,270 --> 00:26:49,949
whatever it is is protected because otherwise,
983
00:26:50,050 --> 00:26:52,099
can you trust that that won't be,
984
00:26:52,109 --> 00:26:52,410
you know,
985
00:26:52,420 --> 00:26:57,910
like you brought up a great example and I didn't even think about this if and when my final breath happens,
986
00:26:57,920 --> 00:26:59,109
what happens to my IP.
987
00:26:59,739 --> 00:27:01,170
Unless it's in a trust,
988
00:27:01,400 --> 00:27:07,020
it's wherever it ends up after that and you have family members and then they get into fun.
989
00:27:08,250 --> 00:27:08,719
They like,
990
00:27:09,300 --> 00:27:09,469
no,
991
00:27:09,609 --> 00:27:09,630
no,
992
00:27:10,140 --> 00:27:10,329
no,
993
00:27:10,339 --> 00:27:11,569
it's the other way around.
994
00:27:11,599 --> 00:27:11,790
It's like,
995
00:27:12,400 --> 00:27:12,630
no,
996
00:27:12,640 --> 00:27:15,709
it'll become popular when you take your final.
997
00:27:16,280 --> 00:27:21,354
That's the way it normally works in that world unless you're of us being still alive,
998
00:27:21,364 --> 00:27:21,765
I think.
999
00:27:21,775 --> 00:27:21,834
And,
1000
00:27:22,944 --> 00:27:23,035
well,
1001
00:27:23,074 --> 00:27:23,094
yeah,
1002
00:27:23,104 --> 00:27:24,025
he's in Kalamazoo,
1003
00:27:25,045 --> 00:27:25,545
Steve.
1004
00:27:26,175 --> 00:27:27,435
Don't tell Kurt our plan,
1005
00:27:27,734 --> 00:27:32,484
which they take my stuff and you can have someone,
1006
00:27:32,494 --> 00:27:36,864
someone has to die for this podcast to take off after the,
1007
00:27:36,875 --> 00:27:37,604
after our,
1008
00:27:37,635 --> 00:27:38,555
our series is done.
1009
00:27:38,564 --> 00:27:40,785
Can I suggest it's Bill our producer?
1010
00:27:42,349 --> 00:27:42,959
No,
1011
00:27:42,969 --> 00:27:43,380
no.
1012
00:27:43,709 --> 00:27:44,089
Well,
1013
00:27:44,099 --> 00:27:45,640
he said he's already dead inside.
1014
00:27:45,650 --> 00:27:47,199
So it doesn't matter,
1015
00:27:48,119 --> 00:27:49,770
whatever you're a I Joseph,
1016
00:27:49,780 --> 00:27:50,760
you were already killed.
1017
00:27:52,170 --> 00:27:53,060
So no one has to,
1018
00:27:53,069 --> 00:27:53,890
no one has to die.
1019
00:27:53,900 --> 00:27:54,800
Now you're already dead.
1020
00:27:54,849 --> 00:27:55,920
There's the story,
1021
00:27:56,140 --> 00:27:57,300
we have to protect that.
1022
00:27:57,890 --> 00:27:58,260
The A,
1023
00:27:58,270 --> 00:28:00,500
what I'll write a story on A I Joseph.
1024
00:28:00,510 --> 00:28:00,819
No,
1025
00:28:00,829 --> 00:28:03,699
I'll use a I to write the story in 20 minutes.
1026
00:28:04,069 --> 00:28:07,979
There's a story in the story like the w but what's,
1027
00:28:07,989 --> 00:28:08,229
you know,
1028
00:28:08,239 --> 00:28:08,260
I,
1029
00:28:08,270 --> 00:28:10,010
I think out of this whole conversation,
1030
00:28:10,020 --> 00:28:14,079
what's really important is understanding that there's value and that's something that,
1031
00:28:14,089 --> 00:28:14,439
you know,
1032
00:28:14,449 --> 00:28:15,979
you mentioned Joseph that we just,
1033
00:28:15,989 --> 00:28:17,040
our focus is creating,
1034
00:28:17,050 --> 00:28:17,239
right?
1035
00:28:17,250 --> 00:28:17,959
We just want to create,
1036
00:28:17,969 --> 00:28:18,699
we just want to create,
1037
00:28:18,709 --> 00:28:19,349
put it behind us,
1038
00:28:19,359 --> 00:28:19,630
create,
1039
00:28:19,640 --> 00:28:20,359
put it behind us.
1040
00:28:20,599 --> 00:28:20,849
And,
1041
00:28:20,859 --> 00:28:22,650
and I think about Thomas Kincade,
1042
00:28:22,660 --> 00:28:24,619
most people may not know Thomas Kincade,
1043
00:28:24,630 --> 00:28:28,079
but he's the painter of light Thomas painter behind our couch in our house.
