After careful consideration, the Department is determined that ollc's prior opinions concerning the Constitution's prohibition on federal indictment and prosecution of a sitting president applied to the situation, and that, as a result, this prosecution must be dismissed before the defendant is inaugurated. In other words, they couldn't finish the job before inauguration day, and they weren't able to keep him out.

Smith cites the reason laid out in his motion to dismiss the election interference case and goes on to list those for the reasons step forth in the United States v. Trump, and he goes through all that. I won't bore you with it, but it's important now. Taken together, these moves marked the end of the federal prosecution against the President elect, leaving two remaining cases at the state level, one in Georgia, which was incredibly correct correct there and in New York. Stephen Chong, the incoming White House Communications Director, touted the enormous legal victories in a statement shared after Smith's filings saying, quote, the American people re elected President Trump with an overwhelming mandate to make America great again. Today's decision by the DOJ ends the unconstitutional federal case against President Trump and is a major victory for the rule of aw Now, I want to be clear, I don't believe this is a victory the way that he is describing it. And the reason why I say this is they want to do this again, and they will do this again if they're given the opportunity. The only reason why they were forced to make the decision and to do what they did on Monday, the only reason is because they lost the election. They do not believe they got this wrong. They do not believe that they should have stopped this. They have not learned from their mistakes. What do we say when kids get in trouble? You know, did you learn from your mistake?

They right are gearing up to fight Trump, but they're worried that the next administration will not be as slap dash and sloppy and crafting Trump's agenda, and the left will find it much harder to find ways to tear down Trump's plans. This is part of the reason why, as I mentioned in yesterday's show, that they're trying to sattle Donald Trump of World War iree and anarchy, chaos and a dumpster fire the day he comes into office, because that is their new way of trying to get him off of his agenda items for the United States of America. So is Trump two point zero gears up. These far left attackers fear they're in for a harder fight this time, The Times continues. Connecticut's Attorney General Tong, for one, told The Times that the ascendants of the GOP will present a hurdle and that Trump will probably hit the ground running this time. Bob Ferguson, that is Washington's state attorney general, agreed and said to the Times this morning quote, A concern I have is that Donald Trump's administration may well be better prepared on their end. Trump's party also will control three branches of the federal government and will have a reoccurring majority majority in the US Supreme Court, all of which sends a chill down the spines of the less law fair plans. But the plan is to repeat the tightal wave of legal attacks to scuttle the will of the voters by drowning Trump's agenda and nuance lawsuits, just like they did to knock back at Trump's first term, The Times continues. The state of Washington alone filed ninety nine lawsuits against Trump to stop his agenda between sixteen and twenty, the Times notes, and because of the flaws in the administration's crafting of orders and directives, the left coast state succeeded in most of its attempts to steimy Trump, winning fifty five of the ninety nine lawsuits that they filed. Indeed, the attacks during Trump's first term spurred the attorney generals of blue states to begin meeting to coordinate their schemes and attacks on conservatives and Republican principles all across the country. According to the New York Times reporting, blue state attorney generals have been having regular monthly meetings ever since Trump's first term, so they can coordinate their lawfare attacks coast to coasts, not just to oppose Trump, but to push their far left agenda everywhere and on everyone, using the courts as their weapon of choice. For his first term, Trump made the mistake of imagining that winning the election meant that he got to control the agenda in the narrative. But he soon discovered that the establishment picks he made for cabinet positions, and the combative and entrench administrative state that has been immune from the will of the voters was not adverse to using their insider powers to destroy Trump's plans to make America great again. After thousands of pages and hundreds of hours of interviews, it comes down to just six pages. Jack Smith the Special Council asking Judge Tanya Chutkin to dismiss this superseding indictment. This is the election interference case in Washington, d C. Where Donald Trump was charged with trying to overturn the results of the twenty twenty presidential election. Ultimately, Smith says that DOJ does not prosecute sitting president. This never went to trial. It was supposed to go to trial earlier this year. That never happened. So he's asking to dismiss this case. Separately, we're waiting to see if and how he's asking to move forward in the document's case in Florida. Now, you may say that case was dis miss this summer, and that's true. It was dismissed this summer. However, Jack Smith at the time he didn't know Donald Trump was going to win, and he filed an appeal with the Eleventh Circuit Court of Appeals in Atlanta. We're told that he's also going to be filing something soon winding down that case as well. So as of now, these cases are not officially dropped yet, but Smith is asking Judge Chutkin, who's expected to move along with it and say, Okay, we're going to drop this case because we cannot prosecute a sitting president separately. If I may add, President elect Trump said that he would fire Jack Smith within quote two seconds of taking office. It doesn't appear that the President of the elect will even have the opportunity to do that because we've been reporting for several weeks now that Jack Smith will be gone. At that point on January twentieth, at noon, he will have stepped down. So at some point over the next several weeks he's going to step down. They're going to close up the Special Council office, and this case will not go to trials. So while it was expected, it's certainly a big deal to see that Special Counsel Jack Smith, has been a thorn in the side of Donald Trump for over two years, is officially asking a judge to drop his case.

After careful consideration, the Department is determined that ollc's prior opinions concerning the Constitution's prohibition on federal indictment and prosecution of a sitting president applied to the situation, and that, as a result, this prosecution must be dismissed before the defendant is inaugurated. In other words, they couldn't finish the job before inauguration day, and they weren't able to keep him out.

