Former Massachusetts State Police Trooper Michael Proctor was scheduled to testify at a hearing regarding a motion to dismiss in the Myles King murder case, but unexpectedly exercised his Fifth Amendment right against self-incrimination after a private sidebar with the judge. Defense attorney Rosemary Scapicchio expressed frustration over the sudden reversal, as Proctor's lawyer had previously indicated he would testify. Scapicchio argued that Proctor's lead role in the investigation tainted the case due to explicit racial bias demonstrated in his text messages, asserting this constitutes structural error warranting dismissal. The court order addressed discovery delays and police bias, mandating that remaining testimonies—including continued cross-examination of Attorney Adam Lally and statements from Milton police officers—proceed under narrow focus, with several witnesses submitting evidence via affidavit.