1044
00:28:28,089 --> 00:28:29,310
And I don't know if you know the back story,
1045
00:28:29,319 --> 00:28:30,089
Thomas Kincade.
1046
00:28:30,099 --> 00:28:30,290
I mean,
1047
00:28:30,300 --> 00:28:30,459
he,
1048
00:28:30,469 --> 00:28:33,650
he was really in a really bad situation growing up,
1049
00:28:33,660 --> 00:28:33,819
right?
1050
00:28:33,829 --> 00:28:34,689
Very poor.
1051
00:28:34,969 --> 00:28:35,640
Um Anyway,
1052
00:28:35,650 --> 00:28:35,869
his,
1053
00:28:35,880 --> 00:28:39,489
his transcending the way he overcame that was by drawing and painting.
1054
00:28:39,869 --> 00:28:44,810
My reason for bringing it up is that he started painting these Hollywood sets and,
1055
00:28:44,819 --> 00:28:48,729
and painting landscapes and somebody saw him painting one day on the street and said,
1056
00:28:48,739 --> 00:28:48,969
wow,
1057
00:28:48,979 --> 00:28:49,170
that's,
1058
00:28:49,180 --> 00:28:49,930
that's amazing.
1059
00:28:49,939 --> 00:28:51,290
I I can help sell that.
1060
00:28:51,300 --> 00:28:53,319
And it's when the creator met the salesman.
1061
00:28:53,839 --> 00:28:54,810
And so they started,
1062
00:28:54,819 --> 00:28:55,189
you know,
1063
00:28:55,199 --> 00:29:00,329
selling things and then it became the fact that he was at a wedding one time and he sat next to somebody that said,
1064
00:29:00,339 --> 00:29:00,469
what,
1065
00:29:00,479 --> 00:29:01,010
what are you doing?
1066
00:29:01,020 --> 00:29:01,260
He's like,
1067
00:29:01,270 --> 00:29:01,329
well,
1068
00:29:01,339 --> 00:29:02,209
I'm a painter and they're like,
1069
00:29:02,219 --> 00:29:02,689
well,
1070
00:29:02,910 --> 00:29:03,140
you know,
1071
00:29:03,150 --> 00:29:03,709
how are you doing?
1072
00:29:03,719 --> 00:29:04,709
Who was running your business?
1073
00:29:05,089 --> 00:29:06,439
And it's when the,
1074
00:29:06,449 --> 00:29:13,650
the creator who had a salesman met the businessman and tied it all together and he became the first billion dollar commercial artist as a result.
1075
00:29:13,660 --> 00:29:14,819
It all started with that.
1076
00:29:14,829 --> 00:29:15,810
But my point is this,
1077
00:29:15,819 --> 00:29:16,050
that,
1078
00:29:16,060 --> 00:29:17,219
that then it ended.
1079
00:29:17,459 --> 00:29:17,739
Yeah.
1080
00:29:17,790 --> 00:29:19,430
And unfortunately tragically,
1081
00:29:19,439 --> 00:29:19,500
yeah,
1082
00:29:19,510 --> 00:29:19,739
absolutely.
1083
00:29:20,089 --> 00:29:20,750
But the,
1084
00:29:20,760 --> 00:29:20,819
the,
1085
00:29:20,829 --> 00:29:22,180
the point is the point,
1086
00:29:22,189 --> 00:29:25,189
the point is um business,
1087
00:29:25,680 --> 00:29:28,290
business aspect and what happened was he got,
1088
00:29:28,300 --> 00:29:28,729
well,
1089
00:29:28,739 --> 00:29:35,010
and then he got taken to the cleaners like it was a bad deal because they were running the kin cake galleries and then he ended up having to buy,
1090
00:29:35,479 --> 00:29:35,569
yeah,
1091
00:29:35,579 --> 00:29:35,949
he had,
1092
00:29:35,959 --> 00:29:37,500
he had to buy it back and then,
1093
00:29:37,540 --> 00:29:37,650
yeah.
1094
00:29:37,760 --> 00:29:38,109
So,
1095
00:29:38,160 --> 00:29:40,989
but the point is the business side of it and the protection of that.
1096
00:29:41,000 --> 00:29:41,189
I mean,
1097
00:29:41,199 --> 00:29:41,489
he didn't.
1098
00:29:41,560 --> 00:29:41,589
Yeah.
1099
00:29:41,599 --> 00:29:42,670
And it's all he wanted to create.
1100
00:29:42,680 --> 00:29:43,329
That's all you wanted to do.
1101
00:29:43,339 --> 00:29:44,489
And it's a whole different skill set.
1102
00:29:44,500 --> 00:29:50,040
I'm so glad you're bringing this up because this is crucial for people listening out there that the creative people,
1103
00:29:50,050 --> 00:29:59,500
the storytellers um you need someone with a business mindset that understands these things because it's a whole different skill set uh to do this and,
1104
00:29:59,510 --> 00:30:04,969
and like you can go back in history and most inventors died poppers because they weren't,
1105
00:30:04,979 --> 00:30:06,739
they weren't good business people.
