Scott Kesterson on the Second Amendment: “The right does not need a court’s permission because the right came first.”
WHAT THIS EPISODE COVERS
Scott Kesterson continues his series on how false beliefs become accepted as truth, with a look at how the Declaration of Independence was separated from the Constitution in court. He follows the case law from Calder v. Bull in 1798 through Dred Scott, the Black Codes, the Slaughter-House Cases, Colfax, and Cruikshank, to Heller, McDonald, and Bruen. Scott argues the Declaration asks one question of every gun law: by what authority?
KEY QUESTIONS ADDRESSED
- Where do our rights come from according to the Declaration of Independence, and how did courts separate it from the Constitution?
- What did the Slaughter-House Cases and Cruikshank decide about federal protection of the right to bear arms?
- What do DeShaney and Castle Rock say about police protection, and why does Scott say that matters for the Second Amendment?