Smith cites the reason laid out in his motion to dismiss the election interference case and goes on to list those for the reasons step forth in the United States v. Trump, and he goes through all that. I won't bore you with it, but it's important now. Taken together, these moves marked the end of the federal prosecution against the President elect, leaving two remaining cases at the state level, one in Georgia, which was incredibly correct correct there and in New York. Stephen Chong, the incoming White House Communications Director, touted the enormous legal victories in a statement shared after Smith's filings saying, quote, the American people re elected President Trump with an overwhelming mandate to make America great again. Today's decision by the DOJ ends the unconstitutional federal case against President Trump and is a major victory for the rule of aw Now, I want to be clear, I don't believe this is a victory the way that he is describing it. And the reason why I say this is they want to do this again, and they will do this again if they're given the opportunity. The only reason why they were forced to make the decision and to do what they did on Monday, the only reason is because they lost the election. They do not believe they got this wrong. They do not believe that they should have stopped this. They have not learned from their mistakes. What do we say when kids get in trouble? You know, did you learn from your mistake?

The sloppy style of writing directives invited the left to find a never ending series of well lawsuits to throw at Trump's orders. That is the exact wording of the New York Times this time. For Trump's second bite at the Apple, Democrats and leftist non governmental organizations. They right are gearing up to fight Trump, but they're worried that the next administration will not be as slap dash and sloppy and crafting Trump's agenda, and the left will find it much harder to find ways to tear down Trump's plans. This is part of the reason why, as I mentioned in yesterday's show, that they're trying to sattle Donald Trump of World War iree and anarchy, chaos and a dumpster fire the day he comes into office, because that is their new way of trying to get him off of his agenda items for the United States of America. So is Trump two point zero gears up. These far left attackers fear they're in for a harder fight this time, The Times continues. Connecticut's Attorney General Tong, for one, told The Times that the ascendants of the GOP will present a hurdle and that Trump will probably hit the ground running this time. Bob Ferguson, that is Washington's state attorney general, agreed and said to the Times this morning quote, A concern I have is that Donald Trump's administration may well be better prepared on their end. Trump's party also will control three branches of the federal government and will have a reoccurring majority majority in the US Supreme Court, all of which sends a chill down the spines of the less law fair plans. But the plan is to repeat the tightal wave of legal attacks to scuttle the will of the voters by drowning Trump's agenda and nuance lawsuits, just like they did to knock back at Trump's first term, The Times continues. The state of Washington alone filed ninety nine lawsuits against Trump to stop his agenda between sixteen and twenty, the Times notes, and because of the flaws in the administration's crafting of orders and directives, the left coast state succeeded in most of its attempts to steimy Trump, winning fifty five of the ninety nine lawsuits that they filed. Indeed, the attacks during Trump's first term spurred the attorney generals of blue states to begin meeting to coordinate their schemes and attacks on conservatives and Republican principles all across the country. According to the New York Times reporting, blue state attorney generals have been having regular monthly meetings ever since Trump's first term, so they can coordinate their lawfare attacks coast to coasts, not just to oppose Trump, but to push their far left agenda everywhere and on everyone, using the courts as their weapon of choice. For his first term, Trump made the mistake of imagining that winning the election meant that he got to control the agenda in the narrative. But he soon discovered that the establishment picks he made for cabinet positions, and the combative and entrench administrative state that has been immune from the will of the voters was not adverse to using their insider powers to destroy Trump's plans to make America great again. And guess what, America, You can expect exactly that this time. And that's why I go back to what I said. Jack Smith didn't surrender. Jack Smith didn't end the prosecutions against Trump. Speaker 11: After almost two years of this, Jack Smith saga, things seemed to be ending for him. We just need the judge to sign off on it. After thousands of pages and hundreds of hours of interviews, it comes down to just six pages. Jack Smith the Special Council asking Judge Tanya Chutkin to dismiss this superseding indictment. This is the election interference case in Washington, d C. Where Donald Trump was charged with trying to overturn the results of the twenty twenty presidential election. Ultimately, Smith says that DOJ does not prosecute sitting president. This never went to trial. It was supposed to go to trial earlier this year. That never happened. So he's asking to dismiss this case. Separately, we're waiting to see if and how he's asking to move forward in the document's case in Florida. Now, you may say that case was dis miss this summer, and that's true. It was dismissed this summer. However, Jack Smith at the time he didn't know Donald Trump was going to win, and he filed an appeal with the Eleventh Circuit Court of Appeals in Atlanta. We're told that he's also going to be filing something soon winding down that case as well. So as of now, these cases are not officially dropped yet, but Smith is asking Judge Chutkin, who's expected to move along with it and say, Okay, we're going to drop this case because we cannot prosecute a sitting president separately. If I may add, President elect Trump said that he would fire Jack Smith within quote two seconds of taking office. It doesn't appear that the President of the elect will even have the opportunity to do that because we've been reporting for several weeks now that Jack Smith will be gone. At that point on January twentieth, at noon, he will have stepped down. So at some point over the next several weeks he's going to step down. They're going to close up the Special Council office, and this case will not go to trials. So while it was expected, it's certainly a big deal to see that Special Counsel Jack Smith, has been a thorn in the side of Donald Trump for over two years, is officially asking a judge to drop his case.