1106
00:30:06,750 --> 00:30:07,199
They were,
1107
00:30:07,209 --> 00:30:16,099
they were creatives and they were creating things and they were inventing things and they usually get screwed because someone with a business mindset comes in and like,
1108
00:30:16,109 --> 00:30:16,420
man,
1109
00:30:16,430 --> 00:30:19,270
I can make a ton of money on that and they,
1110
00:30:19,280 --> 00:30:20,660
they offer him the moon and they,
1111
00:30:20,670 --> 00:30:21,989
they cut him a bad deal.
1112
00:30:22,089 --> 00:30:22,560
And,
1113
00:30:22,569 --> 00:30:22,579
uh,
1114
00:30:22,589 --> 00:30:22,920
you know,
1115
00:30:22,930 --> 00:30:23,069
I mean,
1116
00:30:23,079 --> 00:30:23,380
you could,
1117
00:30:23,390 --> 00:30:28,900
you could list them like Eli Whitney Tesla on and on and on or they didn't protect their IP,
1118
00:30:29,219 --> 00:30:30,520
didn't we talking about today?
1119
00:30:31,209 --> 00:30:38,060
Talking about is a great example of someone that just wanted to give because there's two sides to the coin here.
1120
00:30:38,089 --> 00:30:41,849
You've got the side of securing and protecting your IP.
1121
00:30:42,209 --> 00:30:44,739
But there's a huge community of open source,
1122
00:30:44,750 --> 00:30:45,579
for example,
1123
00:30:45,619 --> 00:30:51,349
which is all about giving and what happens when you give other people add to that art,
1124
00:30:51,359 --> 00:30:51,800
right?
1125
00:30:51,810 --> 00:30:52,150
So say,
1126
00:30:52,160 --> 00:30:52,589
for example,
1127
00:30:52,599 --> 00:30:53,829
I write a small program and I,
1128
00:30:53,839 --> 00:30:54,650
I put it up on,
1129
00:30:54,660 --> 00:30:55,390
get up and I said,
1130
00:30:55,400 --> 00:30:55,810
look here,
1131
00:30:55,819 --> 00:30:57,069
download this and,
1132
00:30:57,079 --> 00:30:57,430
and,
1133
00:30:57,439 --> 00:30:57,810
and,
1134
00:30:57,819 --> 00:30:58,829
and add to it and,
1135
00:30:58,839 --> 00:31:02,760
and all of a sudden that becomes something even more amazing too.
1136
00:31:02,989 --> 00:31:05,650
So I'm not just saying secure,
1137
00:31:05,660 --> 00:31:07,400
everything that you do there,
1138
00:31:07,410 --> 00:31:12,760
there's other components to life where giving is good and giving to the community.
1139
00:31:12,770 --> 00:31:21,020
There are certain things that you should give because for the for the betterment of the world if you do give them and Tesla tried to do that many times and I,
1140
00:31:21,030 --> 00:31:25,810
we won't mention any names of who made that into a service.
1141
00:31:25,819 --> 00:31:30,589
But um the world would be a different place if Nikolai Tesla,
1142
00:31:31,319 --> 00:31:31,900
you know,
1143
00:31:31,910 --> 00:31:33,630
got what he wanted.
1144
00:31:33,640 --> 00:31:34,670
You work for Thomas Edison.
1145
00:31:35,189 --> 00:31:35,849
I didn't say that.
1146
00:31:37,510 --> 00:31:39,579
A I Joseph just said Thomas Edison,
1147
00:31:39,660 --> 00:31:40,140
you're already,
1148
00:31:40,150 --> 00:31:40,810
you're already dead.
1149
00:31:40,839 --> 00:31:41,420
You can say that.
1150
00:31:41,439 --> 00:31:41,819
That's all right.
1151
00:31:41,829 --> 00:31:42,489
I'm already dead.
1152
00:31:42,500 --> 00:31:42,890
You can,
1153
00:31:42,900 --> 00:31:43,869
you can't do anything to me.
1154
00:31:45,459 --> 00:31:46,489
So for our listeners,
1155
00:31:46,500 --> 00:31:49,780
protecting IP comes in all different fashions.
1156
00:31:49,790 --> 00:31:52,369
It comes with securing the content across the board,
1157
00:31:52,380 --> 00:31:54,089
social online.
1158
00:31:54,099 --> 00:31:55,209
But also like you just said,
1159
00:31:55,219 --> 00:31:55,500
though,
1160
00:31:55,510 --> 00:31:56,800
there is a time to give it away,
1161
00:31:56,810 --> 00:31:58,449
there is a time to give something away.
1162
00:31:58,459 --> 00:31:58,630
Yes,
1163
00:31:58,640 --> 00:31:59,359
definitely.
1164
00:31:59,369 --> 00:31:59,630
I mean,
1165
00:31:59,640 --> 00:32:02,130
if you think that it's bigger than you and it's bigger,
1166
00:32:02,140 --> 00:32:02,410
you know,
1167
00:32:02,420 --> 00:32:02,810
and,
1168
00:32:02,819 --> 00:32:03,310
and other,
1169
00:32:03,369 --> 00:32:05,609
and where other people can add to it,
1170
00:32:05,619 --> 00:32:06,130
right?
1171
00:32:06,140 --> 00:32:09,329
Because trying to negotiate that into contracts and it's like,
1172
00:32:09,339 --> 00:32:11,020
oh you created this piece and this piece,
1173
00:32:11,050 --> 00:32:12,959
it becomes such a headache.
1174
00:32:12,969 --> 00:32:13,819
It's,
1175
00:32:13,829 --> 00:32:15,589
it's probably just as easy to say,
1176
00:32:15,670 --> 00:32:17,719
I'm gonna make this open source and I,
1177
00:32:17,729 --> 00:32:19,739
and I want the ability to be able to use this.
1178
00:32:19,750 --> 00:32:21,520
I'm using technology as an example.
1179
00:32:21,530 --> 00:32:25,050
I wanna be able to use that technology for in my business and it becomes open source.
1180
00:32:25,060 --> 00:32:27,109
Wordpress is a prime example of that.
1181
00:32:27,119 --> 00:32:30,099
That's a word that's an open source application which many,
1182
00:32:30,109 --> 00:32:32,369
many developers have have worked on.
1183
00:32:32,550 --> 00:32:34,680
So I have a question back to one of the original questions.
1184
00:32:34,689 --> 00:32:35,550
Does it really matter?
1185
00:32:35,560 --> 00:32:35,719
I mean,
1186
00:32:35,729 --> 00:32:37,800
even if I go through all this of protecting,
1187
00:32:37,810 --> 00:32:38,000
of,
1188
00:32:38,010 --> 00:32:39,359
of solidifying,
1189
00:32:39,369 --> 00:32:39,479
you know,
1190
00:32:39,489 --> 00:32:42,739
making sure my domain URL all these things are are in tech.
1191
00:32:43,069 --> 00:32:44,219
Uh does it matter?
1192
00:32:44,229 --> 00:32:47,699
Why does it matter uh in the end for something like this?
1193
00:32:47,709 --> 00:32:49,349
It is part of the value as mentioned,
1194
00:32:49,359 --> 00:32:49,520
you know,
1195
00:32:49,530 --> 00:32:50,140
in Bill's book,
1196
00:32:50,150 --> 00:32:51,400
he talked about the value of that.
1197
00:32:51,410 --> 00:32:52,750
But how,
1198
00:32:52,760 --> 00:32:54,930
how do we assure that it is still protected?
1199
00:32:55,150 --> 00:32:56,680
So here this is my,
1200
00:32:57,479 --> 00:33:00,640
are you if you're asking me personally as I,
1201
00:33:00,650 --> 00:33:02,239
I'm only asking you professionally,
1202
00:33:02,250 --> 00:33:02,459
but yeah.
1203
00:33:02,469 --> 00:33:02,780
Ok.
1204
00:33:02,790 --> 00:33:03,880
If you want to answer it personally,
1205
00:33:03,890 --> 00:33:04,359
go ahead.
1206
00:33:05,689 --> 00:33:06,260
Well,
1207
00:33:06,270 --> 00:33:07,239
that's the same thing.
1208
00:33:07,250 --> 00:33:07,750
I mean,
1209
00:33:07,849 --> 00:33:09,439
you know what you see is what you get,
1210
00:33:09,689 --> 00:33:10,369
I'm sorry.
1211
00:33:10,579 --> 00:33:13,489
Uh I think protecting it and one of the thing,
1212
00:33:13,500 --> 00:33:13,589
you know,
1213
00:33:13,599 --> 00:33:14,770
Steve was talking about,
1214
00:33:14,959 --> 00:33:15,459
uh,
1215
00:33:15,739 --> 00:33:15,979
you know,
1216
00:33:15,989 --> 00:33:23,300
securing the rights and protecting you can still give people access to your protective IP and you know,
1217
00:33:23,670 --> 00:33:23,890
yeah,
1218
00:33:23,900 --> 00:33:24,599
and you want to,
1219
00:33:24,609 --> 00:33:24,989
but,
1220
00:33:25,000 --> 00:33:26,060
but you have like you,
1221
00:33:26,069 --> 00:33:30,680
then you have the say and the thing is people are still gonna steal like Picasso's quote,
1222
00:33:30,689 --> 00:33:30,920
you know,
1223
00:33:30,930 --> 00:33:32,560
people are still gonna steal.
1224
00:33:32,569 --> 00:33:33,699
And uh,
1225
00:33:33,709 --> 00:33:33,930
well,
1226
00:33:33,939 --> 00:33:34,500
we were ok,
1227
00:33:34,510 --> 00:33:37,329
we were talking to uh Dave cooler from,
1228
00:33:37,339 --> 00:33:39,219
from full house and Dave was,
1229
00:33:39,229 --> 00:33:41,140
we were having breakfast with him and he said,
1230
00:33:41,150 --> 00:33:41,780
uh he goes,
1231
00:33:41,790 --> 00:33:41,939
you know,
1232
00:33:41,949 --> 00:33:42,699
I tried to,
1233
00:33:42,709 --> 00:33:42,849
I,
1234
00:33:42,859 --> 00:33:44,219
I actually copyrighted that.
1235
00:33:44,229 --> 00:33:44,849
Cut it out,
1236
00:33:44,859 --> 00:33:45,020
you know,
1237
00:33:45,030 --> 00:33:45,569
his,
1238
00:33:45,829 --> 00:33:49,339
his signature move with the scissors and,
1239
00:33:49,349 --> 00:33:49,420
yeah,
1240
00:33:49,430 --> 00:33:50,229
they cut it out,
1241
00:33:50,239 --> 00:33:50,949
look up,
1242
00:33:51,050 --> 00:33:51,619
cut it out.
1243
00:33:51,630 --> 00:33:53,089
You'll know exactly what we're talking about.
1244
00:33:53,099 --> 00:33:53,489
But,
1245
00:33:53,500 --> 00:33:53,520
um,
1246
00:33:53,530 --> 00:33:56,380
he said so many people have used it on memes and this and that.
1247
00:33:56,390 --> 00:33:56,810
It's like,
1248
00:33:57,030 --> 00:33:57,489
you know,
1249
00:33:57,500 --> 00:33:57,739
it's,
1250
00:33:57,750 --> 00:33:58,969
it's copyrighted,
1251
00:33:58,979 --> 00:34:01,589
it's protected but people steal it all the time.
1252
00:34:01,599 --> 00:34:03,479
So then you have to make a decision is like,
1253
00:34:03,699 --> 00:34:03,989
you know,
1254
00:34:04,000 --> 00:34:07,569
is it worth chasing everyone or sending cease and desist letters?
1255
00:34:07,780 --> 00:34:08,870
Probably not.
1256
00:34:08,879 --> 00:34:14,648
But um that doesn't mean um you shouldn't protect it because it's just,
1257
00:34:14,658 --> 00:34:17,148
it's just a good business practice to have it protected.
1258
00:34:17,269 --> 00:34:18,769
So many people like all,
1259
00:34:18,779 --> 00:34:20,839
all the images you see online,
1260
00:34:21,218 --> 00:34:21,458
you know,
1261
00:34:21,468 --> 00:34:27,108
most of those are rights protected and people use them all the time um illegally,
1262
00:34:27,118 --> 00:34:27,868
like you could,
1263
00:34:27,878 --> 00:34:31,368
you could pursue that and most people who put pictures up online,
1264
00:34:31,378 --> 00:34:32,628
if you ask for permission,
1265
00:34:32,858 --> 00:34:35,189
they would give you permission to use it.
1266
00:34:35,320 --> 00:34:35,459
Yeah.
1267
00:34:35,469 --> 00:34:38,709
And there's non royalty aspects of images and music,
1268
00:34:38,719 --> 00:34:40,899
but there's also the royalty aspect of it.
1269
00:34:40,989 --> 00:34:41,310
I mean,
1270
00:34:41,320 --> 00:34:42,090
I dealt with this with,
1271
00:34:42,100 --> 00:34:46,110
with my book from glory days because we had the images of the four Detroit teams,
1272
00:34:46,120 --> 00:34:47,040
the Pistons Tigers,
1273
00:34:47,050 --> 00:34:47,760
red Wings and lions.
1274
00:34:47,770 --> 00:34:54,300
And that I gotta tell you that was a quite a experience in learning process because of the licensing with each of those jerseys,
1275
00:34:54,310 --> 00:34:54,429
right?
1276
00:34:54,439 --> 00:34:56,709
We had a picture of each jersey in the front of the cover.
1277
00:34:56,919 --> 00:34:57,179
And,
1278
00:34:57,189 --> 00:34:57,800
and to be honest,
1279
00:34:57,810 --> 00:35:03,659
one of the most difficult was that old English tea from the Detroit Tigers because the Detroit Tigers do not own that.
1280
00:35:03,669 --> 00:35:07,239
That's owned by major league baseball properties incorporated in New York City.
1281
00:35:07,449 --> 00:35:13,429
And we had to go about three months back and forth with legal paperwork and they literally want us to have a,
1282
00:35:13,439 --> 00:35:13,770
um,
1283
00:35:13,780 --> 00:35:16,250
$4 million liability policy on the book.
1284
00:35:16,260 --> 00:35:16,610
And I'm like,
1285
00:35:16,620 --> 00:35:19,340
what somebody gonna get a paper cut and sue major league baseball.
1286
00:35:19,530 --> 00:35:20,389
But literally,
1287
00:35:20,399 --> 00:35:21,780
so we went back and forth for a while.
1288
00:35:21,790 --> 00:35:22,229
And finally,
1289
00:35:22,239 --> 00:35:22,649
they were like,
1290
00:35:22,659 --> 00:35:22,969
well,
1291
00:35:22,979 --> 00:35:23,350
you know,
1292
00:35:23,899 --> 00:35:24,500
you have,
1293
00:35:24,510 --> 00:35:24,520
uh,
1294
00:35:24,530 --> 00:35:25,810
heirs and omissions to the publisher,
1295
00:35:25,820 --> 00:35:26,090
right on the,
1296
00:35:26,100 --> 00:35:26,120
yeah,
1297
00:35:26,129 --> 00:35:26,830
of course,
1298
00:35:27,159 --> 00:35:27,530
they said,
1299
00:35:27,540 --> 00:35:27,729
all right.
1300
00:35:27,739 --> 00:35:27,870
Well,
1301
00:35:27,879 --> 00:35:28,530
let's cut the,
1302
00:35:28,540 --> 00:35:30,850
the 5 $4 million liability policy,
1303
00:35:30,860 --> 00:35:37,290
but you still have to sign this six page licensing agreement that's very strict about what you can do and can't do with that image.
1304
00:35:37,459 --> 00:35:39,270
And so my point is this that they,
1305
00:35:39,280 --> 00:35:39,479
that,
1306
00:35:39,489 --> 00:35:39,770
you know,
1307
00:35:39,780 --> 00:35:41,010
you talk about supports.
1308
00:35:41,020 --> 00:35:43,270
It was one of our previous conversations,
1309
00:35:43,280 --> 00:35:43,909
an episode,
1310
00:35:44,250 --> 00:35:50,280
but sports have a huge IP that they protect and they're marketing monsters and their,
1311
00:35:50,429 --> 00:35:54,780
and their merchandise and you have to prove authenticity of those merchandise.
1312
00:35:54,790 --> 00:35:54,909
I mean,
1313
00:35:54,919 --> 00:35:57,750
like if something is signed like a helmet or a shirt,
1314
00:35:57,760 --> 00:36:00,399
you normally comes with a certificate that says this is authentic,
1315
00:36:00,419 --> 00:36:00,800
right?
1316
00:36:01,060 --> 00:36:12,219
So authenticity is a major part of securing IP and IP can be a shirt as soon as I sign or a ball and it says it's got to have the official license,
1317
00:36:12,229 --> 00:36:13,409
property of whatever,
1318
00:36:13,419 --> 00:36:13,560
you know,
1319
00:36:13,570 --> 00:36:14,989
the tag those tags are on there.
1320
00:36:15,000 --> 00:36:15,429
Well,
1321
00:36:15,439 --> 00:36:15,889
so Steve,
1322
00:36:15,899 --> 00:36:19,830
you've got a story about the uh hero's journey so that the,
1323
00:36:19,840 --> 00:36:27,250
the series we're working on with the uh the black musical artists and the name Hero's Journey.
1324
00:36:27,560 --> 00:36:29,100
Uh You got a letter,
1325
00:36:29,110 --> 00:36:31,489
we got a letter from uh from the Joseph Campbell.
1326
00:36:31,500 --> 00:36:31,739
Found.
1327
00:36:32,229 --> 00:36:32,629
Correct?
1328
00:36:32,639 --> 00:36:32,800
Yeah.
1329
00:36:32,810 --> 00:36:33,570
So Joseph Campbell,
1330
00:36:33,580 --> 00:36:34,610
for those that don't know,
1331
00:36:34,620 --> 00:36:39,649
is uh a mythologist who uh coined the term the hero's journey.
1332
00:36:39,659 --> 00:36:39,850
And he,
1333
00:36:39,860 --> 00:36:44,370
he kind of came up with the model for the progression of the hero's journey,
1334
00:36:44,439 --> 00:36:46,949
um uh probably like 50 years ago.
1335
00:36:46,959 --> 00:36:49,810
So now it's owned by a non-profit foundation,
1336
00:36:49,820 --> 00:36:50,469
but go ahead.
1337
00:36:50,800 --> 00:36:51,010
Yeah,
1338
00:36:51,020 --> 00:36:52,139
and basically said,
1339
00:36:52,149 --> 00:36:52,489
they said,
1340
00:36:52,500 --> 00:36:52,850
listen,
1341
00:36:52,860 --> 00:36:54,350
you can use Hero's journey.
1342
00:36:54,360 --> 00:36:57,010
The series as long as you're not referring to,
1343
00:36:57,090 --> 00:36:59,689
I think it's a 17 step process of heroes,
1344
00:36:59,830 --> 00:37:00,389
different,
1345
00:37:00,399 --> 00:37:00,689
yeah,
1346
00:37:00,699 --> 00:37:01,550
different,
1347
00:37:02,060 --> 00:37:02,929
different stages.
1348
00:37:02,939 --> 00:37:04,340
But that's basically what they were saying.
1349
00:37:04,350 --> 00:37:04,919
So,
1350
00:37:04,929 --> 00:37:07,530
um we wrote a letter and my attorney wrote a letter back and said,
1351
00:37:07,540 --> 00:37:07,719
no,
1352
00:37:07,729 --> 00:37:09,100
we're not referring to that at all.
1353
00:37:09,110 --> 00:37:14,570
We're just using the name Hero's journey because these musicians are going on a hero's journey and it's a series of,
1354
00:37:14,580 --> 00:37:16,199
of different artists and you know,
1355
00:37:16,209 --> 00:37:16,780
that type of thing.
1356
00:37:17,000 --> 00:37:19,360
And um immediately they sent back a letter and said,
1357
00:37:19,370 --> 00:37:19,689
fine,
1358
00:37:19,699 --> 00:37:20,270
go ahead.
1359
00:37:20,639 --> 00:37:20,919
Yeah.
1360
00:37:20,929 --> 00:37:23,270
So that's how easy it can become.
1361
00:37:23,280 --> 00:37:29,590
But what ha when bad things happen is when you don't do that and you don't try to,
1362
00:37:29,600 --> 00:37:30,090
you know,
1363
00:37:30,100 --> 00:37:33,709
do it the right way and you just take and that's what a lot of people do.
1364
00:37:33,719 --> 00:37:34,090
Like you,
1365
00:37:34,100 --> 00:37:35,209
you guys were talking about,
1366
00:37:35,219 --> 00:37:38,229
people take images and they do that and then you're gonna get yourself into trouble.
1367
00:37:38,239 --> 00:37:39,520
Someone's gonna come after you,
1368
00:37:39,800 --> 00:37:40,100
right?
1369
00:37:40,520 --> 00:37:40,939
So it's,
1370
00:37:40,949 --> 00:37:43,929
it's not about um being litigious or like,
1371
00:37:43,939 --> 00:37:44,169
you know,
1372
00:37:44,179 --> 00:37:44,810
when we began,
1373
00:37:44,820 --> 00:37:47,010
it's like it's not about suing people.
1374
00:37:47,020 --> 00:37:50,370
It's just about sound business practices.
1375
00:37:50,379 --> 00:37:53,750
And if you believe that your intellectual property,
1376
00:37:53,760 --> 00:37:54,050
that the,
1377
00:37:54,060 --> 00:37:56,830
your creative assets have value,
1378
00:37:56,929 --> 00:37:58,909
it's important that you protect them.
1379
00:37:58,919 --> 00:37:59,600
I think that's,
1380
00:37:59,669 --> 00:37:59,919
you know,
1381
00:37:59,929 --> 00:38:00,949
that's really the,
1382
00:38:01,189 --> 00:38:02,689
the simple message,
1383
00:38:02,699 --> 00:38:04,030
uh the simple message.
1384
00:38:04,199 --> 00:38:05,399
That's the story.
1385
00:38:05,699 --> 00:38:05,860
Yeah,
1386
00:38:05,870 --> 00:38:07,419
that's the story and you're sticking to it.
1387
00:38:08,020 --> 00:38:10,189
So Steve just ended the whole episode.
1388
00:38:11,389 --> 00:38:12,969
No closure needed at this point.
1389
00:38:12,979 --> 00:38:13,860
There you go.
1390
00:38:14,229 --> 00:38:14,899
So uh yeah,
1391
00:38:14,909 --> 00:38:15,459
but we,
1392
00:38:15,469 --> 00:38:17,100
but I can't leave it at that.
1393
00:38:18,610 --> 00:38:18,969
So yeah,
1394
00:38:18,979 --> 00:38:19,620
so wrap up.
1395
00:38:19,629 --> 00:38:19,959
So like,
1396
00:38:19,969 --> 00:38:20,090
you know,
1397
00:38:20,100 --> 00:38:21,570
from your personal experience,
1398
00:38:22,050 --> 00:38:22,239
you know,
1399
00:38:22,250 --> 00:38:23,260
protecting your story,
1400
00:38:23,270 --> 00:38:25,100
how important is it and why should you do it?
1401
00:38:25,760 --> 00:38:28,090
Um Protecting your story is the most as we,
1402
00:38:28,100 --> 00:38:28,810
we always say,
1403
00:38:28,820 --> 00:38:29,260
we don't,
1404
00:38:29,270 --> 00:38:30,330
you don't protect your story.
1405
00:38:30,340 --> 00:38:32,649
Someone else is gonna take your story for you.
1406
00:38:32,659 --> 00:38:35,090
It's that simple and you got all the lines today.
1407
00:38:35,350 --> 00:38:35,629
Well,
1408
00:38:36,129 --> 00:38:37,330
you've taught me well.
1409
00:38:38,510 --> 00:38:39,379
That's sweet.
1410
00:38:39,699 --> 00:38:40,949
And I love your pink shirt.
1411
00:38:43,209 --> 00:38:43,469
Yeah,
1412
00:38:43,479 --> 00:38:43,949
for me,
1413
00:38:43,959 --> 00:38:48,570
I think the biggest thing in the takeaway is that we have all ideas.
1414
00:38:48,580 --> 00:38:49,530
We all have ideas,
1415
00:38:49,540 --> 00:38:49,699
right?
1416
00:38:49,709 --> 00:38:51,260
We all have ideas that we create and,
1417
00:38:51,399 --> 00:38:58,270
but I think one of the biggest things is I don't know what my idea might become tomorrow and to be safe,
1418
00:38:58,280 --> 00:39:01,590
to protect that idea today because you don't know what's gonna come tomorrow.
1419
00:39:01,600 --> 00:39:07,330
I didn't know that my book was gonna turn into a TV show to turn in all these other aspects into trans media after this,
1420
00:39:07,340 --> 00:39:07,560
right?
1421
00:39:07,570 --> 00:39:09,889
Which it has and it will continue to morph into.
1422
00:39:10,120 --> 00:39:12,949
And so protecting that I think is really important because,
1423
00:39:13,189 --> 00:39:13,570
you know,
1424
00:39:13,580 --> 00:39:14,050
having,
1425
00:39:14,060 --> 00:39:15,370
having that hindsight now,
1426
00:39:15,379 --> 00:39:16,129
I can see it,
1427
00:39:16,139 --> 00:39:17,209
but at that time I did.
1428
00:39:17,219 --> 00:39:18,709
And so that's why it's important to say,
1429
00:39:18,719 --> 00:39:19,100
boy,
1430
00:39:19,110 --> 00:39:20,860
take the time to research,
1431
00:39:20,870 --> 00:39:22,139
collect and do.
1432
00:39:22,149 --> 00:39:23,330
What's the other thing that Bill said,
1433
00:39:23,360 --> 00:39:23,989
protect,
1434
00:39:24,000 --> 00:39:24,979
protect,
1435
00:39:24,989 --> 00:39:25,320
right?
1436
00:39:25,330 --> 00:39:28,290
So those three aspects very important and I'll just,
1437
00:39:28,300 --> 00:39:29,530
I'll just echo that before we,
1438
00:39:29,540 --> 00:39:30,790
before we wrap up,
1439
00:39:30,800 --> 00:39:32,689
just going through that process,
1440
00:39:32,780 --> 00:39:36,129
it's gonna change the way you think about the things that you're creating.
1441
00:39:36,139 --> 00:39:36,530
Uh to,
1442
00:39:36,540 --> 00:39:36,949
to me,
1443
00:39:36,959 --> 00:39:45,969
it really kind of codifies and solidifies a lot of creative ideas and really it forces you by going through that through that process of research,
1444
00:39:45,979 --> 00:39:47,570
collect and protect into,
1445
00:39:47,580 --> 00:39:52,469
into really looking at the broader picture and pulling that thread all the way through.
1446
00:39:52,629 --> 00:39:57,110
So um if any of you out there want more information,
1447
00:39:57,120 --> 00:39:58,310
we highly recommend.
1448
00:39:58,590 --> 00:40:02,020
Uh So Bill Honaker also known as the IP Guy,
1449
00:40:02,189 --> 00:40:04,719
you can go to IP guy dot com.
1450
00:40:04,729 --> 00:40:11,510
He's got some really good free content there and information about securing your story and securing your IP.
1451
00:40:11,520 --> 00:40:13,580
So we highly recommend that.
1452
00:40:13,590 --> 00:40:15,060
And uh that's a good one,
1453
00:40:15,070 --> 00:40:15,560
guys.
1454
00:40:15,929 --> 00:40:16,439
Thank you.
1455
00:40:16,489 --> 00:40:17,360
And this is protected.

our,
1458
00:40:17,429 --> 00:40:18,959
our podcast is protected.
1459
00:40:19,070 --> 00:40:19,610

00:40:20,290 --> 00:40:21,550
has a trademark on that too.
1461
00:40:21,810 --> 00:40:22,600
Take care everyone.
